THIS IS IN PREPARATION FOR OUR REGULAR MEETING TONIGHT AT SIX O'CLOCK.

UH, I WILL NOW CALL THE MEETING TO ORDER.

[1. Announcements for the Planning and Zoning Commission: Welcome new Planning and Zoning Commissioner, Jimmy Barker]

FIRST OFF, UH, WE HAVE, UM, WE HAVE JULIE BRANSON WHO HAS STEPPED OFF THIS COMMITTEE.

SHE HAD SOME WORK COMMITMENTS, UM, AND WE THANK HER FOR HER SERVICE AND THAT ALSO GIVES US THE OPPORTUNITY TO WELCOME A NEW PLANNING END ZONING AND COMMISSIONER JIMMY BARKER.

SO, WELCOME, JIMMY.

UH, AS WE DO IN ALL IN ALL THESE WORK SESSIONS.

[2. Status update on recent Planning and Zoning Commission cases and planning policy items.]

YOU GIVE US A STATUS UPDATE ON RECENT PLANNING AND ZONING COMMISSION CASES? GOOD EVENING COMMISSIONERS AND WELCOME COMMISSIONER BARKER.

UH, KEN SCHMIDT, DIRECTOR OF DEVELOPMENT SERVICES FOR THE TOWN.

SO WE DID HAVE FOUR APPLICATIONS, UH, FROM YOUR, UM, AUGUST MEETING MOVE FORWARD, UH, FOR CITY COUNCIL CONSIDERATION AT THEIR SEPTEMBER 12TH MEETING.

UH, THREE OF THOSE APPLICATIONS WERE ULTIMATELY APPROVED, UH, BY CITY COUNCIL.

ONE OF THOSE APPLICATIONS, UH, LUX, A RESTAURANT CONCEPT ON THE NORTH SIDE OF BELTLINE, UH, ADJACENT TO SURVEYOR BOULEVARD, UH, WITHDREW THEIR APPLICATION, UH, PRIOR TO ACTION BEING TAKEN.

UM, THE THREE OTHER ITEMS, UH, BEGINNING WITH THE TRAMMELL CROW MIXED USE PROJECT THAT WAS APPROVED BY A VOTE OF FIVE, ONE AND ONE.

SO THE SAME VOTE AS P AND Z ITEM.

AND THEN, UH, WE HAD THE, UH, BAUMAN OFFICE, UM, RESIDENTIAL USE CONSIDERATION THAT WAS APPROVED UNANIMOUSLY.

AND THEN ALSO, UH, WE HAD THE, UM, UH, THE, UH, LIQUOR SALES KIOSK OR THE ALCOHOL SALES KIOSK FOR THE HOLIDAY INN EXPRESS THAT WAS ALSO APPROVED UNANIMOUSLY.

OUR NEXT AGENDA ITEM FOR THE WORK SESSION IS DISCUSSIONS REGARDING TONIGHT'S ITEMS THAT ARE ON THE AGENDA.

UM, THE FIRST ITEM IS THE MINUTES FROM THE AUGUST 15TH MEETING, UM, THEY WERE CIRCULATED.

DOES ANYONE HAVE ANY, UH, CHANGES OR EDITS THAT WE NEED TO MAKE TO THOSE MINUTES? ALRIGHT, AND WE'RE, WE'RE GONNA USE THE CONSENT AGENDA TONIGHT, OR DO WE, ARE WE JUST GONNA VOTE ON THE MINUTES? I WAS A LITTLE CONFUSED ON THE AGENDA YOU SENT OUT.

UH, THE MINUTES ARE ON THE CONSENT AGENDA FOR THIS TONIGHT'S MEETING.

OKAY.

OUR SECOND AGENDA ITEM IS THE REPL.

UH, IT'S AN APPROVAL OF A REQUEST FOR A VILLAGE ON THE PARKWAY.

IT LOOKS LIKE THAT'S A 30 DAY EXTENSION.

