THE PLANNING AND ZONING COMMISSION FULFILLS AN ADVISORY ROLE FOR THE TOWN BY EVALUATING, PLANNING, ZONING AND SUBDIVISION PROPOSALS AND MAKING RECOMMENDATIONS TO THE CITY COUNCIL ON LAND USE AND DEVELOPMENT POLICY.

THE PURPOSE OF THE COMMISSION IS TO PROVIDE GUIDANCE ON RESPONSIBLE LAND USE AND DEVELOPMENT THROUGH THE ADHERENCE OF TO THE GOALS AND THE PRINCIPLES OF PLANNING POLICY AND ADMINISTRATION OF THE ZONING AND SUBDIVISION SUBDIVISION LEG REGULATIONS, WHICH AIMS TO PROMOTE THE SAFETY AND WELLBEING OF OUR RESIDENTS WORKFORCE AND VISITORS.

THIS IS CURRENTLY ZONED PLANNED DEVELOPMENT PD THROUGH ORDINANCE OH ZERO ONE DASH 0 0 2 TO ALLOW A RESTAURANT WITH THE SALE OF ALCOHOL BEVERAGES FOR ON-PREMISE CONSUMPTION CASE, 1919 SU SLASH 49 50 BELTLINE ROAD, SUITE 180, THE OFFICE BAR, LESLIE LESLIE KNIGHT, DIRECTOR OF DEVELOPMENT AND NEIGHBORHOOD SERVICES.

UM, THIS REQUEST IS A SPECIAL USE PERMIT FOR A NEW RESTAURANT WITH THE SALE OF ALCOHOL FOR ON-PREMISE CONSUMPTION.

UM, AT THE SUBJECT PROPERTY, WHICH IS THE, UH, QUORUM TWO SHOPPING CENTER, UH, 49 50 BELTLINE ROAD.

UH, THE SUITE IN QUESTION IS SUITE 180.

UH, THIS SITE WAS, UH, DEVELOPED IN THE 1980S UNDER THE LOCAL RETAIL, UM, ZONING DISTRICT, EXCUSE ME.

IN 2001, THERE WAS A PLAN DEVELOPMENT APPROVED FOR THIS SITE, WHICH ESTABLISHED PERMITTED USE AND DEVELOPMENT STANDARDS, SPECIFICALLY MODIFIED PARKING STANDARDS THAT, UM, YOU'LL SEE AFFECT THIS PARTICULAR REQUEST.

UM, THERE ARE SEVERAL OTHER RESTAURANTS AND OTHER USES IN THE CENTER THAT HAVE RECEIVED SPECIAL USE PERMITS OVER TIME.

UM, AND THIS REQUEST IS, UH, ANOTHER SPECIAL USE PERMIT TO ALLOW A NEW RESTAURANT WITH A SALE OF ALCOHOL.

SO THE, UM, APPLICANT OR, UM, THE OFFICE BAR IS REQUESTING TO OCCUPY SUITE 180.

UH, THIS SUITE IS JUST UNDER 1900 SQUARE FEET.

UM, THIS IS A REMNANT OF A PREVIOUSLY MUCH LARGER SUITE THAT, UH, WAS PREVIOUSLY CONJOINED WITH THE SPACE THAT IS CURRENTLY OCCUPIED BY TASTY TAILS, WHICH IS IMMEDIATELY ADJACENT TO THE WEST OF THIS SUITE.

UM, THE APPLICANT, AS I MENTIONED, IS PROPOSING TO OPEN THE OFFICE BAR.

UH, THIS, UM, RESTAURANT WILL PROVIDE A VARIETY OF FOOD OFFERINGS THAT YOU MAY TYPICALLY SEE IN, UM, A BAR SETTINGS SUCH AS WINGS, UH, SLIDERS, FLATBREADS, OR OTHER, UM, OTHER FOOD OFFERINGS.

UH, THEY'RE ALSO PROPOSING A VARIETY OF, UH, COCKTAILS, WINE AND BEER, AS WELL AS HOOKAH OFFERED FOR ON-PREMISE CONSUMPTION.

UH, THE PROPOSED HOURS OF OPERATION, I APOLOGIZE FOR THE TYPO, IS PROPOSED TO BE 2:00 PM TO 2:00 AM SEVEN DAYS A WEEK.

UM, THIS, UM, EXCUSE ME, THE QUORUM TWO SHOPPING CENTER, UM, DOES

HAVE UNIQUE PARKING STANDARDS.

