UH, THIS BUSINESS IS, UH, AS I MENTIONED, A RESTAURANT THAT FIRST BEGAN IN THE AREA AS A FOOD TRUCK.

UH, HAS SINCE EXPANDED TO, UH, SUITE ONE 10 IN THIS SHOPPING CENTER, UH, FOR CATERING AND TAKEOUT, AND IS LOOKING TO EX FURTHER EXPAND THEIR OPERATIONS INTO THIS SUITE.

THIS SITE, UH, IS CURRENTLY ZONED, UH, WITHIN A PLAN DEVELOPMENT.

IT WAS REZONED FROM COMMERCIAL TO PLAN DEVELOPMENT IN 1983.

UH, LATER IN 2011, THERE WAS A PD AMENDMENT AS WELL AS A SPECIAL USE PERMIT ON THAT SITE, UH, TO IDENTIFY A LIST OF PERMITTED USES, AS WELL AS A APPROVE A CONVENIENCE STORE WITH THE SC SALE OF ALCOHOL FOR OFF-PREMISES CONSUMPTION.

UH, AND BEFORE YOU, THIS EVENING IS A SPECIAL USE PERMIT REQUEST FOR A DINE-IN RESTAURANT, UH, WITH THE SALE OF ALCOHOL FOR ON-PREMISE CONSUMPTION.

THERE ARE FAIRLY MINOR MODIFICATIONS PROPOSED ON THE INTERIOR.

UH, THEY'RE PROPOSING TO REMOVE, UM, I BELIEVE TWO WALLS OR PORTION OF TWO WALLS.

UH, TO EXPAND THE DINING AREA, THERE WOULD BE A TOTAL OF 41, UH, SEATS.

IN THE APPROXIMATELY 2,500 SQUARE FOOT RESTAURANT.

THERE WOULD BE FIVE SEATS AT THE BAR, UH, WHICH IS PROPOSED, AND THEN ANOTHER 36 SEATS WITHIN, UH, TABLE AND BOOTHS WITHIN THE DINING AREA.

UM, I MENTIONED THIS EARLIER, BUT THIS OPERATION ALSO, UH, CONDUCTS CATERING BUSINESS AS WELL.

AND THEY'LL DO THEIR DINE-IN, UH, SEATING, EXCUSE ME, THEIR DINE-IN SEATING FOR THEIR RESTAURANT, AS WELL AS CONTINUE THEIR TAKEOUT OPERATIONS.

THE PROPOSED, UM, HOURS OF OPERATION FOR THE, THE RESTAURANT WOULD BE 11:00 AM TO 7:00 PM TUESDAY THROUGH THURSDAY, UH, NOON TO 9:00 PM ON FRIDAY AND SATURDAY, AND THEN NOON TO FIVE ON SUNDAYS.

THE SUBJECT PROPERTY, UH, IS CURRENTLY MEETS THE REQUIRED PARKING OF 73 PARKING SPACES.

HOWEVER, WITH THE STAFF RECOMMENDED CONDITION, WHICH IS TO BRING THE EXISTING FIRE LANE INTO COMPLIANCE, WHICH INCLUDE, WOULD INCLUDE, UH, THE REMOVAL OF TWO PARKING SPACES TO COMPLY WITH THE APPROPRIATE TURNING RADII FOR A FIRE ENGINE.

THIS WOULD PUT THEM BELOW THE MINIMUM REQUIREMENT OF 73 BY PROVIDING 71 PARKING SPACES ON SITE.

UH, STAFF DOES NOT BELIEVE THIS, UH, PARKING DEFICIT OF TWO SPACES WILL BE A CONCERN.

UH, AND IT IS, UM, IMPORTANT THAT THE FIRE LANE, IT'D BE APPROPRIATELY ACCOMMODATED ON SITE.

UH, ADDITIONALLY, STAFF IS REQUESTING THAT AN ADDITIONAL HANDICAP PARKING, A HANDICAPPED PARKING SPACE ALSO BE PROVIDED ON SITE.

AND AS FAR AS THE OPEN SPACE AND LANDSCAPING REQUIREMENTS, THERE ARE NO PROPOSED MODIFICATIONS.

