AS MAYOR STATED, DENISE BANDLER, CHAIRMAN FOR THE PLANNING AND ZONING COMMISSION FOR THE 2024 TERM I'LL PRESENTING THE 2023 PLAN AND ZONING COMMISSION ANNUAL REPORT, 2023 ANNUAL REPORT APPROVAL.
THE INITIAL DRAFT OF THE REPORT WAS PREPARED BY STAFF AND PRESENTED AT THE PLANNING AND ZONING JANUARY 16TH, 2020 24 MEETING, AND LATER APPROVED TO AT THE MARCH 19TH, 2024 MEETING.
THE COMMISSION IS GOVERNED BY ITS ADOPTED RULES AND REGULATION AND PROCEDURES.
THESE RULES STIPULATE THAT AN ANNUAL PROGRESS REPORT BE SUBMITTED TO THE COUNCIL SUMMARIZING ITS ACTIVITIES, MAJOR ACCOMPLISHMENTS FOR THE PAST YEAR, AND PROPOSED WORK PROGRAM FOR THE COMING YEAR.
THE REPORT ALSO CONTAINS THE ATTENDANCE RECORDS FOR ALL MEMBERS AND IDENTIFIES THE COMMISSION OFFICERS.
WE HAD A NUMBER OF PERSONNEL CHANGES THROUGHOUT THE YEAR.
ZACH FAIRCLOTH AND DIANE CHAVEZ JOINED THE COMMISSION IN JANUARY, REPLACING JOHN MEKE AND NANCY CRAIG.
JOHN MALKEY WAS APPOINTED IN JUNE FOLLOWING THE RESIGNATION OF TOM SAWYERS.
JAY BROECK JOINED THE TOWN STAFF IN JULY AS THE COMPREHENSIVE PLANNING MANAGER AND HAS BEEN VERY D IN AUGUST, JIMMY BAKER WAS APPOINTED TO REPLACE JULIE BRONSON FOLLOWING HER RESIGNATION.
AT THE END OF THE YEAR, BOB KEN CANTINI COMPLETED HIS THIRD TERM AND FINAL TERM ON THE COMMISSION IN NOVEMBER.

SEVEN COMMISSIONERS HAD PERFECT ATTENDANCE DURING THEIR TENURE.
IN 2023, THE COMMISSION REVIEWED 38 PACES.
THIS INCLUDED 17 REONE ZONING AND DEVELOPMENT PLAN REQUEST.
14, SPECIAL USE PERMIT REQUEST, AND SEVEN PLATS.
THIS WAS THE HEAVIEST WORKLOAD THE COMMISSION HAS EXPERIENCED IN THE LAST SEVEN YEARS.
SOME OF THE NOTABLE PROJECTS INCLUDE ZOD ENTITLEMENTS FOR THE ADDISON CIRCLE STATION, ADAPTED REUSE FOR THE FORMER CALL CENTER OF THE ADDISON INNOVATIVE CENTER, AND THE INCREASED REDEVELOPMENT ACTIVITY AT THE ADDISON AIRPORT FROM ATLANTIC AVIATION, SKY HARBOR, AND SKY SQUARED.
LOOKING FORWARD, WE CAN EXPECT AN INCREASE IN THE LONG TERM LONG RANGE PLANNING ACTIVITY WITH ADVANCED 2002 2050 COMMISSION, GOSH, 2050 COMPREHENSIVE PLAN AND UNIFIED DEVELOPMENT CODES PROJECTS THAT ARE CURRENTLY UNDERWAY.
WE HAVE SIX COMMISSION MEMBERS, INCLUDING MYSELF, DIANE CHAVEZ, VICE CHAIR, JIMMY BARKER, TOM BRAUN, EJ COPELAND, AND CHELSEA SMITH.
THERE'S CURRENTLY ONE VACANCY ON THE COMMISSION.
IN CONJUNCTION WITH THE STAFF, WE HAVE DEVELOPED THREE GOALS FOR THE 2024, INCLUDING INCREASED EMPHASIS ON PEDESTRIAN SAFETY AND ENCOURAGING USE OF ALTERNA MODES OF TRANSPORTATION IN ORDER TO REDUCE PARKING DEMAND AND SUPPORT DEVELOPMENT STANDARDS AND INFRASTRUCTURE POLICY THAT LIMITS THE CONSTRUCTION OF EXCESS PARKING SUPPLY.
TWO, EVALUATE RULES, REGULATIONS AND PROCEDURES OF THE PLANNING AND ZONING COMMISSION AND UPDATE TO REFLECT CURRENT PRACTICES AS NEEDED.
AND THREE, CONDUCT PERIODIC DEVELOPMENT TOURS WITH THE COMMISSION THROUGHOUT THE YEAR.

