THE SUBJECT PROPERTY WAS IDENTIFIED AS A PAD SITE IN THAT ORIGINAL PD IN 1997, THERE WAS THE ORIGINAL SPECIAL USE PERMIT TO APPROVE A RESTAURANT WITH A DRIVE THROUGH, UH, SPECIFICALLY FOR THE EXISTING MCDONALD'S. UH, THE REQUEST BEFORE YOU THIS EVENING IS AN AMENDMENT TO THAT SPECIAL USE PERMIT, UH, TO UPDATE THE DEVELOPMENT PLANS. THE PROPOSED SITE MODIFICATIONS WITH THIS REQUEST, UH, INCLUDE THE ADDITION OF A SECOND DRIVE-THROUGH LANE. UH, THIS TRIGGERS SOME OTHER MODIFICATIONS, SPECIFICALLY, UM, NEW MENU ORDERING STATIONS, THE REMOVAL OF 17 PARKING SPACES AND THE REMOVAL OF SOME LANDSCAPING AS WELL AS, UH, ONE TREE ON SITE. UM, IN ADDITION TO THE, THE SECOND DRIVE-THROUGH LANE, UH, THEY'RE ALSO MODIFYING THE ACCESSIBLE PARKING AND, UH, ADDING A EXIT LANE OR A DRIVE-THROUGH EXIT LANE ON THE OPPOSITE SIDE OF THE BUILDING. WITH THESE CHANGES, AS I MENTIONED, THEY ARE REMOVING 17 PARKING SPACES. UH, THE CURRENT REQUIREMENT ON SITE FOR, WITH THE RESTAURANT RATIO OF ONE SPACE FOR EVERY 70 SQUARE FEET WOULD REQUIRE THEM TO HAVE, UH, 78 SPACES. THEY'RE PROPOSING TO HAVE 64 SPACES ON SITE. UH, THIS NUMBER RESULTS IN A PARKING RATIO TO BE PROVIDED OF ONE SPACE FOR EVERY 85 SQUARE FEET. UM, STAFF DOES NOT HAVE CONCERNS WITH THIS DEFICIT. UM, THE APPLICANT DID SUBMIT A PARKING STUDY, UH, TO PROVIDE EVIDENCE THAT SUPPORTED THAT THE SITE CAN FUNCTION APPROPRIATELY AND NOT HAVE NEGATIVE IMPACTS WITH THE PARKING DEFICIT. UH, THE PARKING STUDY SHOWED THAT AT THE PEAK TIMES ON SITE, THE MAXIMUM NUMBER OF SPACES USED AT ANY GIVEN TIME WAS 52. UH, IN ADDITION, UH, THE PROPOSED MODIFICATIONS, UH, TO THE LANDSCAPING WILL MEET OR EXCEED THE TOWN REQUIREMENTS, AND THEY HAVE EXCEEDED THE TREE MITIGATION REQUIREMENTS AS WELL. THEY'RE PROPOSING TO REMOVE ONE, UH, 20 CALIBER INCH TREE THAT'S, UH, IN THE MIDDLE OF THE LANE, THE, THE PROPOSED DRIVE THROUGH LANE. AND THEY'RE PROPOSING TO REPLACE THAT WITH SIX FIVE CALIPER INCH CEDAR ELMS THROUGHOUT THE SITE, UM, ON BOTH SIDES OF EAST [00:10:01] AND WEST SIDES OF THE BUILDING. THERE ARE NO, UM, MODIFICATIONS TO THE APPEARANCE OF THE EXTERIOR. AND, UH, WE'VE BEEN EXPERIENCING A LITTLE BIT OF AN ISSUE ON THE SITE TO WHERE THE CARS WERE ACTUALLY BACKING UP IN THE DRIVE-THROUGH LANE BACK OUT INTO THE DRIVE AISLE, UM, WHICH ACTUALLY WAS BLOCKING SOME OF THE EXISTING PARKING AND MAKING IT DIFFICULT TO GET IN AND OUT OF THE SITE. UM, MCDONALD'S IS VERY COGNIZANT OF THE OPERATIONS OF THEIR SITE. THEY PUT A LOT OF STUDY AND SPEND A LOT OF DOLLARS AND WORKING ON THE EFFICIENCY OF THEIR DRIVE-THROUGHS TO TRY TO MAXIMIZE THAT. AND WHAT THEY'VE DONE ALONG WITH OTHER, MANY OTHER QSRS QUICK SERVE RESTAURANTS THAT, UM, HAVE DONE IS THEY GO TO THE DOUBLE MENU ORDERING POINT. 