SO WE WERE, UH, MAKING SURE THAT, YOU KNOW, WE WERE LOOKING AT ALL OF THE MAINTENANCE EASEMENTS, ESPECIALLY FOR THE TOWN HOMES THAT BACK ONTO THAT, UH, PUBLIC PARK AREA. AND ALL OF THOSE THINGS WERE ACCOUNTED FOR. AND UNFORTUNATELY, UH, SOME OF THOSE THINGS CAME WITH THE SECOND REVIEW, UH, OF THE PROJECT. SO WE DIDN'T HAVE ENOUGH TIME TO COME BACK AROUND FOR A THIRD REVIEW PRIOR TO THE MEETING TONIGHT. OKAY. SO, UH, BACK TO BACK TO SOLE FULL STREET BITES. UH, SO THAT WOULD REQUIRE THEM TO LOSE A COUPLE OF PARKING SPACES TO MAKE SURE THAT THAT FIRE ENGINE CAN MAKE THAT TURN, UH, APPROPRIATELY WITHOUT HITTING ANY CARS THAT ARE PARKED IN THE AREA. UH, AND THEN THE THIRD CONDITION FOR THAT ITEM IS THAT AN ACCESSIBLE PARKING SPACE BE ADDED TO THE SITE TO COME INTO COMPLIANCE. I APOLOGIZE, THAT'S FOR THE SOLE, SOLE FULL STREET BITES AND THEIR PARKING IS IN COMPLIANCE. WHEN YOU TAKE AWAY THE TWO ADD THE ONE HANDICAPPED, IT IS NOT, SO IT'S CURRENTLY IN COMPLIANCE 73 REQUIRED 73 PROPO, OR EXCUSE ME, THERE IS 73 REQUIRED, AND THEY CURRENTLY HAVE 73 ON SITE WITH THE REDUCTION FROM THE FIRE ENGINE, FROM THE FIRE LANE. IT TAKES THEM UNDER COMPLIANCE TO 71 PARKING SPACES. UM, HOWEVER, WITH HOW THE SITE IS DESIGNED, WHICH WAS, UH, DEVELOPED IN THE LATE EIGHTIES, THERE IS NOT ANOTHER LOCATION TO RELOCATE THOSE PARKING SPACES OR TO ACCOMMODATE THE, THE FIRE LANE. UM, UH, ON THE VITAL SKILLS, UH, 48 51 KELLER SPRINGS. CAN YOU TALK A MINUTE ABOUT THE CODE VIOLATIONS AND WHY WE'RE DECIDING TO MOVE FORWARD WITH APPROVAL? UM, DO YOU FEEL LIKE YOU STILL HAVE ENOUGH LEVERAGE TO GET THE PROPERTY OWNER TO GET EVERYTHING BACK UP TO CODE IF WE APPROVE TONIGHT? YES. SO WORKING, UH, WITH CODE ENFORCEMENT, UH, WE'LL PURSUE OUR, OUR TYPICAL CODE ENFORCEMENT PROCESS, WHICH INCLUDES NOTICE OF VIOLATION, AND THEN, UM, HOPEFULLY THEY PRODUCE A PLAN FOR COMPLIANCE. SO WE WILL HAVE TO WORK WITH THE PROPERTY OWNER, THEY WILL NEED TO CONSTRUCT A DUMPSTER ENCLOSURES, AND, AND THEY WILL ALSO NEED TO, UH, RES STRIPE THE FIRE LANE TO THE APPROPRIATE WIDTH, AS WELL AS REMOVE SOME SPEED BUMPS. SO THOSE ARE A COUPLE OF ITEMS THAT WILL LIKELY TAKE MORE THAN 10 DAYS TO COMPLETE, UH, FROM THAT NOTICE OF VIOLATION. SO, UH, THE PROCESS MOVING FORWARD WILL BE TO, UH, GET A PLAN TO COME INTO COMPLIANCE FROM THE PROPERTY MANAGEMENT GROUP AND THEN WORK THROUGH THAT PLAN. AND EVENTUALLY, IF THEY DO NOT COME INTO COMPLIANCE, MOVE FORWARD WITH, UM, UH, CITATIONS TO THE PROPERTY MANAGEMENT GROUP. UH, THAT IS, UH, OUR TYPICAL PROCESS FOR, UM, SITES THAT DO NOT HAVE ZONING SPECIAL USE PERMIT REQUEST. UH, IN THIS PARTICULAR INSTANCE, THOSE MODIFICATIONS, OR EXCUSE ME, THOSE CODE ENFORCEMENT VIOLATIONS HAVE, UM, ARE NOT RELATED TO THE REQUEST IN ANY WAY. UM, SO IN THIS INSTANCE, WE WOULD BE ESSENTIALLY