WHEN WE INITIALLY PROPOSED, UM, THE BUDGET TO COUNCIL AS PART OF THE BUDGET PROCESS, WE DID NOT INCLUDE AN AMOUNT TO REAPPLY THE PAINTED SURFACE OF THE PIS PICKLEBALL COURTS.
UM, WE WERE UNDER THE IMPRESSION THAT THE CONTRACTOR COULD WORK FROM THE PERIMETER OF THE COURTS, BUT DUE TO THE OVERHEAD LINES FROM ENCORE AND THE SURROUNDING TREE CANOPY, THE CONTRACTOR HAS REACHED OUT TO US AND INDICATED THAT THEY WILL NEED TO, UM, DRIVE ACROSS THE COURT CONSISTENTLY.
WE THOUGHT IT WOULD BE A LIMITED AMOUNT, AND DUE TO THAT THEY DID WANT US TO BE PREPARED THAT THEY PROBABLY ARE GOING TO DAMAGE THE SURFACING THAT WAS APPLIED TO THE CONCRETE.
I THINK IT'S IMPORTANT TO NOTE THAT WE DO NOT ANTICIPATE, ALTHOUGH THEY DID PUT, YOU KNOW, WE COULD, WE WOULDN'T BE RESPONSIBLE FOR DAMAGE TO THE CONCRETE UNDERLAY.
UM, WHEN WE BUILT THE PICKLEBALL COURT A FEW YEARS AGO, WE USED THE SAME EQUIPMENT AND DROVE OVER THAT CONCRETE SURFACE AND DIDN'T SEE ANY DAMAGE.
WE DON'T HAVE CONCERNS ABOUT THAT HAPPENING.
WHAT WE DO HAVE, UM, CONCERNS ABOUT IS THE KIND OF QUARTER INCH PAINTED ON COLORING THAT'S ON TOP OF THAT BEING DAMAGED AND BEING REPLACED.
WE DID PAY, UM, A LITTLE LESS THAN $15,000 THE FIRST TIME TO APPLY THAT SURFACING.
THERE WAS A LOT OF PREP WORK THAT HAD TO HAPPEN WITH FILLING JOINTS AND STUFF.
SOME OF THAT WILL STILL HAVE TO HAPPEN THIS TIME, BUT NOT TO THAT DEGREE.
SO WE ANTICIPATE THAT THAT COST WOULD BE SLIGHTLY LESS.
UH, THE PROJECT DID COME IN UNDER BUDGET OF ABOUT A 12,000, UM, SOMETHING DIFFERENCE.

THE BENEFIT OF THAT IS, UM, THERE'S SOME MARKETING EFFORT ON FIRM, ON, ON A CONSTRUCTION COMPANY'S PART THAT PRODUCES STRUCTURES LIKE THIS THAT WE ARE NOT PAYING AS MUCH FOR DESIGN AS WE WOULD IF WE HIRED A CONSULTANT TO DESIGN IT AND THEN TURN AROUND AND BID OUT THE SHADE STRUCTURE TO A CONTRACTOR.
UM, THERE WOULD ALSO BE SOME MARKUP, UM, IF WE WENT THAT PATH.