'CAUSE WHAT THEY FOUND IS THAT THAT'S THE LONGEST TIME THAT IT TAKES IN A DRIVE THROUGH IS WHEN SOMEBODY PULLS UP AND THEY LOOK AT THE MENU. THEY'VE GOTTA DECIDE WHAT THEY WANT. AND SO THAT'S TYPICALLY WHERE THE, THE LOG JAM, SO TO SPEAK, TAKES PLACE. AND SO WE'RE TRYING TO ALLEVIATE A LITTLE BIT OF THAT CONGESTION BY ADDING THAT SECOND MENU POINT SO THAT WE CAN HAVE TWO PEOPLE, UM, PERUSING THE MENU, FIGURING OUT WHAT THEY WOULD LIKE, AND WE CAN ALSO, UH, TAKE TWO ORDERS AT THE SAME TIME TO HELP REDUCE THAT TO GET CARS THROUGH THAT POINT. AND THEN WE CAN UTILIZE THE STACKING FROM WHAT WE CALL THE PICKUP WINDOW OR THE CACHE WINDOW, UM, ALL THE WAY THROUGH THAT SITE WHERE THAT GIVES US A LITTLE BIT MORE STACKING TO ALLEVIATE SOME OF THE, THE BACKUP THAT WE HAVE SO THAT WE'RE HERE. UM, STAFF'S BEEN GREAT WORKING WITH US TO TRY TO MODIFY. WE'RE IN A VERY TIGHT SITE RIGHT HERE. UM, AND SO WE DID HAVE TO LOSE, LOSE A LITTLE BIT OF PARKING. UM, AS STAFF HAD MENTIONED A LITTLE BIT EARLIER, WE ACTUALLY HAD, WE DID A TRAFFIC STUDY. UM, WE, WE DOCUMENTED ALL OF OUR PEAK TIMES AND OUR PEAK SERVICE TIMES, AND WE WENT OUT ON SITE. WE CHECKED WHAT THE PARKING WAS, HOW MANY CARS WERE PARKED IN THE PARKING LOT AT THE MAXIMUM TIMES TO MAKE SURE THAT WE WEREN'T GETTING CLOSE TO THAT THRESHOLD. UM, AND SO WITH THAT, WE'VE BEEN ABLE TO JUSTIFY AND KIND OF WORK THROUGH AND ENSURE THAT WHENEVER WE DO HAVE OUR PARKING, WE DO HAVE THE AMOUNT OF PARKING TO BE ABLE TO HAVE FOR OUR CUSTOMERS TO COME IN. EVERYTHING IS SPED UP, EVERYTHING'S GOING AND BEING ABLE TO COME AND SIT DOWN TO WHERE REALLY GOING THROUGH THAT DRIVE THROUGH THE, THE TRAFFIC DEMAND GOING THROUGH THAT HAS INCREASED. UH, THE REQUEST IS A, FOR A SPECIAL USE PERMIT FOR RELIGIOUS INSTITUTION USE, UH, THAT IS INCLUSIVE OF DEVELOPMENT PLANS, AS WELL AS, UH, SPECIAL USE PERMIT, UH, CONDITIONS SUBMITTED BY THE APPLICANT, JAMES GROSSMAN OF MCDERMOTT, WILL AND EMERY ON BEHALF OF THE PROPERTY OWNER, WHITE, WHITE ROCK CHAPEL OF ADDISON INCORPORATED. SO LOTS OF HISTORY TO THIS SITE. UM, THE GENERAL AREA AS WELL. UH, THAT DATES BACK TO 1884, UH, WHERE THE FIRST CONGREGATION OF THE WHITE ROCK CHAPEL WAS ESTABLISHED EAST OF WHITE ROCK CREEK. UH, IN 1918, UH, THE CONGREGATION WAS ESTABLISHED ON THE SUBJECT PROPERTY, UH, FOLLOWING TRANSITION FROM THEIR PREVIOUS SITE, WHICH WAS FLOOD PRONE, AND, UH, PRESENTED RISK TO THE CONGREGATION. THE LAND THAT, UH, ENCOMPASSES THE SUBJECT PROPERTY WAS DONATED AT THAT TIME BY THE, UH, PROMINENT LANDOWNER OF THAT AREA, SS DOLE. UM, THE CONGREGATION, UH, BEGAN WORSHIPING AT THAT TIME AND ULTIMATELY, UH, WORSHIPED IN THE SAME SPACE. UH, UP