YES.

UH, LESLIE KNIGHT PLANNING AND DEVELOPMENT MANAGER, UH, THAT ITEM, THEY ARE REQUESTING A 30 DAY EXTENSION FOR THE, UH, REPL FOR A VILLAGE ON THE PARKWAY.

THAT WAS, UH, THE BLOCK 900, UH, KIND OF OFFICE RETAIL BUILDING THAT WAS APPROVED EARLIER THIS YEAR.

UH, THEY HAD REQUESTED AN EXTENSION WHILE THEY WRAP UP SOME OF THEIR CIVIL REVIEW THAT WILL COME BACK TO YOU FOR CONSIDERATION NEXT MONTH.

AND IS THAT A REPL OF THE WHOLE AREA OR THAT MIXED USE OFFICE RETAIL BUILDING JUST TO THE EAST OF WHOLE FOODS.

SO IT'S TECHNICALLY A REPL OF THE ENTIRE SITE, BUT THE MODIFICATIONS ARE SPECIFIC ONLY TO THE BLOCK 900.

SO VILLAGE ON THE PARKWAY IS ACTUALLY PLATTED AS ONE SINGULAR LOT FOR THAT ENTIRE AREA.

IT IS NOT SUBDIVIDED INTO MULTIPLE LOTS, SO THAT'S WHY, UM, THE REPL COMES AS THE ENTIRE LOT.

HOWEVER, THE MODIFICATION IS ONLY TO ABANDON AND RELOCATE, UH, VERY SPECIFIC UTILITY AND FIRE LANE EASEMENTS TO ACCOMMODATE THE, UH, SHIFT IN THE BUILDING LOCATION OF THE OFFICE RETAIL THAT WE PREVIOUSLY PROVED A COUPLE MONTHS AGO.

CORRECT.

AND SO THAT LOCATION IS BACKED UP TO WHOLE FOOD, IS THAT CORRECT? SO IT'S, UH, THAT TRIANGLE THAT'S CURRENTLY VACANT, THAT'S ON THE, THE EAST SIDE OF WHERE WHOLE FOODS IS REALLY THE WHOLE FOODS PARKING LOT.

IS, UH, A SPECIAL USE PERMIT FOR THE ALLEY.

THIS IS A SPECIAL USE PERMIT FOR A RESTAURANT WITH THE SALE OF ALCOHOL.

THEY'RE PROPOSING TO, UM, OCCUPY AN EXISTING, UH, SPACE THAT WAS FORMERLY USED, UH, AS PETE'S, UH, DO DUELING PIANO BAR.

UM, SO IT'S BEEN VACANT FOR, UH, I BELIEVE APPROXIMATELY FOUR TO FIVE MONTHS AT THIS STAGE.

UH, SO THIS BUSINESS, THE ALLEY IS PROPOSING TO MOVE INTO THIS SPACE ONCE AGAIN, OPEN A RESTAURANT.

UM, THEY'RE PROPOSING TO KEEP, UH, THE TWO EXISTING BARS THAT ARE IN THE SPACE.

THEY WILL SELL ALCOHOL.

THEY'RE ALSO PROPOSING TO MAINTAIN THE STAGE THAT'S CURRENTLY IN THERE FOR, UH, VARIOUS ENTERTAINMENT OPPORTUNITIES.

UH, YOU'LL READ IN THEIR LETTER OF INTENT THAT THEY HAVE INDICATED, UH, AN INTEREST IN HAVING THINGS OFFERING ENTERTAINMENT OPTIONS LIKE, UH, KARAOKE TRIVIA NIGHTS, UM, BEER AND WINE TASTINGS, UH, OTHER SMALLER EVENTS WITHIN THEIR, THEIR RESTAURANT SPACE FOR THEIR PATRONS.

UH, THEY AREN'T PROPOSING ANY SITE MODIFICATIONS.

