UH, AND TO, TO GET TO THE POINT, I JUST CAN'T REALLY SUPPORT ANY VERSION OF THIS MOU THAT DOESN'T INCLUDE HOUSING, UH, GOING FORWARD.
I RECOGNIZE THAT THE, THE 2D ALREADY HAS ABOUT 3,200 WITHIN, UH, WITHIN A, UH, WITHIN ABOUT HALF A MILE OF THE STATION.

UM, I BELIEVE THAT POPULATION DENSITY IS AN ASSET TO ADDISON.
IT'S A SIGN OF OUR IMPORTANCE AND SUCCESS IN THE REGION.
IT'S WHY OUR JOBS MARKET IS SO GOOD.
AND, UH, IT'S WHY WE'RE IN A STRONGER FISCAL POSITION THAN MOST PEER CITIES.
AND ADDITIONALLY, THE 2024 MARKET POSITION REPORT THAT WAS COMMISSIONED FOR THE COMP PLAN SAYS ADDISON CIRCLE'S VACANCY SITS AT UNDER 6%, WHICH IS THE SECOND BEST COMPARED TO LEGACY WEST IN A STUDY OF PIER CITIES AROUND THE METRO.
THE POINT IS, PEOPLE WANNA LIVE HERE AND MORE PEOPLE WILL IF YOU LET THEM.
UM, I BELIEVE WE HAVE AN EVERGREEN NEIGHBORHOOD IN ADDISON CIRCLE BECAUSE YOU GUYS HAVE WORKED SO HARD TO MAKE IT A GOOD PLACE TO LIVE, WORK, AND PLAY IN THAT ORDER.
I BELIEVE THAT'S THE VISION, THAT'S THE ADDISON WAY, AND THAT'S WHY I'M ASKING YOU GUYS TO STOP, LOOK, LISTEN, TABLE THIS VOTE TONIGHT, BECAUSE THE WAY THESE CHANGES HAVE BEEN COMMUNICATED TO US WAS NOT THE ADDISON WAY.
THE ORIGINAL PLANS FOR THE TOD BEGAN WAY BACK BEFORE I GOT HERE.
AND I KNOW IT WAS A DELIBERATE PROCESS THAT INVOLVED A LOT OF STUDY AND PUBLIC ENGAGEMENT.
THAT PROCESS CULMINATED IN A VISION WITH THE HOUSING THAT WAS APPROVED BY THE COUNCIL, ELECTED BY US CITIZENS HERE ALL THAT TIME.
ALL THAT TAXPAYER MONEY WAS INVESTED TO PRESENT SOMETHING BOTH TRULY VISIONARY AND ENDORSED BY THE COMMUNITY.
AND I AM DISAPPOINTED THAT I HEARD ABOUT IT IN AN EMAIL.
I'D LIKE US TO TAKE SOME MORE TIME AND KEEP THE HOUSING.

SO I DON'T, I THINK IT MAKES SENSE, YOU KNOW, IF THE DEED RESTRICTION DOESN'T ALLOW HOUSING, THERE THEN IS WHAT IT IS.
BUT THE EASTERN SIDE ON THE EAST OF QUORUM, THAT DOESN'T HAVE A RESTRICTION.
SO I DON'T SEE WHY THAT NEEDS TO BE REMOVED AS WELL.
I THINK YOU COULD PUT THE HOTEL ON THE OTHER SIDE AND IT ALL WORKS OUT.
UM, THE SECOND ONE IN THE JUSTIFICATION IN THE THE FUTURE PRESENTATION, UM, IT USES THE NUMBER OF UNITS THERE AND IT USES IT WITHIN A HALF MILE RADIUS.
BUT JUST ABOUT A MONTH AGO WHEN DISCUSSING THE UDC AND THE, UH, PARKING MINIMUM REDUCTION AROUND THE, THE TRANSIT CENTER, THE COUNCIL DECIDED THAT A HALF MILE WAS TOO FAR AND KEPT A QUARTER MILE.
SO I FEEL LIKE YOU CAN'T REALLY, YOU KNOW, GO BOTH WAYS, EITHER A QUARTER MILE OR A HALF MILE.
UM, AS FOR, UH, WHY I THINK THAT HOUSING IS IMPORTANT IS THE FIRST THING IS A GROCERY STORE AT THE COMPREHENSIVE PLAN.
ADDISON, UM, CIRCLE RESIDENTS, OVERWHELMING IS SAID.
THE THING THEY WANT THE MOST IS A GROCERY STORE WITHIN WALKING DISTANCE.
AND WHAT THE RESPONSE WE GOT BACK FROM TOWN STAFF AND THE CONSULTANTS WAS THAT FOR A GROCERY STORE TO BE ECONOMICALLY VIABLE, YOU NEED MORE NEIGHBORS.