UNTIL, UH, THERE WAS, UH, A FLOOD THAT DESTROYED, UH, THE WORSHIP HALL. AND THEN, UH, AFTER ONE WAS REBUILT IN 1960, ANOTHER WAS LOST TO FIRE. UM, FROM 1960 TO 1979, WORSHIP OCCURRED IN THE PARSONAGE BUILDING ON SITE. AND THEN IN 1979, THE CURRENT WORSHIP HALL THAT IS AT THE SOUTHEAST QUADRANT OF THE PROPERTY WAS CONSTRUCTED, UM, IN 2000, UH, THE TOWN, UH, AS WELL AS THE STATE. I WORKED WITH THE PROPERTY OWNERS AT THAT TIME TO, UH, RECOGNIZE THE SITE, UH, BY, UH, PROVIDING FOR A TEXAS STATE HISTORIC MARKER ON THE SITE, RECOGNIZING ITS CONTRIBUTION TO TOWN AND STATE HISTORY. AND THEN IN 2009, THE TOWN, UH, ULTIMATELY PARTNERED, UH, WITH THE LANDOWNER AS WELL AS A LOCAL STAKEHOLDER, UH, UDR, UH, TO REPLACE THE PARSONAGE, UH, BUILDING THAT WAS IN A STATE OF DISREPAIR ON THE SITE. AND, UH, ULTIMATELY WITH THE CURRENT FELLOWSHIP HALL THAT EXISTS NOW IN 2018, THIS PROPERTY WAS ACQUIRED BY THE CURRENT PROPERTY OWNER. UH, I THINK, UH, WITH THIS SLIDE, UH, THERE'S A LOT OF TEXT THAT RELATES TO THE HISTORY OF THE SITE AND THE SURROUNDING NEIGHBORHOOD, BUT I THINK WHAT IS VERY ILLUSTRATIVE OF THAT IS THIS IMAGE. UH, YOU SEE ENCIRCLED IN RED, UH, THE, UH, WHITE ROCK CHAPEL IN 1981. UH, SO THAT WAS ONE YEAR AFTER IT WAS DIS ANNEXED, UH, ALONG WITH THE SURROUNDING AREA, UM, AND ULTIMATELY ANNEXED BY THE TOWN OF ADDISON. SO WHAT YOU'LL SEE IN THIS PICTURE IS, UH, A LARGELY UNDEVELOPED AREA. YOU SEE SOME SINGLE FAMILY HOMES ALONG CELESTIAL AND A HANDFUL ALONG WYNWOOD AS WELL. BUT YOU SEE, UH, NEIGHBORHOODS SUCH AS OAKS NORTH, UM, JUST, JUST STARTING TO GET ESTABLISHED. A HANDFUL OF HOMES THERE. BELLBROOK ESTATES DID NOT EXIST AT THAT TIME. UM, STANFORD COURT VILLAS AND CELESTIAL PLACE NEIGHBORHOODS ALSO DID NOT EXIST. SO THE WHITE ROCK CHAPEL WAS A VERY PROMINENT USE IN THIS UNDERDEVELOPED AREA AT THAT TIME, AND IT HAD BEEN IN EXISTENCE, UH, FOR OVER 60 YEARS AT THAT TIME. SO WHY ARE WE HERE TONIGHT? WHY IS THE SPECIAL USE PERMIT REQUIRED? SO FIRST, UM, WHEN THIS PROPERTY WAS ANNEXED BY THE TOWN, THE ZONING THAT WAS APPLIED AT THAT TIME, AND ULTIMATELY, AGAIN IN 1991, DID NOT MAKE THE RELIGIOUS INSTITUTION USE A LEGAL USE. SO IT WAS ESSENTIALLY A NON-CONFORMING USE, UH, FOLLOWING ACQUISITION, UH, OF THE PROPERTY BY THE CURRENT PROPERTY OWNER IN 2018. THE SITE WAS [00:20:01] LARGELY DORMANT, UH, AS THEY DEVELOPED PLANS FOR THE PROPERTY, AND ULTIMATELY THE PANDEMIC CONDITIONS CONTRIBUTED THAT TO THAT AS WELL. AND ULTIMATELY, A CERTIFICATE OF OCCUPANCY WAS NEVER ACQUIRED FOR THE PROPERTY, AND THERE STILL IS NOT ONE TO DATE. UH, SO THE PAST USE WAS, UH, EFFECTIVELY LOST. UH, THE CURRENT PROPOSAL ALSO INCLUDES SITE IMPROVEMENTS THAT REFLECT A CHANGE, UH, FROM