UM, THEY DO, UH, MEET OUR MINIMUM REQUIREMENTS AS IT AS IT RELATES TO, UH, PARKING.

UM, THEY DO HAVE MODIFIED PARKING REQUIREMENTS ON THIS SITE, UH, UNDER AN EXISTING PLAN DEVELOPMENT THAT WAS APPROVED IN, IN TWO TH UH, 2001.

EXCUSE ME.

SO, AND WE'LL, WE CAN GO OVER THAT IN A LITTLE BIT MORE GRANULAR DETAIL DURING THE, THE REGULAR MEETING, BUT I'D BE HAPPY TO ANSWER ANY QUESTIONS.

LESLIE, ANY QUESTIONS ON THAT AGENDA ITEM? I HAVE ONE.

SO, AND YOU GUYS MIGHT NOT KNOW.

WHY ARE YOU THAT, JUST THE WAY YOU SAID IT , SO YOU GUYS MIGHT NOT KNOW THIS OR, OR NOT, BUT, UM, SO ADDISON WALK, YOU KNOW, THERE WERE SOME PARKING ISSUES THERE FOR A WHILE.

YOU PEOPLE WERE PARKING IN THAT IN THIS CENTER.

AND I JUST WONDER HOW, HOW IS THAT PARKING WORKING OUT NOW? ARE THERE ANY ISSUES THAT YOU KNOW OF? UM, I HAVE HEARD THAT PARKING CAN BE CONGESTED DURING PEAK TIMES.

I THINK, UM, SPECIFICALLY WHILE THERE IS EVENTS, I KNOW THE, THE IMPROV, UM, LOCATION WHEN THEY DO HAVE EVENTS, EVENTS HAS A BIG DRAW AND A BIG PARKING DEMAND.

UM, AS FAR AS THE REMAINING USES, THERE IS A, A QUITE SIGNIFICANT, UM, DIVERSITY IN THE, IN THE USES.

SO THERE IS, UH, A SIGNIFICANT PRESENCE OF, OF RETAIL AS WELL AS PERSONAL SERVICE AND RESTAURANT USES.

UM, SO THAT'S, I GUESS WHAT I WOULD COMMUNICATE ABOUT THE, THE CURRENT PARKING ON SITE.

AND EARLY IN MY TENURE HERE, I DID GET FEEDBACK FROM A BUSINESS OWNER IN THIS CENTER, UM, WITH CONCERNS RELATED TO PARKING.

UM, THAT HAS NOT HAPPENED IN, IN SOME TIME.

SO IT'S PROBABLY BEEN TWO YEARS SINCE THAT DISCUSSION OCCURRED.

SO I HAVE NOT RECEIVED ANY SPECIFIC FEEDBACK, UM, UH, OF LATE RELATED TO PARKING CHALLENGES, UM, IN THIS SITE.

I'VE NEVER RECEIVED ANY, UM, FEEDBACK RELATED TO ADDISON WALK, UH, CUSTOMERS, UM, UH, PARKING IN THE SITE, BUT I COULD CERTAINLY SEE WHERE THAT, THAT COULD HAPPEN, UM, ON A BUSY NIGHT.

BUT, UH, NO RECENT FEEDBACK THAT WOULD SUGGEST, UH, THERE'S STILL SIGNIFICANT PARKING CHALLENGES.

I KNOW THERE WAS SOME TALK ABOUT DOING SOME SORT OF PARKING AGREEMENT WITH THE, THAT GARAGE THAT'S BEHIND ADDISON WALK.

DO YOU KNOW IF THAT EVER HAPPENED? I DON'T BELIEVE IT DID.

IS WESTWOOD FINANCIAL THE OWNER OF THE RETAIL CENTER OR MANAGER? OKAY.

THAT IS CORRECT.

THEY ARE THE, THE PROPERTY OWNER.