PUNISHING A TENANT FOR, UH, THE PROPERTY MANAGEMENT ERRORS. OKAY. AND THEN IT WASN'T CLEAR TO ME THERE'S, THERE'S 174 SPACES, PARKING SPACES THAT WERE IDENTIFIED, BUT YOU, WE FOUND ONLY 150. AND I KNOW PART OF THAT MIGHT BE A, A, A LOADING BAY OR SOMETHING, BUT DOES IT MEET THE REQUIREMENT RIGHT NOW? I DO NOT BELIEVE IT MEETS THE CURRENT REQUIREMENT. SO WHEN THIS SITE WAS DEVELOPED IN THE LATE, I BELIEVE IT IS THE LATE EIGHTIES OR THE EARLY NINETIES, UM, THE REQUIRED PARKING WAS BASED ON, UH, AN OFFICE WAREHOUSE RATIO OF APPROXIMATELY, UH, I BELIEVE IT WAS ONE TO 300 PARKING SPACES. AND THAT EQUATED TO THE 174 PARKING SPACES. NOW, THE, THAT WAS THE APPROVED SITE PLAN, AND NOW ON SITE TODAY WAS IS THERE'S 150 PARKING SPACES. UNFORTUNATELY, I STAFFED AT THIS TIME, DOES NOT KNOW WHAT HAS HAPPENED OVER THE LAST 30 YEARS IF IT WAS EVER DEVELOPED TO HAVE 174 PARKING SPACES, OR IF SOME WERE REMOVED LATER, UH, AFTER IT WAS DEVELOPED. UM, UNFORTUNATELY IF YOU COMPARE AN AERIAL TO THE APPROVED SITE PLAN, IT WOULD NOT BE EVEN FEASIBLE FOR THEM TO NOW MEET THE APPROVED SITE PLAN. SO, UH, THE WORK WE'VE DONE WITH THE UNIFIED DEVELOPMENT CODE TO DATE, YOU'LL RECALL THAT WE ADDRESS PARKING, UH, THE PARKING RATIOS THAT WE PROPOSE, UH, ACROSS THE BOARD ON USES RESTAURANT OFFICE RETAIL WOULD RESOLVE A LOT OF WHAT WE PERCEIVE AS REGULATORY PARKING ISSUES THAT AREN'T, UH, PARKING ISSUES IN FROM A PRACTICAL STANDPOINT, A A REALITY STANDPOINT, TH THIS SITE IS AN EXAMPLE. THERE'S NEVER, THERE'S NO ONE PARKING ON KELLER SPRINGS. THERE'S NOT, UH, EVER AN OPPORTUNITY WHERE YOU DON'T HAVE A SPACE TO PARK THERE. SO IT'S NOT SOMETHING THAT WE SEE AS AN ISSUE NOW, BUT IT'S JUST ON PAPER, IT'S AN ISSUE. BUT THOSE WILL BE RESOLVED WHEN WE DO, MANY OF THEM WILL BE RESOLVED WHEN WE DO ADOPT NEW PARKING RATIOS. YEAH. AND I'M SURE THAT THERE ARE OTHER LOCATIONS IN TOWN THAT FALL INTO THIS SAME SORT OF TRAP WHERE NOTHING'S BEEN DONE FOR 30 YEARS. SO WHATEVER WE, WE HAVE ON THE BOOKS AND WHATEVER THEY COME FORWARD WITH GOING FORWARD, OTHERS MIGHT BE NON-COMPLIANT AS WELL. ABSOLUTELY. I'D SAY THE BIGGEST ISSUE WE HAVE IS LESS SO PARKING. IT'S MORE SO THINGS LIKE WE ADDRESSED WITH SOCIAL STREET BITES, HAVING APPROPRIATE FIRE ACCESS, HAVING APPROPRIATE HANDICAPPED PARKING, YES. HAVING APPROPRIATE PEDESTRIAN CIRCULATION AND, UH, HANDICAPPED ACCESSIBLE, UH, PATHWAYS SERVING THESE BUSINESSES. SO THAT'S WHAT WE REALLY TRY TO DO WHEN WE GO THROUGH THESE ZONING PROCESSES TO, TO REALLY ENCOURAGE RETROFIT TO BETTER MEET THOSE STANDARDS. IT'S NOT ALWAYS POSSIBLE TO GET IT ALL THE WAY ACROSS THE FINISH LINE THERE WITHOUT DEMOLISHING THE SITE, BUT WE IMPROVE IT [00:20:01] AS MUCH AS WE CAN. AND SO, UH, HAVING THOSE REGULATIONS TO BETTER IMPROVE THAT AND INCENTIVIZE BETTER BEHAVIORS IS