SO, UH, OUR TYPICAL PARKING STANDARD IS ONE SPACE FOR EVERY 70 SQUARE FEET OF GROSS SQUARE FOOTAGE FOR A RESTAURANT.

UM, THIS PARTICULAR PLAN DEVELOPMENT ESTABLISHED A ONE SPACE FOR EVERY 100 SQUARE FEET OF GROSS SQUARE FOOTAGE, UM, FOR U USES WITHOUT A VALET.

AND THEN THERE ARE ADDITIONAL ALLOWANCES, EXCUSE ME, IT'S ONE TO ONE 60 FOR RESTAURANTS.

AND THEN WITH THOSE DESIGNATED, UH, WITH DESIGNATED VALET SERVICE, IT'S ONE TO 100.

I APOLOGIZE.

UH, SO WITH THAT, THE ONLY, UM, RESTAURANT THAT IS CURRENTLY USING DESIGNATED VALET SERVICE ON THE SITE IS THE, UM, IMPROV COMEDY CLUB.

ALL THE OTHER RESTAURANTS DO NOT AT THIS TIME HAVE DESIGNATED VALET.

SO WITH THAT, UM, THE SITE AND WITH THIS PROPOSED USE WOULD REQUIRE 467 SPACES, AND THERE ARE CURRENTLY 468 PROVIDED ON SITE.

SO JUST ONE SPACE EXCEEDING THAT REQUIREMENT.

UM, MOVING FORWARD, IT'S LOOKING AT SOME OF THE OTHER VACANT SPACES CURRENTLY IN THE CENTER.

ANY FUTURE RESTAURANT USES WOULD LIKELY, WHAT WOULD EXCEED THE, THE THRESHOLD OF, OF PARKING.

AS I MENTIONED PREVIOUSLY IN THE WORK SESSION, THERE'S NO PROPOSED MODIFICATIONS TO THE OPEN SPACE, UH, OR LANDSCAPING ON SPOT SITE OR THE EXTERIOR APPEARANCE.

WITH THIS REQUEST, THE APPLICANT IS REQUIRED TO INSTALL A GREASE TRAP.

UM, HOWEVER, IT WILL NOT AFFECT, UH, THOSE OTHER SITE IMPROVEMENTS AND WILL BE LOCATED BEHIND THE BUILDING.

UH, PUBLIC NOTICE WAS PROVIDED TO ALL PROPERTY OWNERS WITHIN 200 FEET OF THE SITE THAT INCLUDED 14 RECIPIENTS, AND WE HAVE NOT RECEIVED ANY RESPONSES TO THAT NOTICE.

UM, STAFF DOES RECOMMEND APPROVAL OF THE REQUEST, UH, TO OCCUPY A CURRENTLY VACANT SUITE.

Case 1924-SUP/14295 Midway Road (Westwood Montessori Amendment). ]

THIS IS CURRENTLY ZONED PLAN PD THROUGH ORDINANCE 6 2 5, CASE 1924 U SLASH 1 42 95 MIDWAY ROAD, WESTWOOD MONTESSORI, A AMEN AMENDMENT, LESLIE LESLIE KNIGHT, DIRECTOR OF DEVELOPMENT AND NEIGHBORHOOD SERVICES.

UM, THIS REQUEST IS FOR A, UM, SPECIFIC TO A PRIVATE SCHOOL, UM, THAT WAS PREVIOUSLY APPROVED BY CITY COUNCIL IN APRIL OF 2024 FOR A SPECIAL USE PERMIT TO CONVERT AN EXISTING OFFICE BUILDING AT MIDWAY ATRIUMS, UH, INTO A PRIVATE SCHOOL.

THIS REQUEST IS COMING BACK FOR AN AMENDMENT TO THOSE DEVELOPMENT PLANS THAT WERE PREVIOUSLY APPROVED, AS WELL AS TO ALLOW A TEMPORARY STRUCTURE.

SO THIS PARTICULAR PROPERTY WAS REZONED FROM RESIDENTIAL TO PLAN DEVELOPMENT IN 1980.

SUBSEQUENTLY THE EXISTING OFFICE BUILDINGS, WHICH INCLUDES THREE FOUR STORY OFFICE BUILDINGS WERE CONSTRUCTED.

UM, AND THEN LATER IN 2009 THERE WAS A, UM, PD AMENDMENT TO ESTABLISH PARKING RATIOS FOR, UM, OFFICE AND HOTEL USES.

