SO TONIGHT WITH THIS REQUEST FROM TOASTED YO CAFE, UH, THERE IS A, UH, REQUEST FOR A SPECIAL USE PERMIT TO ESTABLISH A NEW RESTAURANT SPACE, UH, TO INCLUDE A PATIO. AND THEN ALSO THE SALE OF ALCOHOL FOR ON-PREMISES CONSUMPTION. UH, SO WITH THIS TENANT SPACE, UH, THEY'RE REUSING THE EXISTING SPACE, BUT THEN THEY'RE ALSO ADDING A PATIO, UH, TO PROVIDE A NEEDED AMENITY, UH, FOR, UH, THIS RESTAURANT SPACE. UH, THIS IS A BRUNCH RESTAURANT. SO HAVING THAT PATIO FOR THE FALL AND SPRING, UH, WEATHER THAT WE ARE ABOUT TO ENTER IS A, IS A KEY COMPONENT, UH, OF THE BUSINESS PLAN FOR THIS PROPERTY. SO, UH, WITH THAT THERE'S, UH, JUST OVER, UH, 4,600 SQUARE FEET OF SPACE, 600 OF THAT IS ON THE PATIO AND THEN IT PROVIDES SEATING FOR 144, 100, UH, SPACES INSIDE AND THEN 44 OUTSIDE. UH, SO THE CHALLENGE WITH THIS SITE, LIKE MANY OF THE SITES THAT YOU SEE, UH, THAT ARE OLDER AND HAVE EXISTING DEVELOPMENT AND ARE NOW STARTING TO SEE A DEPTH DEGREE REUSE AND REDEVELOPMENT IS, UM, THE SITE IN ITS CURRENT CONDITION DOES NOT MEET TOWN ZONING REGULATIONS FOR LANDSCAPE AND PARKING. SO TYPICALLY WHEN STAFF, UH, IS FACED WITH THAT CONSIDERATION, UH, ONE, THE, THE GOAL IS TO, TO BALANCE THOSE NEEDS. THEY'RE BOTH IMPORTANT, BUT WE DON'T WANT TO, UH, PRIORITIZE ONE OVER THE OTHER IN AN UNBALANCED WAY. AND ANOTHER COMPONENT OF THAT IS WHEN WE CONSIDER THESE APPLICATIONS, UH, WE WANT TO ENSURE THAT WE CAN GET AN ECONOMICALLY VIABLE USE ON THE PROPERTY, UM, THIS PROPERTY AS ONE OF THE OLDER IN TOWN. AND IT WOULD GREATLY BENEFIT FROM, UH, THE IMPROVEMENTS THAT ARE PROPOSED BY TOASTED YOLK. SO FIRST ISSUE WE'LL DISCUSS IS PARKING. UH, THERE IS, UH, 116, UH, PARKING SPACES REQUIRED ON SITE, UH, BASED ON THE EXISTING USES. AND THEY'RE ONLY ABLE TO PROVIDE FOR 96 SPACES. THE, THE PRIMARY REASON FOR THAT IS ONE, IT, IT WAS ALREADY SHORT PARKING, BUT TWO THE INTRODUCTION OF THE PATIO, BUT MORE IMPORTANTLY, THE INTRODUCTION OF A SUBSTANTIAL AMOUNT OF LANDSCAPE IMPROVEMENTS TO MAKE IT A, A MORE APPEALING STREET SCAPE AND MORE APPEALING PARKING LOT, UH, RESULTED IN THE LOSS OF PARKING. OTHER CONSIDERATIONS, SUCH AS IMPROVED FIRE LANES ALSO HAS IMPACTS THERE WITH THAT BEING SAID WHILE IT IS TECHNICALLY UNDER PARTED, WE DO FEEL THAT THE MIX OF USES A BRUNCH SPOT THAT HAS, UM, A MORE DOMINANT USE DURING THE MORNING AND AFTERNOONS AND THEN A, A RESTAURANT THAT IS GONNA BE MORE SKEWED TOWARDS AFTERNOON AND EVENINGS. AND THEN, UH, THE FEDEX RETAIL SPACE, WHICH WILL HAVE A, UH, A GENERALLY A LIGHTER USE, BUT SPRINKLED THROUGHOUT THE DAY, WE FEEL THAT THOSE ARE VERY COMPATIBLE LAND USES FROM A PARKING STANDPOINT. SO IT'S NOT LIKE HAVING THREE RESTAURANTS WHERE EVERYONE'S GONNA BE COMING AT PEAK HOUR. THE OTHER CONSIDERATION THERE IS THAT THE TOWN IS, UH, IN THE PROCESS OF ADOPTING NEW DEVELOPMENT CODES. UM, SO WITH THAT, UH, THE APPLICANT HAD TO ACCOUNT FOR, UH, THIS DRIVE THROUGH RESTAURANT, THE FUTURE RETAIL BUILDING AND OFFICE BUILDING ON THE EAST SIDE OF THE SITE, AND THEN ALSO HUMS TO MEET THE PARKING REQUIREMENTS, MOVING FORWARD FOR ALL THAT EXISTING FLOOR AREA, HUM DINKS WILL HAVE TO LOSE ITS CAPACITY TO BE A RESTAURANT IN THE FUTURE. SO IT WOULD HAVE TO BE A RETAIL BUILDING, OR IT COULD BE A RESTAURANT WITH A SMALLER FOOTPRINTS.