UH, THE SITE PROVIDES APPROXIMATELY 5% OPEN SPACE, WHICH IS STILL IN COMPLIANCE WITH THE PLAN DEVELOPMENT THAT WAS APPROVED IN 2011.

ADDITIONALLY, THERE ARE NO EXTERIOR, UH, OR FACADE, UH, MODIFICATIONS.

PROPOSED NOTICES WERE PROVIDED TO EIGHT, UH, PROPERTY OWNERS WITHIN 200 FEET OF THE SITE, AND STAFF HAS NOT RECEIVED ANY RESPONSES TO THAT NOTICE.

AND IN CONCLUSION, STAFF RECOMMENDS APPROVAL OF THIS REQUEST WITH THE THREE CONDITIONS BEFORE YOU AS REFERENCED IN THE STAFF REPORT, UH, THE FIRST BEING THAT THERE BE NO, UM, DEPICTION OF ALCOHOL AND ANY EXTERIOR SIGNAGE, UH, THAT THE FIRE LANE BE BROUGHT INTO COMPLIANCE, AND THAT AN ADDITIONAL HANDICAP PARKING SPACE BE PROVIDED ON SITE.

UM, I WOULD BE HAPPY TO TAKE ANY QUESTIONS.

ON, ON THE PARKING ON THIS, UH, SHOULD WE HAVE CONSIDERATION FROM THE STANDPOINT THAT, UH, THE, UH, THERE IS A RIGHT NEXT DOOR TO THEM IS ACTUALLY A DONUT PLACE THAT'S ONLY OPEN UNTIL, I THINK, AT 11 O'CLOCK IN THE MORNING FROM THAT STANDPOINT, FOR THEIR PARKING SPACES TO TAKE CARE OF THOSE TWO THAT WE'RE GONNA TAKE AWAY FROM THEM? YEAH.

SO THAT WAS A PART OF, OF STAFF'S, UM, REVIEW OF THIS APPLICATION WAS LOOKING AT, UH, NOT ONLY THIS PARTICULAR PROPOSAL FOR DINE-IN RESTAURANT, BUT THE ADJACENT USES AND CURRENT, UH, USE OF THE EXISTING PARKING LOT.

UH, SO THIS PARTICULAR PARKING LOT STAFF HAS, UH, RARELY OBSERVED, YOU KNOW, PEOPLE SPILLING OUT ONTO ADDISON, UH,

ROAD OR SUNBELT DRIVE DUE TO LACK OF PARKING.

UH, THE EXISTING MIXTURE OF USES AS WELL AS, UM, PEAK DEMANDS OF THOSE DIFFERENT USES ARE NOT ALL THE SAME.

SO THEY'RE NOT ALL RESTAURANTS AND ALL HAVE A PEAK DEMAND AT THE SAME TIME.

UM, I BELIEVE THERE'S A LAUNDRY, UM, LAUNDROMAT THERE, A TATTOO SHOP, UH, A DONUT PLACE, I THINK A TACO PLACE, AND, UM, A CONVENIENT STORE AS WELL AS THE PROPOSAL TONIGHT FOR A, A DINE-IN RESTAURANT.

SO THOSE MIXTURE OF USES ALLOWS THE, UH, PARKING TO BE APPROPRIATELY ACCOMMODATED THROUGHOUT THE DAY.

THEY HAVE RELOCATED, I BELIEVE, UM, THAT WAS APPROXIMATELY APRIL OR MAY OF THIS YEAR, UH, TO SUITE ONE 10.

UH, SO THEY HAVE ALREADY R RELOCATED SUITES.

HOWEVER, HOWEVER, THEY HAVE NOT BEGUN, UM, ANY DINE-IN OR THE SALE OF ALCOHOL UNTIL THEY GET THEIR SPECIAL USE PERMIT APPROVED.

SO WHERE THE, WHERE THE SIGN IS TODAY IS WHERE THEIR RESTAURANT IS.

THE LOBBYISTS PROPOSED TO BE OPEN, UH, AND ACCESSIBLE BETWEEN EIGHT AND 8:00 PM UH, MONDAY, EXCUSE ME, SEVEN DAYS A WEEK.