UM, THIS PARTICULAR PD I'LL NOTE ENC ENCOMPASSES BOTH THE ADJACENT PROPERTY, WHICH WAS THE FORMER CROWN PLAZA SITE, AS WELL AS THE PROPERTY LOCATED TO THE NORTH OF PROTON DRIVE, WHICH IS A COMMERCIAL, A MULTI-TENANT COMMERCIAL BUILDING, AS WELL AS ANOTHER, UM, HOTEL ESTABLISHMENT AS WELL.

IN, UM, APRIL, AS I MENTIONED, OF 2024, WESTWOOD MONTESSORI WAS APPROVED FOR A SPECIAL USE PERMIT.

UM, AND THIS REQUEST TODAY IS TO AMEND THAT INITIAL APPROVAL.

SO JUST GOING THROUGH, UM, SOME OF THE CHANGES ARE NOTED IN BOLD, UM, AND TO TO BE, UH, TRANSPARENT.

UH, SOME OF THE OTHER INFORMATION THAT WAS PREVIOUSLY SHARED AND PROPOSED TO CONTINUE OR REMAIN THAT WAS PREVIOUSLY APPROVED, UM, IS ALSO INCLUDED, BUT NOT BOLDED.

SO THE SCHOOL, UM, CONSTRUCTION IS UNDERWAY FOR THE CONVERSION OF THE O FOUR STORY OFFICE BUILDING INTO A PRIVATE SCHOOL.

UM, AND THAT IS LOCATED ON THE NORTH NORTHERN SIDE OF THE SITE, UH, OR THE RIGHT HAND SIDE OF THIS SITE PLAN.

UM, THEY ARE ALSO PROPOSING TO CONSTRUCT A NEW GYMNASIUM AND STORM SHELTER IMMEDIATELY SOUTH OF THE SCHOOL, UM, DUE TO SOME PHASING OF THE PROJECT AND THE CONSTRUCTION, UH, THEY ARE PROPOSING, UM, TEMPORARY STORM SHELTERS, WHICH I'LL ELABORATE ON FURTHER.

UM, THEY'RE ALSO PROPOSING WITH THIS REQUEST TO MODIFY THE PICKUP AND DROP OFF LANE.

THIS CHANGE DOES REDUCE THE TOTAL AMOUNT OF PARKING PROVIDED, BUT IT DOES INCREASE THE ALLOWABLE PLAYGROUND AREA AS WELL AS PRESERVE SOME ADDITIONAL TREES ON SITE REDUCING THE OVERALL, UH, MITIGATION REQUIREMENTS.

UM, THEY'RE ALSO PROPOSING TO MODIFY THE SECURITY FENCING AROUND THE, UM, PLAYGROUND, WHICH IS IDENTIFIED ON THE LANDSCAPE PLAN.

THEY'RE STILL PROPOSING A NEW DUMPSTER ENCLOSURE, WHICH IS GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE NEW GYMNASIUM STRUCTURE.

AND AS I PREVIOUSLY MENTIONED, UM, THEY ARE ALSO SEEKING APPROVAL FOR THREE TEMPORARY STORM SHELTER STRUCTURES TO BE LOCATED ON SITE TEMPORARILY WHILE THE GYMNASIUM IS BEING CONSTRUCTED SO THAT THEY CAN, THE SCHOOL CAN PROCEED FORWARD AND OCCUPY THE NEW, UM, SCHOOL BUILDING.

UH, SO QUICKLY TO GO OVER WHAT, UM, THE NEW SCHOOL WILL BE, IT'S ABOUT 95,000 SQUARE FEET.

IT'S FOUR STORIES.

UH, THEY'RE NOT MAKING SIGNIFICANT CHANGES TO THE EXTERIOR OF THAT BUILDING.

UM, HOWEVER, THEY ARE DOING, UH, QUITE A BIT OF INTERIOR RENOVATION TO, UM, MAKE IT INTO A SCHOOL.

SO GENERALLY ALL THE DIFFERENT FLOORS WILL BE, UM, SUBDIVIDED BY GRADE, SO YOUNGER STUDENTS AND THE FIRST FLOORS GRADUATING TO OLDER STUDENTS IN THE TOP FLOORS.

THIS SCHOOL DOES PROVIDE SERVICES FOR, UM, PRESCHOOL ALL THE WAY THROUGH 12TH GRADE.

SO THERE'S A WIDE VARIETY OF AGES, UM, WITHIN THE SCHOOL.

