THE EXECUTIVE ORDER G 18 IS EFFECTIVE IMMEDIATELY AND CONTINUES THROUGH MAY 15TH OF 2020 SUBJECT TO EXTENSION BASED ON THE STATUS OF THE COVEN 19 UH, SITUATION IN TEXAS AND THE RECOMMENDATIONS OF THE GOVERNOR'S STRIKE FORCE TO OPEN TEXAS EXECUTIVE ORDER GA 18 STATE KEEPS STAY HOME OR WORK AT HOME. UH, PROVISIONS IN PLACE EXCEPT TO ALLOW ACCESS TO ESSENTIAL OR REOPENING SERVICES WHILE FOLLOWING APPROPRIATE GUIDELINES. IT CONTINUES THE ORDER THAT RETAIL SERVICES MAY BE PROVIDED THROUGH PICKUP DELIVERY BY MAIL OR DELIVERY TO THE CUSTOMER'S DOORSTEP. UH, SAME THING WITH RESTAURANTS. PEOPLE OVER THE AGE OF 65, HOWEVER, ARE STRONGLY ENCOURAGED TO STAY AT HOME AS MUCH AS POSSIBLE TO MAINTAIN APPROPRIATE SOCIAL DISTANCE FROM ANY MEMBER OF THE HOUSE HOUSEHOLD WHO HAS BEEN OUT OF THE RESIDENCE AND THE PREVIOUS 14 DAYS. UH, THE SHORT ANSWER IS, IS IT DOESN'T DIFFER IN ANY SUBSTANTIVE FORM. AND IN FACT THAT WAS COUNTY IS IN THE PROCESS OF UPDATING THEIR ORDER, UH, WITH UPDATED LANGUAGE FROM THE GOVERNMENT. UH, SO FOR EXAMPLE, THE DALLAS COUNTY COMMISSIONER'S COURTS, UH, EXTENDED THEIR, UH, LOCAL ORDER AND SELL MAY THE 15TH, UH, THIS ORDER, THE GOVERNOR'S NEW ORDER IS ALSO UNTIL MAY THE 15TH. UM, SO THOSE THINGS ARE THE SAME. HAVING PEOPLE STAY AT HOME WHENEVER POSSIBLE IS STILL A PART OF THE GOVERNOR'S LATEST ORDER. THAT'S STILL THE ACCOUNTING WORLD. SO, UM, THE GOVERNOR'S ORDERS HAVE BEEN PUT OUT AND WHERE POTENTIAL LOCAL ORDERS CONFLICT WITH THE GOVERNOR'S ORDERS, UH, THE GUN, THE GOVERNOR'S ORDERS, BECAUSE THE GOVERNOR HAS SUSPENDED STATE LAW THAT PROVISION PROVISIONS ARE A PARTS OF STATE LAW CONTROL THE LOCAL ORDERS SO THAT LOCAL OWNERS HAVE TO BE PUT IN ALIGNMENT WITH THE GOVERNOR'S ORDERS. AND DALLAS COUNTY LARGELY ISN'T IN ALIGNMENT WITH THIS. UM, UH, AND THERE, LIKE I SAID, IN THE PROCESS OF UPDATING SOME LANGUAGE IN THEIR CURRENT, UH, VERSION OF THEIR ORDER TO MAKE SURE THAT THERE'S NO FUSION. I THINK WHEN YOU READ THE GOVERNOR'S ORDER AND YOU RE RE READ THE COUNTY'S ORDER [00:05:01] THERE, THERE ARE SOME, UH, SMALL WORDING DIFFERENCES. FOR EXAMPLE, WHERE THE GOVERNOR, OR EXCUSE ME, THE COUNTY MIGHT SAY SENIORS 65 AND OLDER, UH, UH, ARE REQUIRED TO STAY AT HOME. THE GOVERNOR DOESN'T SAY REQUIRED. THE GOVERNOR SAYS, ARE STRONGLY URGE IN EVERY POSSIBLE WAY TO STAY AT HOME. RIGHT? SO WITHOUT SAYING THE SAME WORD, THERE'S, THEY'RE, THEY'RE CONVEYING THE SAME MESSAGE. UM, UH, WHERE, YOU KNOW, FOR EXAMPLE, DALLAS COUNTY REQUIRES FACE MASKS OR FACE