THE PAST USE OF THE SITE, WHICH WE'LL DISCUSS HERE IN A MOMENT. UM, SO WITH THE, UH, PROPOSAL BEFORE YOU TONIGHT, IT INCLUDED DEVELOPMENT PLANS AND THEN ALSO SUP CONDITIONS WITH THOSE SUP CONDITIONS THAT ADDRESS, UH, ITEMS SUCH AS USE DEFINITIONS, UM, COMPLIANCE WITH DEVELOPMENT PLANS AND OTHER DEVELOPMENT STANDARDS THAT ARE GERMANE AND APPROPRIATE TO THE REGULATION OF THIS USE. SO IN DEFINING THE RELIGIOUS INSTITUTION USE, WHICH IS PERMITTED ON THIS PROPERTY AND ANY PROPERTY IN TOWN THROUGH THE TOWN, SPECIAL USE PERMIT PROCESS, THEY, UH, THE USE IS DEFINED AS A CHURCH, TEMPLE, SYNAGOGUE, MOSQUE, OR EQUIVALENT PLACE FOR RELIGIOUS ASSEMBLY AND WORSHIP AND ASSOCIATED ACCESSORY ACTIVITIES, WHICH MAY INCLUDE WEDDINGS, BAPTISMS, FUNERALS, AND OTHER RELIGIOUS ACTIVITIES. IT ALSO PROVIDES LANGUAGE THAT, UH, ACCOMMODATES, UH, EDUCATIONAL ACTIVITIES CONCERNING THE HISTORY OF THE RELIGIOUS ORGANIZATION, ITS CONGREGATION AND ITS RELATIONSHIP TO THE SURROUNDING AREA, WHICH IS IMPORTANT GIVEN ITS HISTORY. IT ALSO DEFINES THE USE WITH REFERENCE TO SECTION 1120 OF THE TEXAS TAX CODE, WHICH IS THE PREVAILING LEGISLATION IN THE STATE AS IT RELATES TO TAX EXEMPTIONS FOR RELIGIOUS ORGANIZATIONS, WHICH ALSO HAS DEFINITIONS FOR RELIGIOUS ORGANIZATIONS EMBEDDED WITHIN THAT TAX CODE. SO THE SITE PLAN PROPOSED AS PART OF THE DEVELOPMENT PLAN SUBMITTED BY THE APPLICANT, UH, INCLUDE A PAVILION, AN OPEN PAVILION WITH 699 SQUARE FEET OF FLOOR AREA PARKING LOT IMPROVEMENTS THAT INCLUDE THE ADDITION OF ADA SPACES, A LOADING ZONE, AND THEN THE DELINEATION OF PARKING SPACES, MAINTAINING THE CURRENT DECOMPOSED GRANITE PAVING MATERIAL, UH, PEDESTRIAN PAVING AND RETAINING WALLS ADJACENT TO THE PARKING AREA AT THE BUILDINGS AND IN THE OPEN LANDSCAPE AREA. SUBSTANTIAL ENHANCEMENTS TO THE LANDSCAPE, AND NO ADDITIONAL INTERIOR FLOOR AREA PROPOSED WITHIN EITHER OF THE BUILDINGS OR THROUGH THE INCLUSION OF A NEW WORSHIP BUILDING. UH, THE FLOOR PLAN PROPOSED BY THE APPLICANT, UH, MAINTAINS THE CURRENT FLOOR AREA, WHICH IN TOTAL IS ABOUT 3000 SQUARE FEET, UH, SPLIT BETWEEN TWO BUILDINGS. THE WORSHIP HALL, UH, IS COMPRISED OF 1,960 SQUARE FEET, AND WITH THAT, THE APPLICANT'S PROPOSING AN INTERIOR REMODEL, UH, TO ACCOMMODATE NEW FINISHES, RESTROOM IMPROVEMENTS, ADMINISTRATIVE STORAGE AND CLASSROOM SPACE. AND THEN IT WOULD ACCOMMODATE SEATING FOR 54 IN THE MAIN WORSHIP HALL WHERE SERVICES COULD BE PROVIDED. UH, THERE ARE NO CHANGES PROPOSED TO THE FELLOWSHIP HALL. AND THEN OF COURSE, THE PAVILION WOULD ADD JUST UNDER 700 SQUARE FEET OF FLOOR AREA, THE PROPOSED PARKING LOT FOR THE SITE, UH, ACCOMMODATES 18 PARKING SPACES IN A LOADING ZONE. UH, THIS MEETS THE MOST COMMON PARKING