UH, JOHN PROVIDED AN UPDATE ON TEXAS HOSPITAL HOSPITAL CAPACITY. UH, THE GOVERNOR NOTED THAT DESPITE AND UPTICK UPTICK IN POSITIVE COVID-19 CASES, THERE WAS CON THEY ARE CONTINUING TO BE AN ABUNDANT HOSPITAL CAPACITY. HERE'S ALL TEXANS TO CONTINUE TO DO THEIR PART, TO MITIGATE THE SPREAD OF COVID-19 AND LOOK OUT FOR THE HEALTH OF THEMSELVES AND THOSE AROUND THEM THAT WEEK LATER THAT WEEK, THERE WAS, UH, SOME CLARIFICATION FROM THE GOVERNOR THAT ALLOWED LOCAL OFFICIALS AT THE CITY AND COUNTY LEVEL TO REQUIRE MASKS IN BUSINESSES AND REQUIRE THE BUSINESSES TO HAVE A HEALTH PLAN THAT WOULD REQUIRE THOSE MASKS OF THEIR EMPLOYEES AND CUSTOMERS. SO ON FRIDAY, JUNE THE 19TH AT A SPECIAL MEETING OF THE DALLAS COUNTY COMMISSIONER'S COURT, THE COUNTY COMMISSIONERS APPROVED AN EXECUTIVE ORDER THAT REQUIRES ALL COMMERCIAL ENTITIES IN DALLAS COUNTY THAT PROVIDE GOODS AND SERVICES DIRECTLY TO THE PUBLIC. DO THEY, THEY ARE REQUIRED TO DEVELOP AND IMPLEMENT A HEALTH AND SAFETY POLICY. AND THE HEALTH AND SAFETY POLICY MUST REQUIRE AT A MINIMUM THAT ALL EMPLOYEES OR VISITORS TO THE COMMERCIAL ENTITY AND IT'S THESE BUSINESS PREMISES OR OTHER FACILITIES [00:05:01] WHERE FACE COVERED THE COMMERCIAL ENTITIES MUST POST THE HEALTH AND SAFETY POLICY AND IN, IN A VISIBLE PLACE. THIS APPLIES ONLY TO OUTDOOR GATHERINGS OVER 500 POUNDS. SO THE GOVERNOR HAS ALSO DIRECTED THE TEXAS HEALTH AND HUMAN SERVICES COMMISSION TO ENACT EMERGENCY RULES THAT PROVIDE STRICT HEALTH AND SAFETY STANDARDS AND PROCEDURES RELATED TO COVID-19 FOR CHILDCARE CENTERS IN TEXAS. THESE TWO ACTIONS, AGAIN, ARE BASED ON DATA SHOWING THAT AN INCREASE IN COVID-19 TRANSMISSION IS STEMMING FROM THE LARGE GATHERINGS, AS WELL AS CHILDCARE, UH, THINGS THAT ARE HAPPENING AT CHILDCARE CENTERS. SO THE GUIDANCE FROM THE STAKE, UH, CONTINUES TO ENCOURAGE US OR TO REMIND US THAT THE VIRUS THAT CAUSES COVID-19 IS STILL CIRCULATING IN OUR COMMUNITIES. AND WE SHOULD CONTRIBUTE TO CONTINUE TO OBSERVE PRACTICES THAT PROTECT EVERYONE, INCLUDING THOSE THAT ARE THE MOST VULNERABLE, THOSE HEALTH PRECAUTIONS AND SANITIZING GUIDELINES THAT WE WERE ENCOURAGED TO FOLLOW. AND THAT'S HAPPENING. I THINK MORE STRENUOUSLY BY THE GOVERNOR AND OTHERS AT THIS POINT IS THAT WHEN YOU CONTINUE TO WEAR APPROPRIATE FACE COVERINGS, UM, THAT PEOPLE MINIMIZE BEING IN GROUPS GREATER THAN 10, WHEN POSSIBLE PEOPLE OVER THE AGE OF 65 SHOULD STAY AT HOME AS MUCH AS POSSIBLE. AND PEOPLE ARE STILL BEING ASKED TO AVOID NURSING HOMES, STATE SUPPORT, LIVING CENTERS, ET CETERA, AND ULTIMATELY ARE THE LAST ONE, SORRY, IS TO CONTINUE TO PRACTICE SOCIAL DISTANCING, GOOD HYGIENE AND