SO I, I WANT MORE NEIGHBORS AND I THINK IT'S PRETTY CLEAR.
UH, THE NEXT REASON IS BECAUSE, UH, DFW IS NOW AS OF THIS YEAR, THE, UM, HIGHEST RENT IN TEXAS.
WE BEAT AUSTIN, UM, WHICH IS
I KNOW THE PROBABLY NEW BUILDS WOULD BE EXPENSIVE, BUT THAT FREES UP SPACE FOR THE PEOPLE, PEOPLE THAT MOVE FROM, YOU KNOW, MIDDLE UPPER HOUSING THERE AND IT KIND OF TRICKLES DOWN WHERE IT GIVES MORE SPACE TO PEOPLE AND CAN HELP KEEP HOUSING AT INFLATION RATHER THAN ABOVE IT.

THIS HAS LEFT NO ONE AT HOME TO RAISE THE CHILD FORCING A DEPENDENCY.
THE CONTINUED PROPPING UP OF THIS INDUSTRY OF CONTINUING THIS DEPENDENCY BEGS THE GREATER QUESTION OF WHO DO WE WANT RAISING CHILDREN IN OUR SOCIETY, CHILDCARE WORKERS OR THE PARENTS OF THE CHILDREN, CONTINUING TO PUT MONEY INTO SOLUTIONS THAT ENCOURAGE THE EXISTING RELIANCE ON CHILDCARE RATHER THAN LISTENING TO THE NEEDS OF OUR COMMUNITIES AND FINDING WAYS TO REDUCE OUR PARENTS'.
RELIANCE ON EXTERNAL CHILDCARE DIMINISHES OUR FREEDOMS AND LOWERS QUALITY OF LIFE FOR THE NEXT GENERATIONS AND THE PARENTS.
AND SO I ASK THE COUNCIL TO ADD TO ITS FUTURE AGENDA AN ITEM CONCERNING THE CREATION OF A PARENT'S ADVOCACY COMMITTEE IN COLLABORATION WITH THE GOVERNMENTS OF CARROLLTON AND FARMERS BRANCH.
I BELIEVE IT IN THE PUBLIC INTEREST THAT THE CITY GOVERNMENTS OF THE METROCREST WOULD CREATE A BODY THAT SPANS OUR CITIES, THAT WOULD HEAR AND CREATE RECOMMENDATIONS ON MATTERS RELATED TO CHILDCARE AND THE NEEDS OF OUR FAMILIES ACROSS THE METRO CREST.
THIS BODY SHOULD BE STAFFED BY NO FEWER THAN 21 MEMBERS, AT LEAST SEVEN FROM EACH CITY IN THE METRO CREST.

AND AS WE'VE BEEN TOLD TIME AND TIME AGAIN BY CITY STAFF AND CONSULTANTS, THE NUMBER ONE THING FOR US TO DO THAT IS TO GET MORE NEIGHBORS AND TO GET MORE RESIDENTS.
AND BECAUSE OF THAT IS WHY I WAS SO DISAPPOINTED TO LEARN THROUGH AN EMAIL THAT WE ARE SUDDENLY NOT USING THE TRANSIT ORIENTED DEVELOPMENT TO BUILD MORE HOUSING FOR ADDISON CIRCLE.
WE WERE ALL AT THAT SPRINGTOWN MEETING.
WE ALL REMEMBERED HOW BIG THE APPLAUSE WAS WHEN OUR MAYOR MADE EVEN A JOKE ABOUT A GROCERY STORE COMING TO TOWN.
THE RENTERS THERE WANT A GROCERY STORE SO BAD.
WE NEED MORE HOUSING IN ADDISON CIRCLE.
AND THIS VERSION OF THE TOD IS SIMPLY NOT BALANCED.
WE NEED PEOPLE WHO LIVE IN ADDISON CIRCLE SEVEN DAYS A WEEK, NOT PEOPLE WHO ARE GONNA BE COMING INTO THE OFFICE A FEW DAYS A WEEK, NOT PEOPLE WHO ARE JUST GONNA BE VISITING ADDISON CIRCLE A FEW DAYS A WEEK.

AND AS WE'RE GOING FORWARD, BECAUSE EVERYTHING OBVIOUSLY STARTED WAY BEFORE, BUT WE STARTED AGAIN WHEN WE DID OUR, UH, ADDISON CIRCLE SPECIAL AREA STUDY.

TOWN STAFF HIRED CUSHMAN IN WAKEFIELD TO HELP US PUT AN RFP TOGETHER, A REQUEST FOR PROPOSALS TO ACTUALLY GO OUT AND DEVELOP THAT LAND.SO WE WERE GONNA DEVELOP NOT ONLY THE TOWN OWNED LAND, BUT THE DART PROPERTY IN APRIL OF 2021.