RATIO FOR, UH, THE MOST COMMON PARKING RATIO FOR RELIGIOUS USES IN NORTH TEXAS. WHEN YOU CONSIDER HOW OTHER CITIES REGULATE THIS USE OF ONE SPACE PER THREE SEATS IN THE MAIN WORSHIP HALL, UM, WITH THE LANDSCAPE PLAN THAT'S PROPOSED, UH, THE EXISTING LANDSCAPE EDGE AT THE SOUTHERN BOUNDARY OF THE SITE. SO THE CELESTIAL ROAD BOUNDARY, IT DOES NOT CURRENTLY COMPLY WITH THE TOWN'S LANDSCAPE REQUIREMENTS IN TERMS OF ITS WIDTH AND THE PROVISION OF LANDSCAPE ISLANDS WITHIN THE PARKING AREA. DUE TO THE NEED TO PRESERVE THE PARKING AREA AND TO, UH, UH, ADDRESS THE APPLICANT'S ABILITY TO PROVIDE ENHANCED LANDSCAPING AT OTHER LOCATIONS ON THE SITE, UM, THAT, UM, THAT RELIEF IS WARRANTED. THE APPLICANT IS SIGNIFICANTLY EXCEEDING THE TOWN'S LANDSCAPE REQUIREMENTS BY ADDING 72 TREES TO THE SITE WITH THIS LANDSCAPE PLAN, AND ULTIMATELY PRESERVING 72% OF THE SITE FOR LANDSCAPE AREA, THE TOWN'S ORDINANCES ONLY REQUIRE 20% OF THE AREA TO BE PRESERVED FOR LANDSCAPE AREA. SO THE, UH, FACADE FOR BOTH BUILDINGS ARE LARGELY GOING TO BE RETAINED. THE ONLY CHANGE THAT'S PROPOSED IS, UM, IMPROVEMENTS TO THE, UM, EXTERIOR ENTRYWAY OF THE WORSHIP HALL. SO THE LARGER MAIN BUILDING AT THE SOUTHEAST QUADRANT [00:25:01] OF THE SITE. UM, THE PAVILION WILL BE CONSTRUCTED OF STEEL AND LIMESTONE COLUMNS AND WILL BE 17 FEET TALL AT ITS TALLEST POINT. NO CHANGES ARE PROPOSED FOR THE FELLOWSHIP HALL. SO WITH THE, UM, USE, UM, THE SUP CONDITIONS THAT ARE PROPOSED, THE FIRST SECTION ADDRESSES USE AND PLAN COMPLIANCE. SO IT FORMALLY DEFINES THE RELIGIOUS INSTITUTION USE, AS I PREVIOUSLY DESCRIBED, AND ALSO MAKES THAT REFERENCE AND TIES IT TO SECTION 1120 OF THE TEXAS TAX CODE. IT ALSO REQUIRES COMPLIANCE WITH ALL OF THE DEVELOPMENT PLANS I JUST REVIEWED. ONE THING I WOULD NOTE HERE IS THAT THE USE CONDITIONS INCLUDED IN THIS APPLICATION, UH, WOULD NOT EXPAND. UH, THE USES THAT ARE PERMITTED WOULD BE PERMITTED THROUGH THIS BEYOND WHAT WAS ALREADY ALLOWED AND ABLE TO BE DONE IN THIS SITE PRIOR TO THE PAST CONGREGATION DISSOLVING. SO ANYTHING THAT'S IN THIS SEP COULD HAVE BEEN DONE WHEN THIS CHURCH WAS ACTIVE IN 2018. SO THE PARKING AND LIGHTING CONDITIONS IN THESE USE CONDITIONS, ONCE AGAIN, DEFINE THAT PARKING RATIO. SO THIS WILL APPLY TO THIS PROPERTY. UM, UH, IF THIS SEP IS APPROVED AT ONE PARKING SPACE PER THREE SEATS IN THE MAIN WORSHIP HALL, IF THEY WERE TO EVER, UH, ADD PARKING OR INCREASE FLOOR AREA, THEY WOULD HAVE TO ACHIEVE THAT THROUGH AMENDMENT OF THIS SEP THROUGH A SIMILAR PROCESS AS TO THIS. THE OTHER COMPONENT OF THAT TO REMEMBER IS THAT PARKING RATIO IS TIED TO THE AMOUNT OF SEATING IN THE WORSHIP HALL. SO WITH WHAT IS PROPOSED 18 PARKING SPACES, THAT MEANS THEY