ENVIRONMENT, ENVIRONMENTAL FEMINISTS IN SANITATION, THE TOWN FACILITIES SUCH AS TOWN HALL, THE FINANCE BUILDING, THE SERVICE CENTER, ET CETERA, CONTINUE TO PROVIDE SERVICES VIRTUALLY AND ARE AVAILABLE TO MEET WITH RESIDENTS OR BUSINESSES ON AN APPOINTMENT BASIS. SO WE WON'T BE ABLE TO OPEN UP OUR FULL NORMAL HOURS RIGHT NOW WE'LL HAVE A CAPACITY OF 25%, WHICH IS 78 PEOPLE, RIGHT? WE HAVE WITH THE AREA THAT WE HAVE, WE'LL HAVE A HARD TIME, SOCIAL DISTANCING. THIS EVENING I HAVE FOR YOU A PRESENTATION THAT WILL, UH, PROVIDE SOME DETAILS AND CLARIFICATION OVER, UH, WHAT THE, UH, TOWN'S OPTIONS ARE WITH REGARDS TO CALCULATING THE TAX RATE IN LIGHT OF SENATE BILL TWO, WHICH WAS ADOPTED AT THE 2019 LEGISLATIVE SESSION, AND THEN THE DISASTER DECLARATION, UH, ASSOCIATED WITH COVID-19. SO JUST A, A RECAP OF WHAT SENATE BILL TWO IS SINCE THIS IS A, A BRAND NEW BILL AND THIS WAS GOING TO BE THE FIRST YEAR THAT THIS BILL WAS GOING TO BE IMPLEMENTED ANYWAY. SO THERE WERE SOME TERMINOLOGY CHANGES, AND I'M SURE THAT YOU'VE HEARD THE TERM EFFECTIVE TAX RATE. SO THIS BILL HAS CHANGED THAT TERM EFFECTIVE TAX RATE. IT IS NOW CALLED THE NO NEW TAX RATE, BUT THEY MEAN EXACTLY THE SAME THING. SO IT'S STILL THE TAX RATE THAT WILL GENERATE THE SAME AMOUNT OF REVENUE FROM THE SAME PROPERTIES AS THE PREVIOUS YEAR. SO IN THE, IN THIS EFFECTIVE OR NO NEW TAX RATE, UH, AGAIN, THIS IS THE SAME PROPERTIES AS THE PREVIOUS YEAR. SO ANY NEW PROPERTIES THERE THAT ARE ADDED TO THE TAX ROLL ARE NOT INCLUDED IN THIS RATE CALCULATION, UH, THE ROLLBACK RATE, WHICH WAS, UH, UH, THE OLD TERM THAT IS NOW CALLED THE VOTER APPROVAL TAX RATE. AND THEY, THEY MEAN THE SAME THING AGAIN. SO THIS IS THE MAXIMUM TAX RATE THAT CAN BE ADOPTED WITHOUT THE POSSIBILITY OF AN ELECTION TO OVERTURN THE ADOPTED TAX RATE. SO SOME OF THOSE, UH, RATES AND PROCESS CHANGES THAT WERE INCLUDED IN SENATE BILL TWO. SO THE VOTER APPROVAL RATE, WHICH WAS PREVIOUSLY CALLED THE ROLLBACK RATE IS NOW 3.5% ABOVE THE PRIOR YEAR COMPARED TO 8% BEFORE SENATE BILL TWO. SO BASICALLY THEY'VE REDUCED THAT A LITTLE MORE THAN HALF AS FAR AS WHAT A, UH, WHAT A LOCAL GOVERNMENT CAN INCREASE THE TAX RATE OR THE TAX LEVY BY, UH, WITHOUT GOING TO, UH, SOME TYPE OF A, UH, AN ELECTION PROCESS. AND NOW, UH, EXCEEDING THAT VOTER APPROVAL TAX RATE. IT TRIGGERS AUTOMATIC ELECTION, WHEREAS PREVIOUSLY AN ELECTION REQUIRED A PETITION BY REGISTERED VOTERS. UM, SO NOW IF YOU ARE GOING TO EXCEED THAT VOTER [00:15:01] APPROVAL TAX RATE, IT REALLY COMPRESSES THAT TIMELINE WITH WHICH A LOCAL GOVERNMENT HAS TO ADOPT THE TAX RATE AND BUDGET BECAUSE YOU HAVE TO MEET THAT UNIFORM ELECTION