AND RFP WAS ISSUED FOR A MASTER DEVELOPER IN DECEMBER OF 2021.
AMLI AND STREAM SUBMITTED A JOINT PROPOSAL THAT WAS ULTIMATELY ADOPTED IN APRIL OF 2022 WITH OUR FIRST MEMORANDUM OF UNDERSTANDING.
THAT IS A WORD YOU'RE GOING TO HEAR A LOT IN THIS PRESENTATION BECAUSE WE WENT THROUGH A LOT OF MEMORANDUMS OF UNDERSTANDINGS.
SO AGAIN, WE HAD OUR FIRST ONE IN 2022 DESIGNATING AM AND STREAM AS CO-DEVELOPERS FOR THIS PROJECT.
OUR SECOND ONE WAS IN APRIL OF 23.
WE WERE SOME PROJECT SCHEDULES.
A LITTLE BIT OF THE PROGRAM HAD ANOTHER ONE, SORRY, JANUARY OF 2023.
THEN WE HAD OUR FOURTH IN JUNE OF 23.
AND THEN OUR FIFTH IN OCTOBER OF 23, WE WERE INFORMED STREAM WAS GOING TO WITHDREW, WITHDRAW AS OUR OFFICE DEVELOPER AMLI ASKED FOR TIME TO GO OUT, TRY TO FIND A NEW OFFICE DEVELOPER AND CONTINUE ON WITH THEIR PLAN AS IT WAS PROPOSED.
THAT TAKES US TO JANUARY OF 2024, UH, AM LEE COMES BACK.
THEY HAD PROCURED ANOTHER OFFICE DEVELOPER QIP AND WE'RE MOVING FORWARD WITH THAT PLAN.
AND JUST AS A REMINDER, THIS IS THE INITIAL RFP RESPONSE IN THE FINAL MOU PROPOSAL.
AND IT BOTH PROPOSALS HAD TWO MULTIFAMILY PROJECTS.
THE INITIAL PROPOSAL HAD TWO OFFICE BUILDINGS THAT WAS REDUCED TO ONE PARKING GARAGE AND THEN THERE WAS THE ADDITION OF A RETAIL ENTERTAINMENT CENTER.
SO THEN WE MAKE IT TO APRIL OF 2024.
AMLI AND QIP COME IN TO DO THEIR REZONING, REZONING GETS APPROVED FOR THE TOD AND THE NEXT DAY WE'RE NOTIFIED THAT CHICAGO TITLE, WHO AM LEE HIRED, HAD FOUND A PLAT RESTRICTION THAT WE DID NOT KNOW ABOUT.
SO BENCHMARK, WE ASKED THEM TO GO OUT AND WORK WITH BENCHMARK TO SEE ABOUT THIS TITLE RESTRICTION, THE PLAT RESTRICTION, AND WHAT WE NEEDED TO MOVE FORWARD.
SO BENCHMARK COMES BACK, SAYS, YES, THERE IS A PLA RESTRICTION AND YOU ARE GOING TO HAVE TO, TO REPL GET ALL SEVEN PROPERTY OWNERS TO SIGN.
THAT WAS BENCHMARK'S ADVICE TO US.
JUST TO LET EVERYBODY KNOW AND KIND OF UNDERSTAND, UM, THE RESTRICTED USE REALLY HAS TO DO WITH, AND IT WAS KIND OF BURIED ON THE PLAT, WHAT CAN HAPPEN ON THOSE PARTICULAR PARCELS.
SO THE RESTRICTED USE, UM, AGAIN, WAS LISTED ON THE PLAT AND REALLY DETAILS OUT WHAT CAN BE ON THAT LAND.
AND SO OUR CHALLENGE WAS WE EITHER HAD TO RESOLVE THIS PLAT ISSUE, WHICH WAS A RE PLATTING OR WE HAD TO FIND A WAY TO CONFORM TO WHAT WAS LISTED ON THE PLAT.
AND JUST AS A LITTLE BACKGROUND, AS WE WENT AND STARTED DOING RESEARCH, WE FOUND THIS ORDINANCE THAT DESIGNATED IN 1995 THE ENTITLEMENT TO THE LAND.
AND WE SAW WHERE IT WAS, UM, THE DIFFERENT TRACKS WERE IDENTIFIED AND THEN IN 1997 IT WAS ACTUALLY PLATTED AND CONVEYED OVER TO THE TOWN.
SO WHILE WE'RE DOING ALL OF THIS, STAFF GOES THROUGH, WE INFORM COUNSEL, WE GO THROUGH, WE ATTEMPT TO TRY TO GET THESE RESTRICTIONS LIFTED AGAIN.