UM, THE GEOTECH REPORT WAS ONE OF THOSE INDICATIONS FOR THEM BECAUSE WE DO HAVE A LOT OF ROCK IN ADDISON AND SOMETIMES IT'S ROCK THAT IT IS HARD TO DRILL THROUGH.
NOW, I CAN'T TELL YOU WHEN WE PUT IN THE FENCE POSTS THAT WE WERE ABLE TO DRILL THROUGH THE ROCK AND SO THAT GAVE THEM A HIGH LEVEL OF CONFIDENCE.
UM, WE ALSO PROVIDED THEM THE GEOTECH REPORT FOR THE SHERLOCK PROJECT.
THERE WAS A BORING DONE ALMOST RIGHT ACROSS FROM THE BASKETBALL COURT THAT THEY WERE ABLE TO LOOK AT.
AND THEY DO START, IT DOES INDICATE THAT THEY START TO HIT LIMESTONE AT FIVE FEET, BUT IT'S A LIMESTONE THAT THEY CAN ACTUALLY DRILL THROUGH.
UM, AND AT 10 FEET THEY START TO HIT VERY HARD LIMESTONE THAT THEY'RE NOT SURE THAT THEY CAN DRILL THROUGH.
IF YOU SEE ON THERE, THEY HAVE TWO PIER FOUNDATIONS THAT THEY'VE DESIGNED IN ADVANCE.
ONE OF THEM IS AN EIGHT FOOT PIER.
UM, THAT'S THEIR PREFERRED PATH FORWARD BECAUSE IT MEANS THAT THEY HAVE TO REMOVE THE MINIMUM AMOUNT OF CONCRETE TO GET THAT PEER IN.
BUT IF THEY DO AN EXPLORATORY BORE AND THEY FIND THAT THEY CAN'T GO DEEP AS DEEP AS THEY NEED TO, THEY'VE ALSO DESIGNED A SPREAD FOOTING THAT WILL ALLOW THEM TO NOT HAVE TO GO AS DEEP BECAUSE THEY'RE SPREADING THAT CONCRETE MASS OUT FURTHER.
AND BOTH OF THOSE PEERS ARE, UM, PRICED IN THE PROPOSAL THAT THEY BROUGHT FORWARD TO US.
IF WE DO HAVE TO GO TO A SPREAD FOOTING, THEY'LL OBVIOUSLY BE MORE PATCHING TO DO, UH, CORRECT ON THE SURFACE, BUT THAT COULD SAVE A COST OF HAVING TO GO DEEPER AND HAVING CHALLENGES THERE.
AND THE SURFACING AMOUNT THAT I'VE, UM, COMMUNICATED TO EVERYBODY IS JUST ANTICIPATING THAT WE WOULD DO A TOTAL REPLACEMENT.

THERE'S LIGHTINGS ON BOTH SIDES OF THE COURT ON THE WEST SIDE AND THE EAST SIDE.
ON THE WEST SIDE, THERE'S DOUBLE HEAD LIGHTS, UM, THAT ILLUMINATES THE TENNIS COURTS TO ONE SIDE THAT PICKLEBALL COURTS TO THE OTHER SIDE.
THE PARKS ELECTRICIAN IS GOING TO COME IN AND REMOVE THE LIGHT HEAD FROM THE DOUBLE HEAD POST AND TURN IT INTO A SINGLE HEAD POST.
UM, HE'S ALSO GOING TO REMOVE THE TIMER THAT WE HAVE.
UM, AND SO IT CAN BE RE RELOCATED AT THE END OF THE PROJECT.
AND THEN THE LIGHTS ON THE EAST SIDE OF THE COURT, HE'S GOING TO COMPLETELY REMOVE AND DEMO THE POLES THAT ARE THERE.
NOW WE ARE GOING TO KEEP THOSE POLES AND THOSE FIXTURES FOR FUTURE USE.
SO WE'LL JUST STORE THOSE AND THEN NEW LIGHTS WILL BE INTEGRATED INTO THE SHADE STRUCTURE WHEN IT'S INSTALLED.
THIS SHADE STRUCTURE, MANU MANUFACTURER ACTUALLY WORKS, UM, REAL CLOSELY WITH AN ELECTRICIAN.
AND SO THEY'RE GOING TO INTEGRATE THE LIGHTING INTO THE INTERIOR OF THE SHADE STRUCTURE.
THEY HAVE INCLUDED AN ALLOWANCE FOR LIGHTING.