UH, THIS PROPOSED USE WOULD FUNCTION VERY SIMILARLY TO AN OFFICE, AS YOU SAW ON THE FLOOR PLAN, UH, AND IS UNLIKELY TO HAVE A LARGE INFLUX OF PEOPLE IN AND OUT, UH, ON A, UH, SIGNIFICANT OR OR REGULAR BASIS AS THE CLASS SIZES WILL BE RELATIVELY SMALL.

UM, THIS PARTICULAR SITE WAS APPROVED, UH, FOR A PLAN DEVELOPMENT IN 1985.

AND WITH THAT, THERE WAS A SITE PLAN, WHICH IS, UH, BEFORE YOU ON THAT SITE PLAN, THERE WAS 174 PARKING SPACES IDENTIFIED.

CURRENTLY, THE SITE IMPROVEMENTS PROVIDE 150 PARKING SPACES.

UH, STAFF SUSPECTS THAT THROUGH, UM, SEVERAL, UH, INTERVENTIONS THAT PARKING DEFICIT COULD HAVE BEEN CREATED.

IT ALSO COULD HAVE BEEN CREATED WHEN THE SITE WAS DEVELOPED.

THAT IS SOMEWHAT UNKNOWN WHEN WE'RE WORKING WITH THE SITE, UH, THAT WAS DEVELOPED IN THE LATE EIGHTIES AND SOME POSSIBLE LACK OF, UH, HISTORICAL RECORDS ON THAT PARTICULAR ITEM.

UH, ALL THAT TO SAY, UH, STAFF DOES NOT BELIEVE THAT THE DEFICIT, UH, FOR THE EXISTING USE AND THE PROPOSED USES OF THE SITE WILL CREATE ANY CONCERN AS THERE IS INFREQUENTLY, UH, PARKING CONCERNS OR HIGH DEMAND OF PARKING AT THIS PARTICULAR SITE.

TIME IS MONEY.

CORPORATE OFFICE HAS MONEY SET ASIDE FOR THINGS LIKE THIS.

BUT I FEEL LIKE IF WE COULD KIND OF STREAMLINE THE PROCESS OR SPEED UP THE PROCESS OR COMMUNICATION OF EVERYTHING THAT NEEDS TO BE DONE, WHERE IF THAT PERSON IS WILLING TO DO IT, GET IT DONE WITHIN 30 DAYS OR 60 DAYS, NOT TAKE IT OVER 90 DAYS.

SO IT PUTS A LOT OF STRESS ON THE SMALL BUSINESSES BECAUSE IT'S TYPICALLY SOMETHING THAT YOU WOULD HIRE A CONSULTANT FOR AND THEY WOULD WALK YOU THROUGH THE PROCESS.

AND THAT PROCESS INCLUDES PREPARING PLANS.

AND NOT ALL SMALL BUSINESSES HAVE THE RESOURCES FOR THAT OR HAVE THE TIME TO FIND A CONSULTANT OR THE,

SO ONE OF THE THINGS THAT WE, UH, NEED TO LOOK AT WITH THE UDC IS CREATING SOME THRESHOLDS BY WHICH AN S U P IS REQUIRED.

THERE'S, UM, A LOT OF RESTAURANTS AND HOW THEY OPERATE, WHERE I THINK IT'S STILL A NEED, BUT A RESTAURANT LIKE THIS, I WOULD HAVE NO ISSUE NOT REQUIRING AN S U P IN THE FUTURE.

UM, AND COMMUNICATION IS ALWAYS SOMETHING THAT WE CAN IMPROVE ON.

UH, COMMUNICATION IS A, IS A TWO-WAY ISSUE TOO, BUT OUR STAFF ALWAYS HAS ROOM FOR IMPROVEMENT ON THAT.

SO I DO APPRECIATE THAT FEEDBACK AND, AND WE WILL, WE'LL STRIVE TO DO BETTER IN THE FUTURE.

SO KIM, JUST AS A SORT OF, UM, OBSERVATION, DOES IT, DOES IT MAKE SENSE TO HAVE MAYBE A COUPLE OF DIFFERENT BUCKETS FOR RESTAURANTS THAT SERVE ALCOHOL AND THOSE THAT DON'T SERVE ALCOHOL, THOSE RESTAURANTS THAT ARE UNDER 50 PEOPLE FROM ZERO TO 50, 50 TO A HUNDRED, OVER A HUNDRED, WHATEVER THAT IS, IS OR IS THE PROCESS JUST PRETTY MUCH IT, IT IS WHAT IT IS.

