Code, Consultation with City Attorney to seek advice of its attorney: (2) on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Tex. Gov. Code: Legal matters related to request for a Special Use Permit (SUP) to allow a Religious Institution on 1.28± Acres located at the northwest corner of Celestial Road and Winnwood Road (5555 Celestial Road), that is currently zoned Planned Development (PD), through Ordinance No. O91-038. THERE WERE FOUR, UH, APPLICATIONS THAT THE COMMISSION ACTED ON IN THEIR OCTOBER MEETING.
THOSE WENT TO COUNCIL LAST NIGHT.
UH, THAT INCLUDED THE SEP APPLICATIONS FOR THE, UH, MONTESSORI INSTITUTE IN NORTH TEXAS.
UH, RADISSON HOTEL CONVERSION TO A HAMPTON BY HILTON.
AND THEN THE, UH, AMENDMENT TO THE SEP FOR HOME TWO SUITES, AND THEN ALSO THE PD ZONING AMENDMENT, UH, FOR THE CALL CENTER REDEVELOPMENT PROJECT AT THE SOUTHWEST CORNER OF XCEL PARKWAY AND ADDISON ROAD.
ALL OF THOSE WERE APPROVED BY COUNCIL BY, UH, UNANIMOUS VOTES LAST NIGHT.

THE FIRST IS THE MINUTES OF THE PREVIOUS MEETING.
UM, ANY COMMENTS ON THAT, QUESTIONS ON THE PREVIOUS MEETINGS MINUTES? I THINK WE'RE GOOD THERE.
THE NEXT ITEM, UH, IS A SPECIAL USE PERMIT FOR CAREER DISCOVERY ACADEMY.
UH, THIS IS A TRAINING PROGRAM FOR HEALTHCARE PROFESSIONALS.
UH, IT IS PROPOSED TO BE LOCATED WITHIN AN EXISTING SUITE AT 14 6 6 5 MIDWAY ROAD, SUITE 1 55.
THEY'RE NOT PROPOSING MODIFICATIONS TO THE, UH, INTERIOR EXTERIOR OF THE SITE WITH THIS APPLICATION.
THE ONLY QUESTION I HAD WAS THERE'S 42 SPACES, UM, WITHIN THE TEXAS UTILITIES AREA.
IS IS THAT OFF OF MIDWAY? CORRECT.
SO IT'S THE SAME, UM, STRIP AT WHERE WET REDDING TRAIL IS AS WELL AS THE DOG PARK.
SO NONE OF THOSE SPACES WERE AFFECTED BY, UM, THE 10 FOOT JOGGING TRAIL OR THE CONSTRUCTION ON MIDWAY? THAT IS CORRECT.
THOSE ARE EXISTING TODAY AND WILL REMAIN.
UH, THE NEXT ITEM IS A SPECIAL USE PERMIT FOR, UH, MCDONALD'S.
THIS IS AN AMENDMENT TO THE DEVELOPMENT PR PLANS THAT WERE PREVIOUSLY APPROVED FOR MCDONALD'S BACK IN THE LATE NINETIES.
UH, THE REASON FOR THIS, UH, AMENDMENT IS TO ALLOW A SECOND DRIVE THROUGH LANE, SO THERE'LL BE SOME MINOR SITE MODIFICATIONS RELATED TO THOSE CHANGES TO ADD THAT SECOND LANE.
UH, THEY'RE NOT PROPOSING, UM, INCREASE OF THE GROSS FLOOR AREA OF THE, OF THE EXISTING RESTAURANT.
REAL QUICK, IF THEY MAKE THE DETERMINATION AT A LATER POINT THAT IT DOESN'T WORK AND THEY GO REVERT BACK, UH, IS THERE A REQUIREMENT THEY GO BACK TO LIKE THE REQUIRED PARKING OR IS THAT ELIMINATED BY

THIS CHANGE? SO YEAH, SO THE WHERE THEY TORE OUT WHAT THEY'RE TAKING OUT? YEAH.SO IF THE, UH, REQUEST IS UL TONIGHT IS ULTIMATELY APPROVED, UH, THE DEVELOPMENT PLANS, WHICH ARE, WAS, WERE PROVIDED TO YOU IN THE PACKET, THOSE WILL BECOME THE APPROVED PLANS.

THEY COULD, IF THEY WANTED TO MAKE ADDITIONAL SITE MODIFICATIONS, THEY COULD BACK COME BACK BEFORE YOU ALL FOR ANOTHER AMENDMENT TO THEIR SPECIAL USE PERMIT.