THERE WERE SOME COMPLAINTS THAT AT CERTAIN TIMES A DAY AND BASED ON SUN ANGLE, THAT THE LIGHT WOULD SHINE IN THEIR EYES.AND SO THE SHADE STRUCTURE THAT WE HAVE DRAWINGS FOR HAS A CONTINUOUS SEWN SEAM AROUND IT.
AND SO YOU DON'T HAVE THAT GAP.
THE OTHER THING THAT WE SAW IS THERE'S A POST IN THE CENTER COURT THAT'S ALIGNED WITH THE CENTER OF THE MIDDLE COURT, AND AS PLAYERS WERE PLAYING SEVERAL TIMES, THEY BACKED UP AND BACKED INTO THAT POST.
AND SO THIS SHADE STRUCTURE ACTUALLY HAS A DESIGN THAT IT HAS FOUR POSTS ON EACH SIDE INSTEAD OF THREE.

SO THOSE ARE THE IMPROVEMENTS THAT WE MADE.
UM, WHAT WE ARE PROPOSING THOUGH IS THAT WE WOULD MATCH THE POST COLORS AND THE SHADE CLOTH FABRIC COLORS OF WHAT'S INSTALLED AT THIS COURT.

THE FACT THAT WE HAVE CLOSED THE SEAMS AND WE DON'T HAVE PIECES OF FABRIC REVVING AGAINST EACH OTHER WILL HELP WITH THE LIFE EXPECTANCY.
AND SO OUR GOAL WILL BE TO GET 15 YEARS OUT OF THE FABRIC.

UM, IF WE WERE TO HAVE SOME DAMAGE, THAT IS THE REASON THAT WE HAVE INSURANCE AND WE WOULD INCLUDE THIS IN OUR INSURANCE.

BUT I ASKED 'EM IF THEY HAD INCREASED THEIR PRICES A CONSIDERABLE AMOUNT SINCE THE LAST TIME THEY DID THE WORK AND THEY INDICATED THAT IT WOULD PROBABLY BE CLOSE TO IDENTICAL.

AS I MENTIONED, THREE FORKS WILL PROPOSE TO OCCUPY TWO EXISTING SUITES AT 808 12.

THEY WILL ALSO, UH, PROVIDE TWO PRIVATE DINING AREAS AS WELL AS A BAR ON THE INTERIOR.
THEY'LL PROVIDE, UH, 44 UH, SEATS ON THE PATIO.
UH, THE PATIO WILL HAVE A RETRACTABLE SHADE COVER, UM, BUT IT WILL NOT BE ENCLOSED.
UM, AS I MENTIONED, THEY WILL OFFER THE SALE OF ALCOHOL FOR ON-PREMISES CONSUMPTION AND THEY ARE OFFERING VALET SERVICE.
UH, THE PRIMARY ENTRANCE OF THE SUITE IS LOCATED ON THE EAST FACADE.
UM, SINCE THERE WERE TWO EXISTING SUITES, THEY ARE CLOSING, UH, THE ONE OF THE PRIMARY ENTRANCES FOR THE SUITE, WHICH IS AT THE CORNER, UM, OF THE, UM, I GUESS ON THE TOP RIGHT HAND SIDE OF THE FLOOR.
PLAN ON THE SCREEN, UH, FOR A PRIVATE DINING AREA, THE HOURS OF OPERATION WILL BE 4:30 PM TO 10:00 PM SUNDAY THROUGH THURSDAY, AND THEY'RE PROPOSING TO STAY OPEN AN ADDITIONAL HOUR FRIDAY THROUGH SATURDAY.