WE HAD TO HAVE ALL SEVEN OWNERS AND WE WENT THROUGH BY BENCHMARK GOING THROUGH WHAT THEY TOLD US WE NEEDED TO DO, WORKING WITH THOSE PROPERTY OWNERS AND EVENTUALLY CAME BACK TO COUNCIL WITH ANOTHER OPTION.
AND THE OPTION IS MOVING FORWARD WITH THOSE RESTRICTIONS IN PLACE.
ONE OF THE THINGS THAT WE LOOKED AT WHEN WE WERE TRYING TO DECIDE HOW TO MOVE FORWARD IS WHAT ALL HAD HAPPENED SINCE ALL OF THIS FIRST STARTED.
SO IF YOU GO BACK AGAIN FROM 2019, WHAT HAS HAPPENED? WE'VE HAD THE COVID PANDEMIC, WE'VE HAD MARKET SHIFTS WHERE WE'VE GOT A FLIGHT TO QUALITY OFFICE SPACE.
WE'VE HAD MULTIPLE TOWN STUDIES THAT HAVE HAPPENED.
OUR PARKS OPEN SPACE PLAN, OUR TRAILS

MASTER PLAN, COMPREHENSIVE PLAN, THE CORE AND PLACEMAKING, THE ADDISON CIRCLE VISION STUDY.WE'VE HAD A LOT THAT HAS HAPPENED SINCE WE FIRST STARTED THIS WHOLE PROCESS IN 2019.
SO THE ADDISON CIRCLE VISION STUDY IS STILL A GOOD DOCUMENT.
AND THAT DOCUMENT SAID THAT ADDISON'S FUTURE BY MAKING ADDISON A MAJOR DESTINATION ON THE COTTON BELT TO LIVE, WORK AND PLAY.
THAT IS STILL WHAT WE ARE TRYING TO DO.
AND TO GO BACK AND GIVE A LITTLE BIT MORE HISTORY, COUNCIL AUTHORIZED DOING THIS SPECIAL AREA STUDY IN NOVEMBER OF 2017.
THERE WAS MULTIPLE PUBLIC ENGAGEMENT OPPORTUNITIES.
WE HAD STAKEHOLDER INTERVIEWS, WE HAD A COMMITTEE.
WE HAD FOUR SPECIAL PROJECT MEETINGS, TWO COMMUNITY MEETINGS.
WE PRESENTED TWO DIFFERENT TIMES TO COUNCIL ALONG WITH IT BEING FORMALLY ADOPTED IN, UH, FEBRUARY OF 2019.
SO AGAIN, THIS WAS A VERY LONG PROCESS.
WE TOOK A LOT OF INPUT AND WHAT WE CAME AWAY WITH IS IDENTIFYING THESE AREAS FOR THE SPECIAL AREA STUDY AND WHAT WE CONSIDER TO BE THE TOD, OUR TRANSIT ORIENTED DEVELOPMENT.
AND WE REALLY WANTED TO FOCUS ON THE URBAN CHARACTER, LEVERAGE THE TRANSIT.
WE KNEW THAT THE SILVER LINE WAS COMING IN, DIVERSIFY THE LAND USE, ENHANCE THE PUBLIC SPACES AND CONNECTIVITY, AND STIMULATE THE ECONOMY AND THE TOURISM IN THE CIRCLE.
SO ONCE WE WENT THROUGH ALL OF THIS, THE YEAR AND A HALF LITTLE MORE PROJECT, THIS WAS THE ADDISON CIRCLE PREFERRED, OR THE ADDISON, ADDISON CENTRAL, BECAUSE WE HAD TWO AREAS, PREFERRED DEVELOPMENT PLAN.
THIS IS WHAT WE PUT OUT IN THE RFP AS WHAT WE WANTED TO SEE.
THIS IS WHAT WE WANTED AT THE TIME TO HAPPEN IN THAT AREA.
NOW, IF YOU READ ALL OF THE ADDISON CIRCLE VISION STUDY, YOU'LL ALSO SEE THAT THERE WERE TWO ALTERNATIVES IN THERE.
ONE ALTERNATIVE WAS A RESIDENTIAL FOCUS, WHICH HAD, UH, BOTH RETAIL AND RESIDENTIAL.
AND THEN THERE WAS A FOOD CENTRAL FOCUS, AND THE FOOD CENTRAL HAD A LITTLE BIT, IT HAD A CULINARY DESTINATION, RESTAURANT CLUSTERS, FOOD HALLS, AND MARKET SPACE AND DINING ORIENTED PUBLIC SPACES.
AND SO BOTH OF THESE WERE TALKED ABOUT, WERE HIGHLY, UM, CONSIDERED AS PART OF THE PLAN, BUT ULTIMATELY THE PREFERRED PLAN WAS WHAT WE MOVED FORWARD WITH.