CANNOT EXCEED 54 SEATS IN THE MAIN WORSHIP HALL, WHICH LIMITS THE USE OF THAT BUILDING. UM, PARKING FOR THIS USE, UM, OR PARKING FOR THIS SITE, UH, IT WOULD BE PROHIBITED TO ALLOW OTHER USES, UH, NOT PERMITTED ON THE SITE TO USE THE PARKING LOT, UH, FOR, UH, PARKING USE. AND ALSO THIS, THESE SUP CONDITIONS, UH, PROHIBIT PARKING ON THE GRASS OF THE PROPERTY. UM, LIGHTING IS ADDRESSED BY REQUIRING IT TO BE DESIGNED TO LIMIT INTERACTION WITH THE ADJACENT PROPERTIES AND STREETS. AND IF ANY POLE LIGHTING WERE TO BE PROPOSED IN THE FUTURE, NONE IS PROPOSED AT THE PRESENT. UH, IT WOULD HAVE TO BE SHIELDED AND AIMED DOWNWARD. UH, THE MAINTENANCE AND STORAGE REQUIREMENTS INCLUDED IN THE SEP CONDITIONS ADDRESS, UH, VERY BROADLY THE NEED TO MAINTAIN THE PROPERTY AND THE STATE OF GOOD REPAIR. I WOULD ALSO ADD THAT THE TOWN'S PROPERTY MAINTENANCE, UH, REGULATIONS DO APPLY TO THIS PROPERTY AS WELL. IT ADDRESSES SOLID WASTE CONTAINERS AND THAT THEY MUST BE, BE SUBSTANTIALLY SCREENED FROM VIEW AND SERVICE WEEKLY. LONG-TERM OUTSIDE STORAGE IS PROHIBITED, AND THE PROPERTY OWNER WOULD HAVE THE RIGHT, UH, THOUGH THEY'RE NOT REQUIRED TO DO THIS, TO ACCOMMODATE A, AN ACCESSORY STORAGE BUILDING, AN ENCLOSED BUILDING, NO LARGER THAN 100 SQUARE FEET, IT COULD NOT EXCEED THE HEIGHT OF EITHER OF THE MAIN BUILDINGS, AND IT WOULD HAVE TO BE LOCATED IN A WAY THAT MINIMIZES, UM, VISIBILITY FROM THE ADJACENT STREETS AND MEETS THE PREVAILING SETBACKS FOR THE PROPERTY. SO, BEYOND THE SEP USE CONDITIONS, THERE'S BEEN A LOT OF DISCUSSION ABOUT DEVELOPMENT IMPACTS RELATED TO THIS PROPOSED USE. SO FIRST I WANNA ADDRESS PARKING. SO THERE ARE EXISTING TOWN REGULATIONS THAT APPLY TO ANY PARKING ON WYNWOOD ROAD AND CELESTIAL ROAD PARKING ON EITHER OF THOSE ROADS ARE PROHIBITED AT ANY TIME OF THE DAY, AT ANY DAY, ON ANY DAY OF THE WEEK. ON ANY DAY OF THE YEAR. REGARDLESS OF WHAT HAPPENS WITH THIS SUP, THE TOWN HAS THE AUTHORITY TO CITE THE OWNER OF THE VEHICLE AND TOW AWAY ANY ILLEGALLY PARKED VIDEO PARKED VEHICLE. REGARDLESS OF WHAT HAPPENS WITH THIS SUP, THAT WOULD REMAIN IN EFFECT, UH, FOLLOWING ACTION ON THIS ITEM NOISE. SIMILARLY, THE TOWN HAS NOISE REGULATIONS THAT WOULD APPLY TO THIS PROPERTY JUST AS IT WOULD APPLY TO ANY OTHER APPLICABLE PROPERTY IN TOWN. AND THE NOISE REGULATIONS ARE QUITE BROAD. IT DOES HAVE LANGUAGE THAT ADDRESSES SPECIFIC CONSIDERATIONS IN THE REGULATION, BUT IT ALSO HAS LANGUAGE THAT, UH, IS LISTED HERE, WHICH DEFINES CLEARLY AUDIBLE, UH, NOISE AT A DISTANCE OF MORE THAN 50 FEET FROM THE SOURCE OF THE NOISE MEASURED IN A STRAIGHT LINE AS A PUBLIC NUISANCE THAT WOULD APPLY TO THIS PROPERTY. REGARDLESS OF THIS SEP TRAFFIC, LOT OF, UH, DISCUSSION HAS