UH, IN THE, UH, WINTER AND SPRING OF, UH, 2021 AND 2022, THAT'S WHEN THE PROJECT TRANSITIONED TO THE CIVIL ENGINEERING SITE DESIGN AND BUILDING PERMIT PROCESS.
AND IN MARCH OF 2022, UH, THAT'S WHEN, UH, THE TOWN APPROVED CIVIL ENGINEERING PLANS AND ALSO SITE WORK COMMENCED ON THE SITE.
AT THAT TIME, UH, THERE WAS NOT ANY PERMANENT POWER POLES REFLECTED IN THOSE CIVIL ENGINEERING PLANS, BUT THERE WAS A TEMPORARY POWER POLE, AS THE TOWN STAFF WAS TOLD, INSTALLED ADJACENT TO THE TOWN HOMES OF ADDISON NEIGHBORHOOD.
IN MAY, THE TOWN RELEASED THE BUILDING PERMIT FOR THE PROJECT TO ALLOWING IT TO, UH, BEGIN CONSTRUCTION OF THE PRIVATE IMPROVEMENTS AS WELL AS, UH, THE BUILDING OF COURSE.
AND WITH THAT PERMIT, IT REFLECTED NO ADDITIONAL POWER POLES FOR THIS PROJECT AND ALL ELECTRIC UTILITIES TO BE, UH, CONNECTED TO AN EXISTING POWER POLE AND ROUTED UNDERGROUND.
UH, FAST FORWARD, UH, TO AUGUST OF 20 20 20, 20 23, UH, WHEN THE, THE BUILDING WAS, UH, VERY MUCH APPROACHING SUBSTANTIAL COMPLETION.
UH, AT THAT TIME, UH, TOWN STAFF, UH, AS WELL AS GREENHILL SCHOOL LEADERSHIP WAS NOTIFIED, UH, BY SCOTT AND REED, THE GENERAL CONTRACTOR FOR THE PROJECT, AS WELL AS ENCORE THAT THE TEMPORARY POWER POLE THAT WAS PLACED ADJACENT TO 40 92, UH, JULLIARD DRIVE, WAS ACTUALLY A PERMANENT POWER POLE NEEDED TO SERVE, UH, THE VALEZ STEM AND INNOVATION CENTER.
AFTER, UH, DISCUSSION, UH, UH, OVER THE LAST, UH, THE PREVIOUS SEVERAL MONTHS WITH THE TOWN STAFF ENCORE GREENHILL SCHOOL, THE TOWN DID ISSUE A NOTICE OF VIOLATION FOR THIS IMPROVEMENT, WHICH VIOLATES THE TOWN SUBDIVISION ORDINANCE.
SO WITH THAT TONIGHT, UH, THAT IS WHY YOU HAVE A SUBDIVISION SUBDIVISION VARIANCE REQUEST BEFORE YOU, UH, TO CONSIDER, UH, THE PROVISION OF A PERMANENT POWER POLE.
UM, IN THE INTERIM TOWN STAFF HAS WORKED WITH, UH, GREENHILL SCHOOL LEADERSHIP, UH, BY ISSUING A TEMPORARY CERTIFICATE OF OCCUPANCY FOR THE STEM AND INNOVATION CENTER, ALLOWING THEM TO OPEN FOR THE REMAINDER OF THE SCHOOL YEAR AND TO ADDRESS THIS PARTICULAR ISSUE FOLLOWING THE CONCLUSION OF THE SCHOOL YEAR.
SO OUR SUBDIVISION REGULATIONS ARE VERY SPECIFIC AS IT RELATES TO, UH, NEW, UH, OVERHEAD ELECTRIC UTILITY INFRASTRUCTURE, SPECIFICALLY THAT IT IS NOT PERMITTED.
UH, SO WHEN WE WERE TOLD THE TEMPORARY POWER POLE WAS INDEED A PERMANENT POWER POLE, THAT IS WHEN WE NOTIFIED THE, UM, RELATED PARTIES THAT, UH, THAT WAS IN VIOLATION OF THE TOWN SUBDIVISION REGULATIONS AND, UH, ANY NEW UTILITY INFRASTRUCTURE THAT THEY PROVIDED WITH THE SITE HAD TO, UH, EITHER, UH, BE FULLY UNDERGROUND OR TO BE MOUNTED TO AN EXISTING OVERHEAD POWER POLE.
UM, UH, AND WITH THAT REGULATION, IT DOES PROVIDE A PROCESS, UH, A SUBDIVISION VARIANCE PROCESS BY WHICH THEY CAN, UH, SEEK RELIEF, UH, FROM THE CITY COUNCIL.
UM, AND THAT RELIEF REALLY MUST BE TIED TO A HARDSHIP CONDITION CREATED BY APPLICATION OF THE ORDINANCE.
SO WITH THAT, UM, THE APPLICANT'S ORIGINAL, UH, ELECTRIC UTILITY DESIGN HAD ONE POWER POLE, UH, AT THE NORTHERN PROPERTY BOUNDARY OF GREEN HILL SCHOOL, SO NORTH OF HORNET ROAD, UH, REALLY CENTER MASS ON, UH, 40 92 JULLIARD DRIVE.
UH, AND THEN IT INCLUDED ADDITIONAL OVERHEAD ELECTRIC LINES, UH, TRAVERSING ACROSS HORNET ROAD AND CONNECTING TO ANOTHER POWER POLE, WHICH THEN THE LINES THAT ROUTED, ROUTED UNDERGROUND AND CONNECTED TO THE TRANSFORMER.
UH, SERVING THE INNOVATION CENTER.
UH, WITH THE PROPOSAL BEFORE YOU TONIGHT, UH, THE APPLICANT IS REQUESTING TO REMOVE ALL OF THOSE IMPROVEMENTS THROUGH THIS COMPLIANCE PLAN, AND THEY'RE PROPOSING TO ADD, UM, A NEW POWER POLE AT AN ALTERNATIVE LOCATION.