ARE THEY COMING THIS EVENING THAT YOU'RE AWARE THE I THE PROPERTY OWNER IS NOT COMING WESTWOOD FINANCIAL, BUT THE, THE BUSINESS, UH, OPERATOR AND OWNER, UH, SEAN COOPER, IT WILL BE IN ATTENDANCE THIS EVENING.

SO HE WOULD KNOW THINGS LIKE CHRIS'S QUESTION ABOUT IF THEY'VE EXTENDED A, UH, IF THEY'VE NOT EXTENDED, NOT THE ALLEY OPERATOR, SOMEBODY FROM THE REAL ESTATE, FROM THE THE PROPERTY.

SO DOES CHRIS, IS DOES YOUR QUESTION RELATE TO ADDISON WALK OR TO THE PRO THIS PROPERTY, I GUESS COLLECTIVELY? I I JUST WANTED TO KNOW IT IS PARKING WORKING AT BOTH CENTERS? MM-HMM.

'CAUSE IF IT'S NOT WORKING IN EDISON WALK AND IT'S WORKING NOW BECAUSE PETE'S WENT OUT, IF WE PUT ANOTHER BAR IN THERE, ARE WE GONNA CERTAINLY GONNA HAVE A PROBLEM AGAIN, IS MY QUESTION.

I HAVEN'T RECEIVED ANY FEEDBACK IN MY TENURE HERE RELATED TO PARKING ON EDISON WALK.

AND THE ONLY FEEDBACK I RECEIVED IN THIS PARTICULAR PROPERTY WAS WHAT I MENTIONED EARLIER.

YEAH, AND I THINK THE DIFFERENCE BETWEEN THE TWO, KEN IS ADDISON WALK, THEY ONLY, THEY REALLY ONLY HAD ONE, UM, VALET PARKING AND IT WAS, I GUESS FOR ONE OF THE RESTAURANTS AND IT WASN'T ANYTHING LIKE THE IMPROV OR PEACH DUELING PIANOS THAT IT TAKES IT TO A WHOLE NOTHER LEVEL.

SO I WOULD THINK THAT YOU PROBABLY HAVE NO ISSUE AT ADDISON, MARK AND, UH, ADDISON WALK.

AND THE REASON IN THE LAST

TWO YEARS BECAUSE OF THE PANDEMIC, THERE'S PROBABLY BEEN, YOU KNOW, LESS PEOPLE THERE TOO.

SO IF THIS GETS APPROVED, STAY TUNED AS THEY SAY 'CAUSE IT MIGHT GO BACK TO WHAT IT WAS.

SURE.

ALRIGHT, ANY OTHER QUESTIONS ON THIS AGENDA ITEM, THE ALLEY? NOPE.

UH, THE NEXT AGENDA ITEM IS THE REZONING REQUEST FOR CHICK-FIL-A.

YES.

THIS IS A, UH, REQUEST TO REZONE THE SUBJECT PROPERTY, UH, 37 90 BELTLINE ROAD.

THIS IS ON THE SOUTH SIDE OF BELTLINE ROAD, UM, ALMOST DIRECTLY ACROSS FROM THEIR CHICK-FIL-A'S CURRENT SITE ON THE NORTH SIDE.

UM, SO THEY'RE REQUESTING TO REZONE THE SITE.

IT HAS A QUITE EXTENSIVE ZONING HISTORY AND WE WILL, WE WILL WALK THROUGH THAT.

UM, THIS PAD SITE WAS AT ONE TIME BACK IN THE, THE EIGHTIES AND NINETIES, A PART OF WHAT IS ADDISON TOWN CENTER, WHICH IS THE, THE TARGET KROGER SHOPPING CENTER.

SO THAT ACCOUNTS FOR MUCH OF ITS ZONING HISTORY.

UM, THEY WERE ALSO REQUESTING A SPECIAL USE PERMIT FOR A RESTAURANT WITH A DRIVE-THROUGH AS WELL.