COVENANTS, EXCUSE ME, IN PUBLIC, UH, THE, THE GOVERNOR'S ORDER DOESN'T REQUIRE THEM BUT STRONGLY RECOMMENDS THEM. AND THE GOVERNOR'S ORDER SAYS YOU CAN'T HAVE ANY REGULATIONS WORK, ANY FINES OR PENALTIES FOR SOMEBODY WHO DOESN'T WEAR A FACE COVERING. AND THAT'S WHAT THE COUNTY'S ORDER SAYS AS WELL. SO FOR THOSE WHO ARE WONDERING WHAT THE DIFFERENCE IS BETWEEN THE TWO ORDERS, THERE'S NOT MUCH DIFFERENCE AT ALL. AND ANY DIFFERENCE WILL BE CLARIFY OR EXCUSE ME, UM, RESOLVE, UH, ONCE THE COUNTY IS USE AN ORDER THAT UPDATES THE COUNTY ORDER WITH THE GOVERNORS. SO THAT'S WHERE WE STAND. BUT, UM, BACK TO, TO THE GOVERNOR'S PHASED APPROACH TO OPENING TEXAS, UM, UH, STARTING ON MAY 1ST FRIDAY, MAY 1ST CONSECUTIVE ORDER OPENS UP THE FOLLOWING, UH, THE SERVICES OR SECTORS OF THE ECONOMY. AND IN ORDER TO BE ABLE TO, UH, HAVE THESE SECTORS OF THE ECONOMY OPEN UP, THEY HAVE TO MEET, UH, GUIDELINES THAT HAVE BEEN PROVIDED BY THE STATE IN THE CA IN THE GOVERNOR'S PLAN, UH, IN ORDER TO MAKE SURE THAT THE APPROPRIATE SOCIAL DISTANCES, UH, IS IN PLACE, GOOD HYGIENE, EXERCISE, ET CETERA. SO THESE SECTORS, UH, ARE THE SECTORS OF THE ECONOMY THAT ARE ABLE TO REOPEN IN STORE RETAIL SERVICES FOR RETAIL ESTABLISHMENT ESTABLISHMENT THAT OPERATE AT UP TO 25% OF THE TOTAL LIST, THAT OCCUPANCY OF THE RETAIL ESTABLISHMENT, DINING RESTAURANT SERVICES FOR RESTAURANTS THAT OPERATE AT UP TO 25% OF THE TOTAL LIST. THAT OCCUPANCY FOR THE RESTAURANT PROVIDED. HOWEVER, THAT, UH, A, THIS APPLIES ONLY TO RESTAURANTS THAT HAVE LESS THAN 51% OF THEIR GROSS RECEIPTS FROM THE SALE OF ALCOHOLIC BEVERAGES AND ARE THEREFORE NOT REQUIRED POST THE 51% SIGN REQUIRED BY TEXAS LAW IS DETERMINED BY THE TABC OR THE TEXAS ALCOHOLIC BEVERAGE COMMISSION. AND B VALET SERVICE SERVICES ARE PROHIBITED EXCEPT FOR VEHICLES WITH PLACARDS OR PLATES FOR DISABLED PARK, A MOVIE THEATERS THAT OPERATE AT UP TO 25% OF THE TOTAL LIST THAT OCCUPANCY OF ANY INDIVIDUAL THEATER FOR IN SCREEN SHOPPING MALLS THAT OPERATE, UH, UP TO 25% OF THE TOTAL LIST. THAT OCCUPANCY OF THE SHOPPING MALL PROVIDED, HOWEVER, THAT IN THE SHOPPING MALLS, THE FOOD COURT, DINING AREAS, PLAY AREAS AND INTERACTIVE DISPLAYS AND SETTINGS MUST BE, MUST'VE BEEN CLOSED. SO THAT DOESN'T APPLY TO DALLAS COUNTY, BUT THAT IS SOMETHING FOR MORE RURAL COUNTIES. UM, SERVICES PROVIDED BY AN INDIVIDUAL WORKING ALONE IN AN OFFICE MAY, UH, MAY RESUME AS THEY WORK PRE COBRAND THAT TEAM. YOU'LL NOTICE THAT THIS IS SPECIFIC TO SOLE PROPRIETORSHIPS. SO LET'S SAY A DALLAS