SO HERE IS A, UM, PROPOSED GROUND VIEW OF THE, UH, IDENTIFIED LOCATION.
UH, SO THIS IS SITUATED, UH, GENERALLY AT THE COMMON BOUNDARY BETWEEN 40 90 JULLIARD DRIVE A LOT, UM, TO THE EAST IN THIS IMAGE, UH, TO THE RIGHT, UH, OF THIS IMAGE.
UH, THAT IS A TOWN HOME LOT IN THE TOWN HOMES OF ADDISON NEIGHBORHOOD, AND THEN A LARGER, UH, SINGLE FAMILY DETACHED HOT LOT, UH, OFF OF, UH, VINTAGE LANE, UH, THAT IS ON THE LEFT SIDE OF THIS IMAGE.

THE PROPOSED POLE IS, UH, HIGHLIGHTED IN GREEN, SO IT'S NOT CENTER MASS ON EITHER OF THE LOTS.
AND IN PARTICULAR, IT DOES A REALLY NICE JOB OF AVOIDING THE VINTAGE LANE LOT.
HOWEVER, IT IS, UH, FAIRLY CLOSE TO THE, UH, 40 90 JULLIARD DRIVE LOT, UH, WHICH HAS A LARGER SIDE YARD, UH, PROVIDING FOR MORE OUTDOOR AREA SERVING THAT LOT.
SO WITH THIS REQUEST, AS I MENTIONED EARLIER, UH, ENCORE HAS SHARED WITH TOWN STAFF AS WELL AS GREENHILL SCHOOL LEADERSHIP SEVERAL TIMES THAT THERE IS NO FEASIBLE SOLUTION BY WHICH THEY COULD ACHIEVE THIS WITHOUT ADDING A NEW POWER POLE.
SO IT IS A NEED, UH, AND IT NEEDS TO BE INSTALLED TO SERVE THIS SITE.
UH, IF THERE WAS NOT A LOCATION ALONG THIS NORTHERN EDGE, THE CLOSEST EDGE, UH, AND THE CLOSEST ELECTRIC SERVICE TO THE, UH, VALEZ STEM AND INNOVATION CENTER, THE NEXT CLOSEST FACILITY IS ABOUT A THOUSAND FEET TO THE SOUTH ALONG SPRING VALLEY, UH, ROAD, WHICH WOULD REQUIRE THEM TO GO THROUGH A, A FAIRLY WELL DEVELOPED AREA OF THEIR CAMPUS TO FACILITATE THIS.