SO WHEN YOU TAKE ALL OF THE THINGS THAT WE HAVE DONE, ALL THE PLANS, ALL THE SPECIAL AREA STUDIES, YOU FIND COMMON THEMES, VIBRANT AND MIXED USE, ECONOMIC VITALITY, PEDESTRIAN ORIENTED, UH, CONNECTIVITY AND WALKABILITY, HIGH QUALITY PUBLIC SPACES, MULTIMODAL TRANSPORTATION, BOUTIQUE HOTEL, DIVERSE AND BALANCED ACTIVATION, DESTINATION PLACEMAKING AND BRANDING.
AND SO WHAT WE CAME UP WITH, WORKING WITH QIP WAS A NEW ITERATION OF OUR STUDY.
AND AGAIN, IT HITS A LOT OF WHAT WAS ALREADY ADDRESSED AS PART OF THAT, UH, CIRCLE VISION STUDY.
AND SO IT IDENTIFIES OFFICE AND PARKING GARAGE, WHICH WAS ALREADY PART OF THE ORIGINAL PLAN.
AND THEN IN THE RESTRICTED AREA, RESTAURANT RECREATION, ENTERTAINMENT AND EVENT FACILITY.
SO THAT'S KIND OF A BROAD, YOU KNOW, A BROAD BRUSH WHERE WE CAN, YOU KNOW, HAVE SOME OPTIONS.
WE ALSO IDENTIFIED A HOTEL AND MEETING SPACE AREA, A FOOD AND BEVERAGE MARKET TYPE SPACE, WHICH IS ON THE DART LAND.
AND THEN DART IS ACTUALLY TALKING ABOUT MOVING THEIR TRANSIT STOP TOWARDS ADDISON ROAD.
AND SO THIS WAS KIND OF THE NEW VISION OF WHAT WE THOUGHT WAS OUR BEST USE, WHAT WE COULD MAKE HAPPEN HERE, WHAT WOULD REALLY ACTIVATE THIS AREA.
AND SO IF YOU LOOK AT THIS MATRIX AND YOU LOOK AT THE DIFFERENT PLANS THAT WE HAVE, IT HITS ALL THE PLANS, IT TALK, I MEAN THE FOOD AND BEVERAGE MARKET, THE

SO OUR ADDISON CIRCLE AREA HAS 3,194 HOUSING UNITS.
NOEL TRAIL SEPARATELY HAS ANOTHER 438.
BECAUSE IF YOU LOOK AT THE MAP, IT'S A LITTLE DECEIVING.
IT LOOKS LIKE THEY'RE COMBINING THOSE.
BUT WE VERIFIED AND WE HAVE THE 3,100, ALMOST 3,200 UNITS.
AND THAT, I MEAN, WE'VE, WE'VE APPRECIATED THAT HOUSING, THAT HOUSING HAS MADE ADDISON CIRCLE WHAT IT IS.
BUT THAT DOESN'T MEAN, AS EVERYBODY HAS SAID, THAT HOUSING STOPS THERE.
AND I DON'T THINK ONE OF THE THINGS THAT THE ADDISON CIRCLE SPECIAL AREA STUDY DID WAS IT TOOK A VERY NARROW SNAPSHOT OF THAT AREA.
SO IT WAS TOWN ON LAND THAT WAS SOUTH OF FESTIVAL WAY AND DART LAND THAT WAS NORTH OF ARAPAHO.
WELL, WHEN YOU TAKE THIS AS A CATALYST PROJECT, SO WHAT WE'RE DOING IS THE CATALYST, AND YOU LOOK SOUTH OF ALL OF THAT, THAT AREA IS RIPE FOR REDEVELOPMENT.
IT IS GOING TO HAPPEN AS THINGS COME IN.
AND AS WE REDEVELOP AND DEVELOP THIS AREA, YOU'RE GOING TO HAVE THINGS COME IN.

WE'D LIKE TO HAVE SOME SMALLER FORMAT ENTERTAINMENT HERE, LIKE A SMALLER STAGE IF YOU WILL.
MAYBE IN COMPARISON TO LIKE A BIGGER STAGE THAT WOULD BE ON THE LARGER ENTERTAINMENT SITE.

UM, AND THERE WILL ALSO BE A STORM DRAIN SYSTEM THAT IS INSTALLED WITH THIS PROJECT.
IT'LL GO FROM KELLER SPRINGS ALL THE WAY TO, UM, THE END OF JIMMY DOOLITTLE.
AND, UM, THERE WILL ALSO BE A MONUMENT SIGN YOU CAN SEE IN THE FAR CORNER, UM, THAT IS GOING TO BE DESIGNED BY OTHERS.