REALLY GONNA BE IMPORTANT FOR US. WELL, AND I, I HAVE A QUESTION, I, I GET YOU THAT THIS IS THE TENANT THAT'S FILING FOR THIS APPLICATION, BUT THAT'S FOR THE BETTERMENT OF THE OWNER. SO WHY IS THOSE ITEMS THAT ARE VIOLATIONS NOT A RESTRICTION THAT WE'RE PUTTING IN FOR OUR CONDITIONS TO APPROVE THIS, TO BE THAT, TO BE FIXED? IT, IT'S SOMETHING THAT WE COULD CONSIDER. UM, WE THINK THAT THE, THE CODE ENFORCEMENT PROCESS IS, IS AN APPROPRIATE PROCESS. IT'S SOMETHING THAT WE COULD TIE IT DOWN TO THE ZONING THOUGH, AS AN S U P CONDITION. UH, BUT WE, WE FEEL THAT, UH, GIVEN THE, THE VERY, UH, MINOR NATURE OF THIS REQUEST AND THAT WHAT THE TENANT'S PROPOSING, AND IT'S NOT ANYTHING THAT WE WOULD REQUIRE SITE IMPROVEMENTS FOR, UM, IF THOSE CODING ITEMS WERE NOT, UH, EXISTING, IT WOULD, IT WOULDN'T BE SOMETHING THAT THEY'D HAVE TO IMPROVE THE LANDSCAPE OR ADD PARKING. SO IT, IT'S, IT'S JUST FROM A BUSINESS STANDPOINT, IT, IT'S HARD FOR ME TO, TO WANNA HOLD UP THIS TENANT WHEN IT'S REALLY A CODE ENFORCEMENT ISSUE THAT TO, TO BE FAIR, HAS PROBABLY GONE ON FOR DECADES ON THIS PROPERTY. UM, RIGHT. WHICH MEANS THEY HAVEN'T CORRECTED IT FOR DECADES. UNDERSTAND, IT'S MY POINT OF THIS IS THE WAY TO SOMEWHAT FORCE IT IN EXTRA WAY IN ADDITION TO ANY FINES THAT THEY MAY GET. AND I GUESS QUESTION FROM, I GUESS THE TENANT AND THE OWNER'S STANDPOINT, IF WE APPROVE THIS, I MEAN, HOW DO THEY KNOW THAT WE AREN'T JUST GONNA TURN AROUND AND GO AFTER THEM FOR CODE ENFORCEMENT THE NEXT DAY? YOU KNOW, NOW THAT IT HAS BEEN BROUGHT TO THEIR ATTENTION, ARE WE JUST BY APPROVING IT WITH THESE PARKING SPACES, THEY KNOW THAT THEY'RE, THEY'RE FINE? OR HOW DOES THAT, HOW DOES THAT EVEN WORK? I MEAN, WE'RE, WE'RE FOLLOWING OUR TYPICAL PROCESS FOR CODE. UM, IT'S THE, THE PARKING ON THIS SITE IS NOT SOMETHING THAT WE FEEL IS A CURRENT ISSUE BASED ON THE, THE CURRENT USE MIX ON THE PROPERTY. WE EVALUATE THAT FREQUENTLY AS WE GET NEW, UH, PROPOSALS FOR MULTI-TENANT SITES. WE DO HAVE TO EVALUATE THE USE MIX AND HOW THAT IMPACTS THE PARKING SUPPLY ON SITE. SO IF WE HAD A MULTI-TENANT SITE THAT WAS JUST FILLING UP WITH RESTAURANTS AND IT WAS PARKED FOR OFFICE, THAT'S AN ISSUE. BUT IF WE HAVE A OFFICE WAREHOUSE, FLEX SPACE SITE LIKE THIS, THIS, THAT IS, THAT IS FILLING UP WITH, UM, UH, USES LIKE THIS, IT'S TYPICALLY NOT AN ISSUE WHERE WE HAVE TO WORRY ABOUT ENFORCEMENT. IS THAT CENTER MOSTLY VACANT OR OCCUPIED? UH, THAT'S A GREAT QUESTION. UM, I'D SAY IT'S, UH, JUST, UH, FROM A PRACTICAL STANDPOINT, I, I SUSPECT IT'S STRUGGLING LIKE A LOT OF LOWER DENSITY B AND C OFFICE PROPERTIES AND, AND HAS SOME VACANCY. UH, BUT IT IS WELL LOCATED NEXT TO ADDISON AIRPORT AND BY THE TOLLWAY. SO IT, IT'S, IT'S, IT'S STILL A GOOD PROPERTY, BUT I DON'T THINK IT'S, IT'S BUSTING AT THE SEAMS WITH TENANTS.