COUNTY STARTS TO SHOW TRENDS OF COBIT 19, UH, INFECTION THAT, UM, YOU KNOW, THAT ARE GOING THE WRONG DIRECTION, THEN THE, THAT THEN THE GOVERNOR CAN IMPOSE A GREATER RESTRICTIONS ON DALLAS COUNTY, UH, FOR HIS, UH, PERFECT. SO, UM, IN ADDITION TO ORDERS, THE ORDERS THAT I JUST SHARE, PARTS OF THE ORDER I JUST SHARED, RELIGIOUS SERVICES SHOULD BE CONDUCTED IN ACCORDANCE WITH THE JOINT GUIDANCE ISSUED BY AND UPDATED BY THE ATTORNEY GENERAL AND THE GOVERNOR, WHICH MEANS, UH, TRY TO STAY AS WAY AS STAY AWAY AS MUCH AS POSSIBLE. THE, UH, THE SCOPE OF THIS PROJECT IS THE, THE TOTAL RECONSTRUCTION OF MIDWAY MIDWAY ROAD FROM SPRING VALLEY TO KELLER SPRINGS. IT INCLUDES THE REPLACEMENT OF THE PAVING DRAINAGE, WATER AND SEWER, SEWER LINES, UPGRADES TO THE TRAFFIC SIGNALS STREET LIGHTING, 10 FOOT SIDE PASS FROM SPRING VALLEY. THE BELTLINE AND CONNECTION TO THE COTTON BELT TRAIL AT THE WHEELER BRIDGE. THE FINAL PLANS FOR THIS PROJECT WERE RECEIVED BY STAFF LATE LAST YEAR, AND THE TOTAL [00:25:01] BUDGET FOR THIS PROJECT IS CURRENTLY AT $41 MILLION. SO THE FUNDING FOR THIS PROJECT WAS SET UP, UM, AND WE HAVE $16 MILLION APPROVED AS PART OF THE 2012 BOND PROGRAM. UM, IN 2018, COUNCIL DIRECTED, UH, THE CITY MANAGER TO PURSUE THE ISSUANCE OF UP TO $25 MILLION IN CERTIFICATES OF OBLIGATION. AND IN JULY OF LAST YEAR, 15 MILLION OF THAT $25 MILLION IN BONDS WERE ISSUED IN DECEMBER OF LAST YEAR. THE TOWN ENTER INTO AN AGREEMENT WITH, UH, DALLAS COUNTY TO FUND 50% OF THE TRAIL UPGRADE COST OF THIS PROJECT AND THE AMOUNT OF JUST UNDER 28 MILLION OR TWO POINT $8 MILLION. THE MAJOR EXPENSES TO DATE ON THE PROJECT OR THE DESIGN MANAGEMENT BY JACOBS ENGINEERING, $543,000. THE ACTUAL DESIGN BY AND PERKINS, TWO POINT $9 MILLION AND THE GEOTECHNICAL ANALYSIS OF ABOUT $47,000. OKAY. UM, AS PART OF THE PROPERTY ACQUISITION, UH, WE NEED TO ACQUIRE 25 SEPARATE PARCELS. FOR THIS PROJECT. THEY RANGE IN SIZE FROM A SMALL AS A HUNDRED SQUARE FEET TO AS LARGE AS 7,700 SQUARE FEET TO DATE, UH, 12 OR THE 25 PROPERTIES ARE UNDER CONTRACT OR HAVE BEEN ACQUIRED. SIX ARE STILL IN NEGOTIATIONS AND SEVEN ARE SLATED FOR IMMINENT DOMAIN. UH, WE CURRENTLY ESTIMATE THE COST OF THESE PROPERTIES AT THREE POINT $8 MILLION. THIS NUMBER WILL VARY SLIGHTLY DEPENDING ON THE FINAL VALUES ON OF THE PROPERTIES. UM, AS YOU, AS YOU'RE ALL AWARE, IN TEXAS, ANY CONTRACT OVER $50,000 MUST BE PROCURED UTILIZING COMPETITIVE BID PROCESS. UH, LOCAL GOVERNMENTS CAN DO THIS, UH, THROUGH COOPERATION WITH OTHER GOVERNMENT