BUT THERE WAS ADDED AS AN ALTERNATIVE BID FOR, UH, PROVIDING THE ELECTRICITY AND SOME OF THE UNDERGROUND CONDUITS, UM, AS AN ADD ALTERNATE BID TO THIS PROJECT.
SO AS YOU CAN TELL, WE'RE GOING TO TAKE THE PROJECT AND RECONSTRUCT IT TO THE STANDARDS, UM, OF THE TOWN.
THERE WERE QUITE A FEW DEPARTMENTS INVOLVED.
UM, THE AIRPORT, UM, PUBLIC WORKS AND ENGINEERING PROCUREMENT, AND THEN ALSO PARKS AND RECREATION THROUGHOUT THE PROJECT.
UM, BS WERE RECEIVED IN DECEMBER OF 2024.
UM, THERE WERE ACTUALLY THREE BIDS RECEIVED.
UM, IT W WENT THROUGH WHAT IS CALLED A COMPETITIVE SOLD PROPOSAL PROCESS.
UM, THE ANTICIPATION IS FOR CONSTRUCTION TO START AS SOON AS THE PROJECT.
IF YOU SO DECIDE TO APPROVE TONIGHT, UM, IT IS ANTICIPATED TO TAKE ABOUT 150 CALENDAR DAYS AND, UM, LOOKING FORWARD WHETHER OBVIOUSLY DEPENDENT TO BE COMPLETED, UM, BY THE END OF OCTOBER.
SO THE NEXT STEPS ARE TO AWARD THE CONSTRUCTION CONTRACT TO MCMAHAN CONTRACTING LP IN THE, UM, AMOUNT OF $1,513,716 AND 70 CENTS.
IT WOULD BE COMPLETELY FUNDED BY THE AIRPORT.
UM, THERE IS THE $24,500 THAT'LL BE ADMINISTRATIVELY APPROVED, WHICH IS FOR MATERIAL AND TESTING, UH, CONSULTING SERVICES.
AND WHAT WE'RE ASKING FOR YOU TO DO TO TONIGHT IS TO APPROVE A RESOLUTION, UM, WHICH IS APPROVING THAT CONTRACT WITH MAC MCMAHAN, UM, CONTRACTING LP.

ARE WE LOCKED INTO 1,000,513 OR IF MATERIALS GO UP WITH THE COST OF THE PROJECT? NO, WE ARE LOCKED INTO WHAT THEY HAVE CURRENTLY BID.
UM, THEY HAVE THE OPPORTUNITY THROUGH CONTRACTING TO BRING ADDITIONAL, UM, PRICE, UH, IMPLICATIONS TO US.

AND THEN THERE'S A FEW OTHER ITEMS IN THERE AS WELL.
UH, SO REGULAR AMENDMENTS ARE AN ACCEPTED, UH, PRACTICE.
UH, SO IT MEANS THAT WE'RE ACTIVELY MONITORING OUR BUDGETS.
UH, WE'RE MITIGATING IMPACTS OF CHANGES IN CIRCUMSTANCES.
UH, THE TOWN HAS A, UH, BUDGET AMENDMENT POLICY THAT ALLOWS, UH, TRANSFERS BETWEEN ACCOUNTS, UH, TO BE APPROVED BY THE CFO MYSELF.
UH, TRANSFERS BETWEEN DEPARTMENTS THAT ARE LESS THAN 5% OF THEIR BUDGET, UH, CAN BE APPROVED BY THE CITY MANAGER.
AND THEN WHEN WE HAVE TRANSFERS BETWEEN FUNDS OR DEPARTMENTS, UH, THAT ARE MORE THAN A 5% CHANGE, WE BRING THAT TO THE CITY COUNCIL AS A FORMAL B UH, FORMAL, UH, BUDGET AMENDMENT.
SO GETTING INTO WHAT'S IN THIS BUDGET AMENDMENT.
UM, SO IF YOU RECALL THAT, UH, AT THE BEGINNING OF THIS FISCAL YEAR, UM, UH, ANIMAL SERVICES WAS MOVED FROM THE POLICE DEPARTMENT TO THE DEVELOPMENT SERVICES DEPARTMENT.
SO THE BIGGEST PART OF THE GENERAL FUND HERE IS MOVING THE PERSONNEL AND CONTRACTUAL SERVICES, UH, FROM THE POLICE DEPARTMENT TO THE DEVELOPMENT SERVICES DEPARTMENT.
WE'RE SIMPLY MOVING, UH, THOSE EXPENDITURES TO THE DEPARTMENT WHERE THEY WILL NOW RESIDE.
