UM, AS I MENTIONED, THEY WILL HAVE A BAR ON SITE THAT WILL OFFER ALCOHOL FOR ON-PREMISE CONSUMPTION. AND THE PROPOSED HOURS OF OPERATION, UM, INCLUDE 11:00 AM TO 10:00 PM MONDAY THROUGH THURSDAY. SO THAT DID INCLUDE THE REMOVAL OF TWO TREES IN PARTICULAR THAT THEN HAD, WERE CONFLICTING WITH THE EMERGENCY ACCESS LANE, UM, WERE COMMONLY REFERRED TO AS THE FIRE LANE. AND THAT ALSO INCLUDED THE REMOVAL OF, UH, SEVERAL PARKING SPACES AS WELL. UH, 'CAUSE THOSE FIRE LANES WOULD THEN IN, UH, IMPACT WITH THE EXISTING PARKING SPACES IF THERE WERE VEHICLES PARKED THERE. UM, THAT DID DECREASE THE OVERALL PARKING ON SITE. UM, I BELIEVE BY FIVE SPACES. HOWEVER, THE PARK, UH, THE, THE PARKING IS, IS, UM, EXCEEDS THE MINIMUM REQUIREMENT AS THERE ARE A HUNDRED. AND, UM, WITH THESE IMPROVEMENTS AS PROPOSED THERE, THERE ARE A HUNDRED AND, UH, 49 SPACES PROVIDED AND THEY'RE REQUIRED TO HAVE 126. IT WAS VERY IMPORTANT TO THE, UM, OPERATOR MEXICAN SUGAR, THAT THEY MAINTAIN A SIGNIFICANT AMOUNT OF PARKING ON THE SITE AS DURING PEAK TIMES. THEY DO HAVE, UH, ABOUT 65 EMPLOYEES ON SITE. UM, SO THAT WAS, UM, AN IMPORTANT CONSIDERATION AND, UH, A REASON THAT THEY WERE ATTRACTED TO THIS PARTICULAR, THIS SITE IN PARTICULAR. SO FOR OPEN SPACE AND LANDSCAPING, UH, THIS SITE, UM, HAD BEEN SEEN SOME NEGLECT WITH RE IN REGARDS TO LANDSCAPE MAINTENANCE. UH, MEXICAN SUGAR WILL BRING IT, UH, WITH THIS APPLICATION BACK INTO COMPLIANCE WITH WHAT'S EXPECTED, UM, AS FAR AS ADDING SOME SHRUBS GROUND COVER, AS WELL AS MITIGATING SOME TREES AS WELL. AS I MENTIONED, TWO TREES WILL NEED TO BE REMOVED FOR EMERGENCY ACCESS. THERE ARE FOUR ADDITIONAL TREES THAT WILL BE IMPACTED AS WELL. UM, THOSE ARE IN VERY POOR CONDITION. UM, I BELIEVE TWO ARE DEAD AND TWO ARE IN, UH, SEVERELY DECLINING HEALTH. UH, STAFF IS ASKED THAT THOSE BE REMOVED AND MITIGATED, WHICH THE APPLICANT IS PROPOSING TO, UM, FULLY MITIGATE AND ACTUALLY EXCEED THE MITIGATION REQUIREMENT BY ONE CALIBER PER INCH. UM, A BIG, UM, POSITIVE WITH THIS APPLICATION IS THAT THE PROPERTY OWNER HAS AGREED TO PROVIDE, UH, THE TOWN WITH A PEDESTRIAN ACCESS AND MAINTENANCE EASEMENT BOTH ON QUORUM AND BELTLINE ROAD FOR THE FUTURE PEDESTRIAN ENHANCEMENTS, WHICH WILL ULTIMATELY, UM, ALLOW THE TOWN TO COMPLY WITH OUR, UM, BELTLINE 1.5 PLAN, WHICH INCLUDES AN EIGHT FOOT SIDEWALK AND SIX FOOT BUFFER ON BELTLINE AND POTENTIALLY IMPLEMENT POSSIBLE, UH, OR FUTURE IMPROVEMENTS, PEDESTRIAN IMPROVEMENTS ON, ON QUORUM WITH THE, UH, QUORUM RECONSTRUCTION PROJECTS, WHICH, UM, HAS BEEN PRELIMINARILY PRESENTED TO, TO COUNCIL EARLIER THIS YEAR FOR THE EXTERIOR OF THE BUILDING. AND, UH, WITH THAT STAFF RECOMMENDS APPROVAL OF THE REQUEST WITH TWO CONDITIONS. UH, THE FIRST IS THAT PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY, THE PROPERTY OWNER, UM, UH, WORK WITH THE TOWN TO DEDICATE THE EASEMENTS, UM, AS REFERENCED ON BELTLINE AND UM, QUORUM DRIVE AS SHOWN ON THE SITE PLAN AS WELL. AND THEN THE SECOND IS THAT PREVIOUS SPECIAL USE PERMITS FOR THIS PROPERTY RELATED TO THE PREVIOUS RESTAURANTS AND OTHER ENTERTAINMENT LIKE USES BE REPEALED.