AGENCIES THAT HAVE ALREADY GONE THROUGH THIS PROCESS. IN THE LAST PRESENTATION TO COUNCIL, UH, ON THIS PROJECT, UH, THE THEY THOUGHT WAS PRESENTED ABOUT PARTNERING WITH DART AND THEIR CONTRACTOR ON THE SILVER LINE. PART OF PROJECT ARCHER WESTERN HURTS OFF. UM, TO THAT END, LATE LAST YEAR, STAFF SENT THE FINAL DESIGN DOCUMENTS, UH, TO ARCHER WESTERN HERTZOG FOR THEM TO PROVIDE PRICING ON THE PROJECT EARLIER THIS YEAR. RE RECEIVED THIS PRICING ALONG WITH DARTS COST ESTIMATES, UTILIZING RS MEANS FOR THE PROJECT. ARCHER WESTERN HERTZ SOGS COST ESTIMATE WAS $37 MILLION AND DARKS RS MEANS COST ESTIMATE WAS $42 MILLION. AND THESE COSTS WERE OBVIOUSLY NOT IN LINE WITH OUR ENGINEER'S OPINION OF PROBLEM COSTS, WHICH WAS 26 POINT $6 MILLION. BUT THIS LARGE DISPARITY IN NUMBERS CAUSED US TO REALLY TAKE A STEP BACK TO REEVALUATE OUR ESTIMATES TO MAKE SURE OUR NUMBERS WERE CORRECT AND NOT MORE IN LINES WITH ARCHER WESTERN HERTZOG OR THE RS MEANS NUMBERS. WHEN WE DID THIS, WE FOUND THAT MOST OF THE DIFFERENCE BETWEEN THOSE, THE NUMBERS WERE CONCENTRATED IN THE PAVING ITEMS REALLY IN THREE ITEMS, MOBILIZATION, PAVING, REMOVAL AND PAVING. SO WE TASKED, UH, UH, TAKING ON PERKINS OR DESIGNING ENGINEER TO REACH OUT TO SEVERAL, UH, MAJOR, MAJOR PAVING CONTRACTORS IN THIS AREA TO HAVE THEM TAKE A LOOK AT OUR PROJECT, TO GIVE US, TO VALIDATE OUR PRICING, UM, TO TELL US WHAT WOULD BE REASONABLE NUMBERS WITH THE SCOPE AND QUANTITIES OF WHAT WE WERE LOOKING FOR. AND WHEN WE ANALYZE THEIR NUMBERS, WE CAME AWAY WITH OUR PAVING REMOVAL ON PAVING NUMBERS WERE GOOD, BUT THE NUMBER WE HAD IN THERE FOR MOBILIZATION WAS REALLY NOT. SO WHEN WE UPDATED THIS NUMBER, IT INCREASED OUR OPINION OF PROBABLE COSTS FROM 26 POINT $6 MILLION TO 28 POINT $5 MILLION. AND THAT'S WHERE WE SIT TODAY AS WHERE WE BELIEVE THE ACTUAL CONSTRUCTION COSTS WILL COME IN. WELL, THE OTHER ITEMS WE WANTED TO ANALYZE, UM, WAS, WOULD THERE BE ANY EFFICIENCIES IN BREAKING THIS VERY LARGE PROJECT INTO TWO BID PACKAGES? AS YOU CAN IMAGINE, THE BIDDING POOL IS NOT VERY LARGE FOR THE NUMBER OF PEOPLE THAT CAN BOND A THIRD UP TO A $30 MILLION PROJECT. SO OUR THOUGHT WAS IF WE COULD BREAK IT INTO MAYBE TWO SMALLER PROJECTS, WE WOULD GET A LARGER, LARGER NUMBER OF COMPANIES INTERESTED IN BIDDING IT THAT COULD BOND IT. AND AS SUCH, WE WOULD HAVE A MORE COMPETITIVE BIDDING PROCESS. SO WE ASKED A TECHNOLOGY PERKINS TO LOOK AT IT TO SEE WHAT WOULD BE THE EFFECT OF THIS, UH, OF US SPLITTING IT APART. AND WHAT WE FOUND WAS THAT