UM, AND THEN IN ADDITION TO THAT, UH, AT THE, UH, MARCH 25TH, UH, COUNCIL MEETING, UH, YOU WERE, UH, GIVEN A PRESENTATION ABOUT A DEVELOPMENT RELATIONS PROJECT MANAGER.
THERE'S SOME FUNDING IN THAT FOR THE REMAINDER OF THE FISCAL YEAR.
UH, AND THEN THAT WOULD BE BUDGETED IN FUTURE FISCAL YEARS AS WELL AS AN AUTHORIZED POSITION.
AND THEN WE HAD A VERY LARGE, UH, OR TWO VERY LARGE SALES TAX RECOVERIES IN THE FOURTH QUARTER OF 2024, UH, WHERE THE TOWN RECOVERED, UH, UH, OVER $1.2 MILLION.
WE USE A CONSULTANT FOR THOSE SERVICES.
UM, SO THEIR FEE, AND WE HAVE A BUDGET FOR THIS, MY BUDGET'S ONLY ABOUT $90,000 FOR THIS EACH YEAR.
SO WHEN THEY FIND TWO REALLY BIG ONES, WE WANT THEM TO FIND THEM.
BUT WHEN THEY DO, THERE'S A BIG, THERE'S A BIG OUTLAY FOR THEIR SERVICES BECAUSE IT'S, UH, IT'S PERCENTAGE BASED.
SO, UM, WE'RE REQUESTING AN ADDITIONAL $300,000 FOR THAT SALES TAX RECOVERY, UH, PROFESSIONAL SERVICES FEE.
UM, THE REVENUE OFFSET TO THIS IN THE GENERAL FUND, UM, IS $360,000 IN SALES TAX, WHICH COVERS THE $60,000, UH, FOR THE PROJECT MANAGER.
AND THEN THE $300,000 FOR THE SALES TAX RECOVERY SERVICES.
SO THE NET TO THE GENERAL FUND IS, IS A TOTAL OF ZERO.
UH, THEN GOING ON TO THE INFRASTRUCTURE INVESTMENT FUND, UH, THESE WERE TWO PROJECTS THAT WERE BUDGETED IN PRIOR YEARS.
SO WE'RE SIMPLY ROLLING THOSE FORWARD.
UH, ONE OF THOSE IS THE TRAFFIC SIGNAL AND A DA IMPROVEMENTS PROJECT.
UH, THE SECOND ONE IS THE, UH, AND IN OUR BUDGET, WE CALL IT THE CONFERENCE CENTER RENOVATION PROJECT.
WE CAN CALL IT THE NEW TOWN HALL PROJECT.
UM, EITHER WAY, 500,000 WAS BUDGETED IN 2024 FOR THAT.
UH, WE DIDN'T ACTUALLY SPEND ANYTHING LAST YEAR.
SO WE'RE SIMPLY ROLLING THOSE FUNDS FORWARD TO THE CURRENT FISCAL YEAR.
UH, THEN WE HAVE OUR SELF-FUNDED SPECIAL PROJECTS FUND.
UM, SO THERE ARE TWO ITEMS THAT WERE NOT, UH, IN THE FISCAL YEAR 2025 BUDGET, UH, THERE'S THE ROCKING AROUND THE CIRCLE EVENT, 120,000, UH, DOLLARS.
UM, AND A CONTRACT FOR THAT LATE IN FISCAL YEAR 2024.
THE EXPENDITURES DIDN'T ACTUALLY OCCUR UNTIL FISCAL FISCAL YEAR 2025.
THEN WE HAVE THE ATHLETIC CLUB OUTDOOR FENCE.
SO THIS WAS A PROJECT IN TOTAL THAT WAS APPROVED BY COUNSEL, UH, FOR 2025.
BUT THE OUTDOOR FENCE PART OF THAT PROJECT WASN'T ANTICIPATED TO BE COMPLETED UNTIL 2026.
IT WAS COMPLETED OR IS BEING COMPLETED IN THIS FISCAL YEAR.
UH, IN ADDITION TO THAT, WE HAVE PRIOR YEAR ENCUMBRANCES OF ABOUT 853,000.
UH, WITHIN THE MEMO, THERE'S DETAILS OF EACH OF THOSE ITEMS. MOST, UH, WERE FROM THE FISCAL YEAR 2023 OR 2024 BUDGETS THAT ARE ROLLING FORWARD.
THERE'S SOME OLDER ITEMS THAT WERE APPROVED BY COUNCIL, SUCH AS, UM, THE UNIFIED DEVELOPMENT CODE AND A DART ENGINEERING REVIEW AND THINGS

UH, BUT IN TOTAL, FOR THE SELF-FUNDED SPECIAL PROJECTS FUND, A LITTLE BIT OVER A MILLION DOLLARS, UH, $1,023,000.