UM, THEY ARE PROPOSED TO HAVE THE, WE, THEY WILL HAVE DINE-IN SEATING.

UH, THEY WILL HAVE QUITE EXTENSIVE DRIVE-THROUGH LANE, UM, MORE THAN FIVE TIMES THE STACKING CAPACITY OF WHAT THEY CURRENTLY HAVE ACROSS THE STREET.

UH, AND THEY WILL ALSO HAVE A SMALL OUTDOOR PATIO AREA AS WELL.

UM, THEY DO MEET THE PARKING AND LANDSCAPING REQUIREMENTS.

UH, THEY WERE NOT ABLE TO FULLY MITIGATE TREES ON SITE.

THEY ARE DOING A COMBINATION OF MITIGATION VIA REPLACEMENT TREES.

UM, APPROXIMATELY 170 CALIBER INCHES WILL BE REPLACED ON SITE.

AND THEN I BELIEVE, UM, IT'S AROUND 80 CALIBER INCHES AT THEIR PER PROPOSING TO, UH, REPLACE VIA FEE IN LIEU OF WHICH EQUATES TO JUST OVER $17,000.

SO STAFF, UM, IS RECOMMENDING APPROVAL OF THIS REQUEST.

I'D BE HAPPY TO TAKE ANY QUESTIONS.

QUESTIONS FOR LESLIE? HOW MUCH THOUGHT DID WE GIVE? EXCUSE ME.

I KNOW WE DID THE TRAFFIC STUDY, BUT, UM, IS THERE GONNA BE, IT'S GONNA BE TWO DRIVE-THROUGH LANES, RIGHT? CORRECT.

UM, THE, AS FAR AS QUEUING FOR THE CARS GO MM-HMM.

, UM, DO WE KNOW HOW MANY CARS COULD STACK UP AND IS THERE ANY POTENTIAL FOR IT TO COME OUT TO EITHER ON BELTLINE OR THE ENTRANCE OR EXIT TO THAT CENTER? YEAH, SO, UH, THERE WE DID, UH, ASK THE APPLICANT TO COMPLETE A, A TRAFFIC IMPACT ANALYSIS.

UH, THE RESULTS OF THAT DID SHOW A, UM, AN INCREASE IN THE ANTICIPATED TRIPS PER DAY BASED ON THE CURRENT LOCATION TO THE PROPOSED SITE.

UH, ON THE SOUTH SIDE, UM, STAFF DOES FEEL LIKE THEY ADEQUATELY ACCOMMODATED ONSITE AND BOTH.

AND ADDITIONALLY, THE T I A DID NOT, UH, RECOMMEND OR I SHOULD SAY RECOMMENDED MINIMAL TRAFFIC MITIGATIONS OFFSITE.

SO, UH, THE, THE MITIGATION EFFORTS THAT WERE PROPOSED BY THE T I A INCLUDED SOME MINOR TIMING CHANGES TO THE STOPLIGHTS, UM, BOTH AT, UH, WHAT WOULD BE BUSINESS AVENUE AND THEN THE, UH, ANOTHER ONE ON BELTLINE I, THE CROSS STREET ESCAPES ME AT THIS POINT, BUT SOME SLIGHT TIMING ISSUES DURING PEAK HOURS TO ACCOMMODATE DEMAND AT THOSE INTERSECTIONS.

UM, BUT THERE IS NO ADDITIONAL NEED FOR, UM, TRAFFIC SIGNALS, THINGS LIKE THAT.

SORRY, DO YOU HAVE ANOTHER QUESTION? WHAT I WAS REALLY GETTING AT IS WITH, WITHIN THE SITE ITSELF, WHEN YOU START TO QUEUE UP CARS, DO WE KNOW HOW MANY? YEAH, SO THERE'S, THERE'S OVER 700 FEET OF STACKING ON SITE.