THE OPPOSITE WAS TRUE. UH, WHATEVER, UH, ADVANTAGES WE WOULD GAIN BY GETTING A LARGER, UH, BIDDING POOL WAS WELL OFFSET BY [00:30:01] THE LOSS OF, UH, OF EFFICIENCIES OF BREAKING IT INTO TWO AND THEN THAT RESULT WOULD BE AN INCREASE IN $1 MILLION IN COSTS AND AN ADDITIONAL $6 MILLION IN CONSTRUCTION COSTS. SO WE WOULD NOT RECOMMEND BREAKING THIS PROJECT INTO TWO BIDDING PACKAGES. THE NEXT THING THAT WE'VE ANALYZED, UH, SINCE THE LAST TIME THIS WAS PRESENTED WAS, WAS HOW DO WE WANT TO BID THIS PROJECT FOR A PROJECT? THIS TYPE, UM, FOR THE TOWN, WE HAVE TWO MAIN BIDDING PROCESSES THAT ARE REALLY AVAILABLE TO US. THERE'S THE TRADITIONAL BID WHERE WE ADVERTISE, UH, PUT THE PLANS AND SPECIFICATIONS OUT THERE, RECEIVE BIDS, AND WE AWARD TO THE LOWEST BIDDER. BUT THERE'S ALSO THE, UH, OPTION OF USING WHAT'S CALLED A COMPETITIVE SEAL PROPOSAL OR CSP AS WHERE WE UTILIZE A VARIETY OF FACTORS INCLUDING THE EXPERIENCE OF THE COMPANY, UM, AND THEIR KEY PERSONNEL, THEIR PRICE OBVIOUSLY, AND EVEN ITEMS SUCH AS THE TIME OF CONSTRUCTION THAT THEY WOULD PROPOSE TO EVALUATE THEIR PROPOSALS IN, PICK THE BEST PARTNER FOR THE TOWN. THIS IS SOMEBODY WE'RE GOING TO BE DEALING WITH PARTNERING WITH FOR THREE YEARS ON THIS PROJECT IN ONE OF THE BUSIEST CORRIDORS THROUGH THE TOWN. SO WE BELIEVE IT'S REALLY IMPORTANT THAT WE GET THE BEST PARTNER TO HELP US MINERAL MINIMIZE THE DISRUPTION TO THE COMMUNITY AND THE BUSINESSES AS THIS PROJECT MOVES FORWARD. UM, THE LAST THING THAT WE LOOKED AT WAS AS PART OF THE PROJECT WAS THE CONSTRUCTION MANAGEMENT ACTIVITIES. EVERY ONE OF OUR INFRASTRUCTURE BOND PROJECTS HAS CONSTRUCTION MANAGEMENT, MANAGEMENT SERVICES, UH, COSTS BUILT INTO THE BUDGETS. SO AS PART OF THE $41 MILLION BUDGET IN, UH, IN THE, UH, MIDWAY ROAD RECONSTRUCTION PROJECT, UH, THERE WAS MONEY IN THAT NUMBER FOR THE CONSTRUCTION MANAGEMENT ON THIS PROJECT. SPECIFICALLY, IT WAS ORIGINALLY ENVISIONED TO BE OUTSOURCED TO AN ENGINEERING FIRM AND IT WAS BUDGETED AT $3 MILLION. WE'VE REACHED OUT TO ENGINEERING FIRMS TO CONFIRM THAT NUMBER IS A GOOD NUMBER FOR A PROJECT THIS SIZE. AND IT IS. SO WE, WE, WE TOOK A LOOK AT WHAT WOULD THIS LOOK LIKE IF WE PERFORM THESE SERVICES. AND WHAT WE FOUND IS THAT WE WOULD, WE COULD DO THIS, UH, THE CONSTRUCTION MANAGEMENT SERVICES WITH, WITH THREE FULL TIME EMPLOYEES, PROJECT MANAGER, CONSTRUCTION ADMINISTRATOR AND AN INSPECTOR. WE WORKED WITH HR TO DETERMINE WHAT THE ACTUAL SALARIES AND BENEFITS THOSE COSTS WERE. WE INCLUDED THE EQUIPMENT