UH, THEN THE, WE HAVE THE FACILITY MAINTENANCE FUND.
SO ONE OF THE, UM, PARTS THAT WENT ALONG WITH THE, UH, NEW TOWN HALL, UM, IS THAT THE FOLKS THAT WERE IN THE, UH, SPECIAL EVENTS DEPARTMENT MOVING OVER TO THE THEATER CENTER.
SO THERE WAS SOME COST TO MAINTENANCE AND REPAIRS OF THE ADDISON PERFORMING ARTS CENTER, UM, TO, TO ACCOMMODATE THEM.
UH, SO THAT REQUEST IS, UH, FROM THE FACILITY MAINTENANCE FUND OF $80,000.
AND THEN WE HAVE OUR CAPITAL EQUIPMENT REPLACEMENT FUND.
AND THESE ARE ALL RELATED TO PRIOR YEAR ENCUMBRANCES, UH, RELATED TO VEHICLES THAT WERE ORDERED IN THE PRIOR FISCAL YEAR, BUT HAVEN'T BEEN DELIVERED.
OR WE MAY HAVE BEEN DELIVERED NOW BUT WEREN'T DELIVERED BEFORE THE END OF THE FISCAL YEAR.
UM, SO, UH, WE CONTINUE TO SEE SOME DISRUPTIONS WITH THE DELIVERY OF VEHICLES.
UM, I DON'T THINK WE'RE VERY PROFITABLE FOR THE CAR COMPANY, SO THEY DON'T WANNA SELL TO, TO CITIES 'CAUSE WE GET GOOD PRICING.
SO THEY, THEY, THERE'S A LIMITED SUPPLY AND IT'S PRETTY DIFFICULT.
SO THE, THE MAJORITY OF THIS IS RELATED TO, UH, AN AMBULANCE THAT WAS ORDERED LAST YEAR THAT WAS DELIVERED THIS YEAR.
UH, WE HAVE THE UPFITTING OF THE NEW POLICE FLEET, UM, THAT WAS BUDGETED LAST YEAR, COMPLETED IN THIS FISCAL YEAR.
AND THEN SEVERAL OTHER VEHICLES, UH, PRIMARILY IN, PRIMARILY IN THE PARKS DEPARTMENT, UH, GENERAL SERVICES AND UTILITY DEPARTMENTS THAT WERE ORDERED IN THE PRIOR FISCAL YEAR THAT WERE, UH, DELIVERED THIS FISCAL YEAR.
SO ALMOST $2 MILLION, 1,925,000, UM, IN PRIOR YEAR ENCUMBRANCES IN THE CAPITAL EQUIPMENT REPLACEMENT FUND.
AND THEN OUR CAPITAL PROJECTS FUND, WE HAVE THE REDING TRAIL EXTENSION DOG PARK PROJECT, UH, THAT WAS APPROVED.
UH, WE HAVE $50,000 IN RESIDUAL BOND FUNDS THAT, UH, FROM INTEREST EARNINGS, UH, IN THE, UM, I THINK IT'S THE 2021, UH, GENERAL OBLIGATION BOND.
SO WE'RE, UH, WANTING TO SPEND THOSE FUNDS SO WE CAN CLOSE OUT THIS BOND FUND AND APPLY THOSE TO THIS PROJECT WHICH COUNCIL, UH, HAD APPROVED, UH, EARLIER IN 2024.
AND WITH THAT, UH, THE ONLY OPERATING FUND THAT WE HAVE IN THE PROPOSED BUDGET AMENDMENT IS THE GENERAL FUND.
AND YOU CAN SEE THAT, UH, THE EXPENDITURES, UH, ARE OFFSET BY REVENUE INCREASES.
SO, UH, A NET IMPACT ON THE FUND BALANCE OF ZERO, THE OTHER FUNDS.
UM, IF YOU LOOKED AT THE EXHIBIT IN THE ORDINANCE, UH, BECAUSE THE MAJORITY OF THESE ARE PRIOR ENCUMBRANCES, OUR FUND BALANCE BEGINNING FUND BALANCE WAS ACTUALLY HIGHER THAN WE ANTICIPATED WHEN WE DID THE BUDGET.
UH, THAT INCREASE IS ACTUALLY HIGHER THAN UM, WHAT WE'RE ASKING FOR HERE.
SO THE NET, WHILE IT SHOWS AN IMPACT ON FUND BALANCE, OUR BEGINNING FUND BALANCES WERE SIGNIFICANTLY HIGHER THAN WE ANTICIPATED, UH, BECAUSE THESE WERE PRIOR ENCUMBRANCES.
SO, UM, OVERALL ABOUT 4,548,000 IN EXPENDITURES, $360,000 IN REVENUE, THE NET IS JUST UNDER $4.2 MILLION.