REVOLVED AROUND TRAFFIC, AND THAT'S UNDERSTANDABLE. WE ARE IN A REGION THAT IS GROWING. ADDISON IS A [00:30:01] CENTRALLY LOCATED COMMUNITY, AND IT'S WELL AMENITIZED. IT HAS A VERY HIGH EMPLOYMENT BASE, ONE OF THE HIGHEST IN THE REGION. IT IS A PLACE WHERE PEOPLE COME TO DO BUSINESS, TO SOCIALIZE AND TO LIVE. THIS PARTICULAR NEIGHBORHOOD IS SURROUNDED BY MANY VERY ACTIVE CORRIDORS. IT IS NEAR SEVERAL OF THE MOST ACTIVE ARTERIAL CORRIDORS IN BELTLINE AND PRESTON ROAD, AND ALSO NEAR SOME OF THE MORE PROMINENT REGIONAL HIGHWAYS IN DALLAS, NORTH TOLLWAY AND I 6 35. THE TRAFFIC ON THE SURROUNDING PERIMETER STREETS IS NOT THE RESULT OF A 3000 SQUARE FOOT CHURCH. IT'S THE RESULT OF THE TREMENDOUS AMOUNT OF ACTIVITY IN THIS AREA RESULTING FROM EMPLOYMENT, PEOPLE COMMUNICATING TO THEIR HOMES, AND PEOPLE COMING TO ADDISON TO SOCIALIZE INTERNALS OF THE NEIGHBORHOOD. THE CHURCH WOULD PRESENT TRAFFIC JUST AS ANY OTHER USE WOULD, BUT APPLYING TYPICAL TRAFFIC ANALYSIS PRINCIPLES TO THE CHURCH AS WELL AS THE EXISTING NEIGHBORHOOD, UH, YOU'LL FIND THAT THE TRAFFIC GENERATED BY THE EXISTING NEIGHBORHOOD PRESENTS A FAR GREATER TRAFFIC IMPACT THAN A 3000 SQUARE FOOT CHURCH WITH 18 PARKING SPACES. LANDSCAPE AND PROPERTY MAINTENANCE LIKE NOISE AND LIKE PARKING, THE TOWN HAS EXISTING REGULATIONS THAT REQUIRE A PROPERTY OWNER TO MAINTAIN THEIR LANDSCAPE AND A GOOD STATE OF REPAIR. AND TO IRRIGATE TURF TREES AND OTHER LANDSCAPE PLANTINGS. THERE ARE REGULATIONS REQUIRING FOLKS TO REPLACE LANDSCAPE THAT'S DIED. AND IF THEY FAIL TO COMPLY WITH THOSE REGULATIONS, THE TOWN HAS THE ABILITY TO CITE THE PROPERTY OWNER FOLLOWING A FORMAL CODE ENFORCEMENT PROCESS. THESE CODES, AS WELL AS OUR PROPERTY MAINTENANCE CODES THAT RELATE TO OTHER SITE FEATURES TO INCLUDE MAINTENANCE OF BUILDINGS, THE PARKING LOT, UM, AND AND SO ON AND SO FORTH, WOULD APPLY REGARDLESS OF WHETHER THIS SUP IS ACTED ON. SO THE, UH, TOWN PROVIDED PUBLIC NOTICE, UH, FOR THIS APPLICATION IN ACCORDANCE WITH TOWN AND STATE REQUIREMENTS, ALL PROPERTY OWNERS WITHIN 200 FEET OF THE SUBJECT PROPERTY RECEIVE NOTICE THAT INCLUDES 15 INCLUSIVE OF THE PROPERTY OWNER. UH, AS OF THIS, UM, ABOUT AN HOUR BEFORE THIS MEETING, WE RECEIVED, UM, 10 STATEMENTS OF OPPOSITION FROM PROPERTY OWNERS WITHIN THAT 200 FOOT BOUNDARY. IF THIS APPLICATION MOVES FORWARD TO CITY COUNCIL, THAT RESULT, IF IT REMAINED AS IT IS, WOULD REQUIRE A THREE FOURTH VOTE OF CITY COUNCIL, A SUPER MAJORITY TO APPROVE THIS APPLICATION. IN ADDITION TO THOSE STATEMENTS WITHIN THE 200 FOOT BUFFER, WE RECEIVED AN ADDITIONAL 40 LETTERS OF OPPOSITION, TWO LETTERS OF SUPPORT, AND ONE NEUTRAL STATEMENT, WHICH WILL BE, IT HAS BEEN PROVIDED TO THE COMMISSION