AND ALL THE OTHER ANCILLARY ITEMS AND BELIEVE WE COULD DO THIS IN HOUSE FOR ONE POINT $5 MILLION FOR THE THREE YEAR PERIOD OF THE MIDWAY ROAD PROJECT. NOW WE WOULD ENVISION THESE THREE PEOPLE GOING AWAY AT THE END OF MIDWAY. THERE'S OTHER BOND FUNDED PROJECTS THAT ARE GOING ON. WE JUST USED THE THREE, THREE YEAR PERIOD AS A COMPARISON BETWEEN MIDWAY'S $3 MILLION COST, OUTSOURCE IT AND THE IN DOING IT INTERNAL. SO THESE, THESE POSITIONS WOULD BE FULLY FUNDED UTILIZING ON PROCEEDS. SO WHERE DOES THAT BRING US? WRAP THIS ALL UP? YOU KNOW, WE, FOR AS FAR AS AVAILABLE FUNDING, WE HAVE $16 MILLION AS PART OF THE 2012 BONDS, UH, 25 MILLION. UM, AS PART OF THE 29, UH, 2019 BONDS OF WHICH 15 MILLION HAVE BEEN SOLD. WE HAVE JUST A LITTLE BIT MORE THAN TWO POINT $7 MILLION AS PART OF THE DALLAS COUNTY TRAILS GRANT PROGRAM. THAT'S THE AVAILABLE FUNDING AS FAR AS COSTCO, YOU KNOW, LIKE YOU SAID, WE'VE SPENT THREE POINT $5 MILLION SO FAR AS, AS PART OF THE DESIGN AND TESTING SO FAR. UM, OUR CURRENT OPINION OF PROBABLE COST IS 28 POINT $5 MILLION. WE HAVE A CONTINGENCY OF 5%, WHICH I THINK IS ADEQUATE FOR PROJECT THE SIZE OF ONE POINT $5 MILLION. WE HAVE A MATERIALS TESTING, YOU KNOW, THE CONCRETE TESTING, SOIL DENSITY, ALL THE STUFF THAT WE'LL NEED THROUGHOUT THE PROJECT OF 400,000. WE HAVE THE RIGHT OF WAY ACQUISITION THAT WE SPOKE OF A THREE POINT $8 MILLION. UH, THE CONSTRUCTION MANAGEMENT ACTIVITIES INTERNAL WOULD BE A ONE POINT $5 MILLION AND CONSTRUCTION ADMINISTRATION, THOSE ARE THE SERVICES THAT THE ENGINEER WOULD NEED TO PERFORM THROUGHOUT THE THREE YEAR PERIOD OF THE CONTRACT. UH, YOU KNOW, SUBMITTALS, RFID, YOU KNOW, ANY KIND OF QUESTIONS ABOUT THE DESIGN AT $900,000. THAT BRINGS US TO A TOTAL ESTIMATED COST OF THE PROJECT AS WE SIT TODAY OF JUST OVER $40 MILLION WITH OUR PROJECT BUDGET OF $41 MILLION. SO THE PATH FORWARD WE STAFF RECOMMENDS THAT WE BID THE PROJECT AS ONE PACKAGE UTILIZING COMPETITIVE SEAL PROPOSAL METHOD. UM, BUT, BUT HOLDING OFF UNTIL AFTER THE LIFTING OF THE SHELTER IN PLACE AND EVERYTHING KIND OF GETS BACK TO NORMAL. WE DON'T WANT TO PUT THIS PROJECT OUT TO BID AND HAVE THE COMMODITIES, UH, WHERE THEY'RE HARD TO GET QUOTES CAUSE ANYTIME CONTRACTORS ARE BIDDING [00:35:01] ON THESE PROJECTS, IF THEY'RE HAVING DIFFICULTIES OR THEY'RE, THEY'RE WORRIED, THEY JUST ENDED UP PUTTING MORE MONEY ON THE PROJECTS. WE WANT TO WAIT UNTIL THINGS KIND OF LEVEL OUT A LITTLE BIT. WE'RE CURRENTLY ANTICIPATING THAT HAPPENING SOMETIME IN THE SUMMER.