THERE ARE A VARIETY OF PROGRAMMING IN THE BUILDING, INCLUDING CLASSROOMS, OFFICES, SOME INDOOR, UM, PLAY AREAS, RESTROOMS AND OTHER STORAGE FACILITIES.

UM, AS A REMINDER, THE SCHOOL DOES NOT PROVIDE ANY LUNCHES, UM, FOR THE STUDENTS.

SO THERE'S NO COOKING FACILITIES ON SITE FOR THE GYMNASIUM.

UM, THIS IS ALSO, THIS, THE GYM ITSELF REMAINS THE SAME.

IT'S REALLY, REALLY TALKING ABOUT THE PHASING.

UM, IT'S APPROXIMATELY, UM, 10,700 SQUARE FOOT IN SIZE.

THERE'S, UH, PROPOSED BLEACHERS AS WELL AS A SPORTS COURT AND SOME OTHER, UH, LOCKER ROOM RESTROOM FACILITIES.

UM, ALSO SERVING AS A STORM SHELTER EVENTUALLY.

ONCE AGAIN, THE PHASING NECESSITATES THE NEED FOR THIS TEMPORARY STRUCTURES AS THE, UM, ICC 500 CODES DOES REQUIRE SCHOOLS TO PROVIDE STORM SHELTERS.

SO IN ORDER TO, FOR THE TOWN TO ISSUE A CERTIFICATE OF OCCUPANCY TO OCCUPY THE OFFICE BUILDING, WHICH WILL EVENTUALLY BE THE NEW SCHOOL, THEY WILL BE REQUIRED TO PROVIDE A STORM SHELTER FOR AN APPROPRIATE NUMBER OF OCCUPANTS OF THE SCHOOL BUILDING.

THE PROPOSED TEMPORARY STORM STRUCTURE STRUCTURES WILL BE THREE 10 FOOT BY 40 FOOT, UH, TORNADO LOCK STRUCTURES, AS YOU SEE IN THIS IMAGE, UH, THEY'RE APPROXIMATELY EIGHT FEET TALL.

UM, THESE DO MEET THE CODE REQUIREMENTS, UH, FOR THE ICC 500 CODE.

UM, THEY WOULD NEED TO BE LOCATED ON SITE AND MEET ALL THE PROVISIONS.

UM, THERE ARE CERTAIN DISTANCE PROVISIONS AS WELL AS ACCESSIBILITY STANDARDS THAT ARE REQUIRED FOR THIS.

UM, THOSE HAVE BEEN TAKEN INTO ACCOUNT WITH THE PLAN AND THEY DO PROVIDE OCCUPANCY FOR 399 INDIVIDUALS FOR THREE OF THEM ACROSS THREE OF THEM, WHICH DOES MEET, UM,

THE CODE REQUIREMENT FOR THE OCCUPANCY OF THE BUILDING.

ADDITIONALLY, THE TEMPORARY STRUCTURES, UH, WOULD ONLY BE ON SITE FOR THE DURATION OF CONSTRUCTION OF THE GYMNASIUM, WHICH IS ANTICIPATED TO BE NINE MONTHS AFTER THAT PERIOD.

THEY WOULD BE REMOVED.

UM, THEY WOULD BE SITUATED UPON, UM, EXISTING PARKING SURFACE, SO THEY WOULD JUST BE, UM, BOLTED INTO THAT, THAT HARD SURFACE AND THEN COULD JUST BE UNBOLTED AND REMOVED WITH RELATIVELY A LITTLE DAMAGE OR DISTURBANCE TO THE, THE SITE.

SO LOOKING AT THE PARKING, UM, THERE, WITH THE SHIFT OF THE DROP OFF LANE, THE PARKING DID DECREASE BY OR PROPOSING TO DECREASE BY 14 SPACES.

UM, DOING THIS, IT WAS A, AN OFFSET OF INCREASE OF OPEN SPACE VERSUS PARKING.

UM, AND THEN ADDITIONALLY I'LL ADD WITH THE PROPOSED TEMPORARY STORM SHELTERS, THIS WOULD REDUCE, OR EXCUSE ME, OCCUPY 21 EXISTING SPACES, UM, DURING THE GYM CONSTRUCTION.

SO THOSE WOULD NO LONGER BE AVAILABLE FOR USE.