DATE AND BE 70. YOU HAVE TO BASICALLY, UH, ADOPT THAT TAX RATE 71 DAYS BEFORE THAT UNIFORM ELECTION DATE IN ORDER TO GET THAT, UH, ELECTION CALLED . UH, SO DISASTER DECLARATION. SO ON MARCH 13TH, UH, BOTH PRESIDENT TRUMP AND GOVERNOR ABBOTT, UH, DECLARED, UH, A NATIONAL EMERGENCY AND A STATE OF EMERGENCY FOR EVERY TEXAS COUNTY DUE TO COVID-19. SO WITHIN SENATE BILL TWO, THERE IS A DISASTER EXEMPTION. AND THESE ACTIONS BY THE PRESIDENT AND THE GOVERNOR TRIGGERED THIS DISASTER EXEMPTION, WHICH WOULD ALLOW A LOCAL GOVERNMENT TO DIRECT THE DESIGNATED OFFICER OR EMPLOYEE TO CALCULATE THAT VOTER APPROVAL TAX RATE AT 8% INSTEAD OF THREE AND A HALF PERCENT. SO IF YOU REMEMBER FROM THE FIRST SLIDE, 8% WAS WHAT, UH, LOCAL GOVERNMENTS WERE PREVIOUSLY ABLE TO USE. UH, SO THIS, THIS EXEMPTION, UH, BASICALLY TAKES US BACK TO WHERE WE WERE IN PREVIOUS YEARS. UH, AND THEN THIS, THIS, THIS DISASTER EXEMPTION, UH, IT REMAINS IN EFFECT FOR A MINIMUM OF TWO YEARS. SO IT WOULD BE, YOU KNOW, IF IT WOULD BE FIRST OF THE YEAR OF THE DISASTER, UH, IN THE SECOND YEAR OF TAXABLE VALUES INCREASED OVER THE, OVER WHAT THEY WERE IN THE YEAR OF DISASTER, THAT WOULD BE, UH, THE FINAL YEAR OF THE EXEMPTION. AND THEN, UH, IN THE SECOND YEAR, IF TAXABLE VALUES WERE LOWER THAN, UH, THE YEAR OF THE, UH, DISASTER, THEN IT WOULD EXTEND TO A THIRD YEAR. AND THEN THE THIRD YEAR IS THE FINAL YEAR. OKAY. AND THEN ANOTHER INTERESTING COMPONENT OF WHAT SENATE BILL TWO HAS. IT HAS A, WHAT THEY CALL BANKING. UH, SO SENATE BILL TWO ALLOWS, UH, FOR BANKING OR CARRYING FORWARD, THE DIFFERENCE BETWEEN THE VOTER APPROVED TAX RATE OR VOTER APPROVAL TAX RATE AND THE ADOPTED TAX RATE. AND THAT CAN BE ALLOCATED IN ANY WAY THAT THE GOVERNMENT SEES FIT OVER A COURSE OF THREE YEARS. SO, UM, WHATEVER TAX RATE GETS ADOPTED THIS YEAR, IF THERE'S A DIFFERENCE BETWEEN THE VOTER APPROVAL RATE AND WHATEVER THE ADOPTED TAX RATE IS, UH, THAT THE COUNCIL CAN APPLY THAT HOWEVER THEY WANT OVER ANY OF THE NEXT THREE YEARS OR, OR NOT AT ALL. SO IT'S COMPLETELY UP TO, UH, THE GOVERNING BODY. IT ALLOWS ENCORE TO CONSTRUCT AND OPERATE THE ELECTRIC TRANSMISSION AND DISTRIBUTION SYSTEM WITHIN ADDISON. THE FRANCHISE DIRECTS WHAT, WHERE AND HOW THIS HAPPENS AND ENCORE ACCESS TO OUR RIGHTS AWAY AND OTHER TOWN OWNED PROPERTIES, UM, FOR THEIR SYSTEM, IT PROVIDES THE TOWN TO COLLECT FEES FOR THE RIGHTS TO THAT ACCESS. IT DEFINES RESPONSIBILITIES FOR CONSTRUCTING, MAINTAINING, AND OPERATING THAT SYSTEM. IT PROTECTS THE TOWN'S RIGHTS REGARDING, UM, WHAT CAN, AND CAN'T BE ATTACHED TO THEIR INFRASTRUCTURE REGARDING ANCILLARY USES AND, UH, LIKE ANY AGREEMENT.