SO IF YOU FIGURE ABOUT 20 FEET PER CAR, THAT'S 35 CARS THAT WOULD BE STACKED ON SITE, THAT IS COMPLETELY OUT OF THE FIRE LANE AND OUT OF MANEUVERABILITY AREA FOR PARKING SPACES AS WELL.

SO THERE WOULD BE TECH, THERE WOULD TECHNICALLY BE ADDITIONAL STACKING AREA, UM, THAT WOULD NOT BE WITHIN THE FIRE LANE.

HOWEVER, IT WOULD HINDER MANEUVERABILITY OF CARS GETTING IN AND OUT OF PARKING SPACES.

UM, I THINK GENERALLY, UM, CHICK-FIL-A DOES A PRETTY GOOD JOB ABOUT PUSHING TRAFFIC THROUGH, ESPECIALLY THROUGH THE DRIVE-THROUGH AND MAKING SURE THAT THEY'RE, THEY'RE MITIGATING ANY SAFETY CONCERNS THAT EXIST.

AND BOTH THE ENTRANCES, THEY HAVE TO COME TO THE, INTO THE SHOPPING CENTER.

THERE'S NO, THERE IS NO ACCESS.

THEY, THEY'RE COMING CA BACK WHAT I CALL KIND OF BACK BEHIND IT TO GET SOME WAY, RIGHT? CORRECT.

THEY'RE, THEY'RE NOT PROPOSING ANY ADDITIONAL ACCESS POINTS.

THEY'LL MAINTAIN THE TWO, UM, THAT ARE BOTH SET BACK OFF OF BELTLINE ROAD.

THERE WILL BE NO ACCESS DIRECTLY FROM BELTLINE ROAD, UM, FOR CARS TO STACK ALL THE WAY

THROUGH THEIR DRIVE THROUGH, THROUGH THEIR SITE, AND THEN BACK ONTO BELTLINE WOULD BE, UM, QUITE IMPRESSIVE IF THEY HAD THAT MANY CARS.

I CAN'T IMAGINE THAT THAT WOULD, UM, FAIR ENOUGH.

THAT'S A, THAT'S A HIGH RISK SITUATION.

AND AS FAR AS THE TRAFFIC STUDY VERSUS LIKE THE TOWN'S REVIEW, DO THEY LOOK AT THAT POINT IN TIME DURING THIS? IF THEY WOULD NEED A LEFT TURN AT WHAT IS NOT A LIGHT CURRENTLY THAT GOES INTO THE CENTER? SO BETWEEN THIS BANK SITE AND LIKE THE EINSTEIN'S BA BAGELS, WHEN YOU'RE WESTBOUND ON BELTLINE, THERE'S A MM-HMM.

YOU CAN TURN THERE, BUT IT'S NOT A PROTECTED, IT'S NOT A LIGHT INTERSECTION.

CORRECT.

THEY REVIEWED WHO, WHO DOES THAT KIND OF, AND HAS THAT BEEN DONE AT THIS POINT? YES, SO THAT WAS A PART OF THE, THE T I A, SO THEY STUDIED BOTH OF THE ADJACENT INTERSECTIONS.

UM, I GUESS WHAT WOULD BE ON THE NORTH, UM, WEST AND THE NORTHEAST CORNERS OF THE SITE, UH, 'CAUSE YOU HAVE BUSINESS AVENUE ON THE, THE EAST SIDE AND THEN YOU HAVE THE PRIVATE DRIVE ON THE WEST.

SO BOTH OF THOSE INTERSECTIONS WERE EVALUATED AS WELL AS OTHER ADJACENT INTERSECTIONS, UH, FURTHER EAST AND FURTHER WEST ALONG BELTLINE.

OKAY.

I JUST WANNA MAKE SURE, 'CAUSE I DON'T KNOW IF I WOULD TECHNICALLY CALL THAT AN INTERSECTION BECAUSE IT'S NOT CROSSING ACROSS BELTLINE AT THAT POINT.

SO THAT'S WHY I'M CLARIFYING.