UM, STAFF DOESN'T HAVE CONCERN ABOUT THAT BECAUSE THE, UM, THE PARKING DEMAND IS LIKELY TO BE AT, ITS, I GOTTA SAY ITS HIGHEST WHEN THE GYM IS COMPLETED DURING VARIOUS EXTRACURRICULAR EVENTS, NOT NECESSARILY DURING THE SCHOOL DAY, SINCE THERE IS A VERY SMALL POPULATION OF THE, THE STUDENTS THAT ACTUALLY DRIVE OR A, OR ARE OF DRIVING AGE FOR TREE REMOVAL.

UM, WITH THE SHIFT OF THE DROP OFF LANE, THEY WERE ABLE TO REDUCE THE TOTAL, UM, CALIPER INCHES BEING REMOVED AND ABLE TO SAVE SEVERAL MORE TREES ON SITE.

UM, THEY ALSO WERE ABLE TO ADD ONE MORE TREE BACK ON, INCREASING THE TOTAL MITIGATED ON SITE, UM, ULTIMATELY DECREASING THEIR TREE MITIGATION FUND PAYMENT BY NEARLY $15,000.

UM, LANDSCAPING, UH, THERE WAS VERY LITTLE CHANGES OVERALL OTHER THAN WHAT I'VE MENTIONED REGARDING THE TREE MITIGATION, THEY WERE ABLE TO INCREASE THE OVERALL OPEN SPACE BY ABOUT HALF PERCENT.

OH, AND I'LL JUST NOTE, UM, THE, THERE IS A PROPOSED FENCE SURROUNDING THE PLAYGROUND AREA, WHICH IS LOCATED ON THE NORTH AND NORTHWEST SIDE OF THE BUILDING.

THERE IS NO PROPOSED CHANGES FROM WHAT WAS PREVIOUSLY APPROVED.

UM, THE SAME IS, UH, WITH THE GYMNASIUM STRUCTURE AS WELL.

JUST QUICKLY REVIEWING THE TRAFFIC IMPACT ANALYSIS, THIS IS NOT DIFFERENT.

UM, THE ONE CHANGE IS THAT THE TOTAL STACKING AREA WITH THE SHIFT OF THE QUEUING LANE, OR EXCUSE ME, THE DROP OFF LANE IS REDUCED BY ONE VEHICLE FROM 39 VEHICLE CAPACITY ON SITE TO 38.

UH, STAFF DOES NOT FEEL THAT THAT WILL BE AN ISSUE, UM, CONSIDERING THAT THEY ARE HAVE A SURPLUS OF QUEUING ON SITE, UH, FOR ALL THEIR PROPOSED PICKUP TIMES BASED UPON OBSERVANT, UM, OBSERVANCE OF THEIR CURRENT, UM, SCHOOL STAFF PROVIDED NOTICE TO 109, UM, PROPERTY OWNERS SURROUNDING THE SITE AND DID NOT RECEIVE ANY RESPONSES TO THE REQUEST.

UM, STAFF ULTIMATELY DOES RECOMMEND APPROVAL.

HOWEVER, UM, SINCE THE THE PACKET WAS PUBLISHED, STAFF HAS HAD SEVERAL CONVERSATIONS ABOUT, UM, THE SECOND CONDITION WHICH STAFF'S RECOMMENDING REGARDING THE PERIMETER PLAYGROUND SECURITY FENCING.

UM, SO THIS CONDITION WAS CARRIED FORWARD FROM THE PREVIOUS APPROVAL.

HOWEVER, AFTER, UM, DISCUSSIONS WITH THE SCHOOL, THEY WOULD PREFER TO NOT USE IRON MATERIAL AS THEY DESIRE TO HAVE IT SOLID.

UM, A COUPLE OF ITEMS THAT THEY ARE RECOMMENDING IS THAT IT BE SOLID.

UM, IT NOT RETAIN HEAT TO POTENTIALLY BE A DANGER FOR CHILDREN USING THE PLAYGROUND AND IT TO BE RELATIVELY COST EFFECTIVE.

SO THAT, THAT IS A, A REQUEST THAT THEY WOULD LIKE THE COMMISSION TO CONSIDER.

UM, THE OTHER TWO, UH, CONDITIONS ARE ALSO RECOMMENDED, UH, THE FIRST THAT A PHOTOMETRIC PLAN BE SUBMITTED WITH THE GYM STRUCTURE.

AND THE THIRD IS THAT, UM, THESE TEMPORARY STRUCTURES WOULD EXPIRE 18 MONTHS FROM THE DATE OF APPROVAL.

UM, THAT IS THE, I'M GONNA SAY THE DEFAULT FOR TEMPORARY STRUCTURES WITHIN OUR ZONING CODE CURRENTLY.