AND WILL BE POSTED ONLINE TOMORROW AS PART OF THE RECORD FOR THIS APPLICATION. SO STAFF DOES RECOMMEND A APPROVAL OF THE REQUEST SUBJECT TO THE CONDITIONS PRESENTED BY THE APPLICANT. THIS PROPOSAL REFLECTS A RELIGIOUS ASSEMBLY USE, AND THE PROPOSED SUP CONDITIONS ARE CONSISTENT WITH TYPICAL ZONING PRACTICES FOR RELIGIOUS ASSEMBLY USES. THERE IS A HUNDRED YEAR HISTORY OF WORSHIP USE ON THIS SITE. BOTH THE TOWN AND STATE HAS RECOGNIZED THE VALUE OF THAT HISTORY IN THE RECENT PAST. THE NEIGHBORHOOD THAT NOW SURROUNDS WHAT WAS DEVELOPED, UH, IS, WAS DEVELOPED WHEN THAT USE WAS ACTIVE. THE USE WAS THERE BEFORE ALL THE SURROUNDING NEIGHBORHOODS DEVELOPED. WHAT IS PROPOSED IS NOT A NEW USE FOR THIS AREA. I KNOW THERE'S A LOT OF DIAL COMMUNITY DIALOGUE AND A LOT OF PASSION REGARDING THIS APPLICATION ON BOTH SIDES OF THE ISSUE. WE ACKNOWLEDGE THAT AND WE UNDERSTAND THAT THIS IS A DIFFICULT APPLICATION WHEN WE CONSIDER AND REVIEW THIS APPLICATION. SO DEFINING THAT WAS IMPORTANT. AND THEN ALSO, WE DO NOT HAVE A FORMALLY DEFINED PARKING RATIO FOR RELIGIOUS INSTITUTION USE. WE DO HAVE SOME LANGUAGE THAT GETS YOU CLOSE TO THAT FOR OTHER ASSEMBLY USES, BUT NOT DIRECTLY APPLICABLE TO THE RELIGIOUS INSTITUTION USE. SO WE BORROWED FROM, SAY, A COMMERCIAL ZONING ORDINANCE. UH, WE LOOKED AT THAT. AND THEN, UM, THROUGHOUT THE DIALOGUE RELATED TO THIS CASE, WE'VE EXAMINED HOW OTHER COMMUNITIES REGULATE THIS USE. AND A VERY COMMON ONE WAS WHAT WAS ULTIMATELY APPLIED HERE. OKAY. AND THERE WAS ANOTHER SLIDE THAT I BELIEVE MENTIONED THAT ALL THE RELIGIOUS USE THAT WENT ON IN 2018 WHEN THE CONGREGATE CONGREGATION DISSOLVED WOULD BE PERMISSIBLE UNDER THE SUP. SO I THINK THE, THE INTENT OF THAT STATEMENT WAS ANYTHING THAT IS INCLUDED IN THIS SUP WOULD HAVE BEEN, UH, PERMITTED UNDER THE PREVIOUS CONDITION. THERE WAS NOTHING THAT WAS BEING PERMITTED BY THIS SUP THAT COULDN'T HAVE BEEN DONE UNDER THE PREVIOUS CONDITION. WHAT IS THE PREVIOUS CONDITION? SO THE, UH, NON-CONFORMING USE. THANK YOU. THAT WAS LARGELY CONSISTENT WITH THE R 16 ZONING DISTRICT, WITH THE EXCEPTION OF IT MODIFIED SOME OF THE DEVELOPMENT STANDARDS SUCH AS SETBACKS. SO IT WAS REALLY, UH, UH, ORIENTED TO ADDRESS THE SINGLE FAMILY HOUSING. IT WAS SILENT ON THE CHURCH, BUT IT, DOES IT ELIMINATE RELIGIOUS ASSEMBLY ON THAT PROPERTY. IT WAS SILENT ON THAT ISSUE BECAUSE RELIGIOUS ASSEMBLY WAS NEVER PERMITTED TO BEGIN WITH. UH, BECAUSE WHEN IT WAS ANNEXED BY THE TOWN, AN SEP FOR RELIGIOUS, UH, INSTITUTION WAS NOT APPLIED TO THE PROPERTY. THE ONLY, THE ONLY WAY THROUGH OUR BASE ZONING DISTRICTS A RELIGIOUS INSTITUTION USE COULD BE APPLIED IS THROUGH A SPECIAL USE PERMIT. SO IT DOES NOT ELIMINATE IT. CORRECT.