UM, REGARDLESS OF WHAT LOCATION IS SELECTED, UH, FOR THIS PARTICULAR IMPROVEMENT, UH, STRICT ENFORCEMENT OF THIS REGULATION, NOT ALLOWING THEM TO PUT UP ANY POWER POLE REALLY WOULD BE A HARDSHIP, UH, FOR GREENHILL SCHOOL.
SO, UM, STAFF DID PROVIDE PUBLIC NOTICE, UH, TO ALL PROPERTY OWNERS WITHIN 200 FEET OF THE SUBJECT PROPERTY, UH, THAT INCLUDED 85 NOTICES THAT WERE SENT.
WE HAVE NOT RECEIVED ANY WRITTEN FEEDBACK, UH, TO DATE.
HOWEVER, WE DO, UH, HAVE A FEW OF THE IMPACTED PROPERTY OWNERS THAT I BELIEVE WILL ADDRESS COUNSEL IN THE PUBLIC HEARING.
SO STAFF DOES RECOMMEND APPROVAL OF THE REQUEST WITH SOME CONDITIONS.
AND I WOULD ALSO ADD A CAVEAT THAT YOU'RE GOING LIKELY GOING TO HEAR SOME FEEDBACK IN THE PUBLIC HEARING, UH, THAT POTENTIALLY ADDRESSES, UH, ANOTHER OPTION TO CONSIDER.
UM, WHEN YOU THINK ABOUT, UH, AND LOOK AT THIS AREA AND YOU LOOK AT THE EXISTING TREE LINE, I NOTED EARLIER THAT THE HACKBERRIES THAT EXIST THERE AND, AND REALLY ALONG THAT ENTIRE FRONTAGE, UM, UH, THAT IS THE COMMON BOUNDARY OF TOWN HOMES OF ADDISON AND GREENHILL SCHOOL.
THERE'S A LOT OF VERY UNHEALTHY LOOKING TREES.
SO TOWN STAFF AS WELL AS GREENHILL SCHOOL STAFF RECENTLY DID AN ASSESSMENT OF THOSE TREES.
AND MOST OF THOSE HACKBERRY TREES DO NEED TO BE REMOVED.
SO WHEREAS THIS PROPOSED LOCATION DOES, UH, UH, HAVE MERITS IN THAT IT DOES NOT REQUIRE ANY TREE REMOVAL, NOW THAT

WE DO KNOW THAT MANY OF THE TREES NEED TO BE REMOVED ANYWAYS, AND THE AREA NEEDS TO BE RE-LANDSCAPED, UH, THAT IN A WAY THAT WILL BE ADDRESSED AT A FUTURE TIME, THERE'S POTENTIAL OPPORTUNITIES THAT PROVIDE EVEN BETTER, UM, MITIGATION OF THE IMPACT OF THIS POWER POLE PROVIDED THAT IT'S TECHNICALLY FEASIBLE TO LOCATE AT THOSE NEW OPTIONS.SO WITH THAT, REGARDLESS OF WHICH WAY THE COUNCIL GOES, IF YOU ELECT TO APPROVE THIS RECOMMENDATION, WE DO HAVE SOME, UH, CONDITIONS THAT WE WOULD APPLY AND REALLY, UH, THAT INCLUDES THE REMOVAL OF ALL THE NON-COMPLIANT OVERHEAD, ELECTRIC UTILITY INFRASTRUCTURE THAT WAS ORIGINALLY INSTALLED.
AND THAT IS CURRENTLY SERVING THE STEM AND INNOVATION CENTER, UM, THAT NEEDS TO REMAIN IN PLACE WHILE SCHOOL IS IN SERVICE.
BUT ONCE THE, UH, SUMMER HITS AND THEY BEGIN THIS WORK TO, UH, ADDRESS THE SITUATION, ALL OF THAT NEEDS TO BE REMOVED.
AND THEN ALL REQUIRED WORK ASSOCIATED WITH THIS VARIANCE, UH, NEEDS TO BE SUBSTANTIALLY COMPLETED PRIOR TO THE NEXT SCHOOL YEAR.
SO THE TCO FOR THE BUILDING EXPIRES, UH, MAY 28TH WHEN SCHOOL YEAR ENDS, AND THEN DURING THAT SUMMER PERIOD THEY WOULD NEED TO COMPLETE THIS WORK AND SUBSTANTIALLY COMPLETE THE INSTALLATION OF THE NEW POWER POLE AND UNDERGROUND ELECTRIC UTILITY INFRASTRUCTURE PRIOR TO GETTING A CO FOR THE PROJECT.

I MEAN, CERTAINLY, UH, THE OPTION OF MOVING IT TO THE, UH, SOUTH END OF THE PROPERTY ALONG SPRING VALLEY, THAT'S NOT FEASIBLE IN MY OPINION.

SO STAFF BELIEVE THAT IS A HARDSHIP FOR THIS PARTICULAR APPLICANT.

AND SO, SO COCO AND I WATCHED THE, UH, THE LINEUP AND I WAS NOT GOING TO SUBJECT THE EASTER BUNNY TO COCO 'CAUSE THAT WOULD BE A LOT FOR, FOR ANYBODY TO HANDLE.
BUT, BUT WE DID GET OUR PICTURE TAKEN, THANK YOU TO REAGAN.