NO, I, I THINK WE DO NEED TO LOOK AT TAKE THE BUCKET APPROACH.

THE BIG THING FOR ME IS, IS PROBABLY LESS, UM, ALCOHOL.

IT'S MORE THE LATE NIGHT HOURS.

UH, WE HAVE MANY RESTAURANTS LIKE THIS ONE, UH, WHICH WILL EVENTUALLY AS WELL THAT, UM, IT, IT, ALCOHOL SERVICE IS NOT AN ISSUE.

WHERE WE RUN INTO THE ISSUES IS PRIMARILY THE RESTAURANTS THAT, THAT STAY OPEN AND RESTAURANTS PROBABLY A GENEROUS TERM FOR SOME OF THESE PLACES THAT STAY OPEN AND, AND, AND KEEP LATE NIGHT HOURS.

SO THAT PICK UP THE KIND OF THE AFTER PARTY CROWD.

UM, SO THAT IS WHERE THE S U P IS, IS PROBABLY MOST NEEDED.

SO I THINK, I THINK THERE'S OPPORTUNITY THERE.

THE OTHER TRICKY THING WITH OUR SMALL BUSINESSES IS THEY FREQUENTLY ARE, UM, JUST, IT'S THE NATURE OF THINGS.

THEY'RE FINDING THE SPACES THAT ARE, ARE MOST ECONOMICAL AND REALISTIC FOR THEM ARE ALSO SOME OF OUR OLDEST SPACES, WHICH TEND TO HAVE THE MOST CODE COMPLIANCE ISSUES.

SO THE BOTH OF THESE, UH, SITES, THESE PROJECTS WE DISCUSSED TONIGHT, I THINK REFLECT THAT.

SO IT OFTEN, ONE, IT MAKES OUR JOB MORE DIFFICULT IN THAT WE'RE TRYING TO GET TO A WIN-WIN AND IN HELPING THESE BUSINESSES GET ESTABLISHED.

BUT TO DO THAT, WE HAVE TO BE PRETTY, TAKE A POLITIC, PRETTY FLEXIBLE APPROACH TO, TO REGULATION TOO.

SOME PLANNERS WOULD LOOK AT SOME OF THESE ISSUES IN A VERY BLACK AND WHITE WAY AND SAY, NO, YOU DON'T MEET PARKING.

THIS WON'T DO THAT.

SPACE NEEDS TO STAY VACANT.

THAT'S NOT OUR ROLE HERE IN ADDISON WHERE OUR, OUR ROLE IS TO, TO KEEP OUR BUSINESSES VIBRANT AND FULL AND ACTIVE AND TO SUPPORT GREAT BUSINESSES LIKE THIS.

SO WE TRY TO WORK WITH IT, BUT SOMETIMES THAT MAKES IT MORE, UH, CHALLENGING AND CUMBERSOME AND DIFFICULT FOR OUR APPLICANTS.

AND THE SMALL BUSINESSES IN THOSE OLDER CENTERS KIND OF BEAR THE BRUNT OF THAT.

YOU KNOW, THE BIG COMPANIES HAVE A TEAM OF PEOPLE TO DO ALL OF THE STUFF THAT SHE AND HER HUSBAND AND WHOEVER SHE CAN GET TO HELP ARE GONNA HAVE ABSOLUTELY ALL.

SO, SO DOES THE TOWN PROVIDE LIKE, NAMES OF THEM FOR SPACE PLANNERS AND THAT MAYBE THAT ARE ADDISON BASED WHERE, YOU KNOW, THEY'RE RIGHT HERE IN, YOU KNOW, EVERYBODY'S A LITTLE MORE, IT'S A TRICKY AWARE WITH HOW THE TOWN WORKS, OR DO YOU GET INTO TOO MUCH TROUBLE WITH PUTTING OUT A LIST LIKE THAT? IT'S A TRICKY ETHICAL LINE FOR A PUBLIC AGENCY.
