UH, JENNIFER DEDRICK PLANNING AND DEVELOPMENT MANAGER, UH, AS MENTIONED THE CASE BEFORE YOU IS TO CONSIDER A SPECIAL USE PERMIT FOR A NEW TENANT WITHIN THE PRESTON WOOD SHOPPING CENTER.

UH, THE PROPERTY IS LOCATED AT 52 94 BELTLINE ROAD IN SUITE ONE 10.

UH, THE TENANT LAGO LAND KIND CAFE IS REQUESTING A SPECIAL USE PERMIT IN ORDER TO, UH, TO OPERATE A CAFE WITHIN, UM, WITHIN THAT TENANT SPACE.

AS I MENTIONED IN THE WORK SESSION, THIS, UH, RESTAURANT HAS OCCUPIED THIS SPACE, UM, AND IS OPERATING UNDER A TEMPORARY CERTIFICATE OF OCCUPANCY.

AND I'LL COVER A LITTLE BIT OF THE BACKSTORY ON THAT.

UM, BUT FIRST I WANT TO JUST MENTION, UM, THE HISTORY OF THE SITE.

AS MANY OF YOU, UM, ARE AWARE THAT THE PROPERTY UNDERWENT A REZONING BACK IN 2019 AND ON IN JUNE, UH, TO REZONE THE PROPERTY TO A PLAN DEVELOPMENT DISTRICT IN ORDER TO FACILITATE, UH, THE RE-INVESTMENT OF THE SITE AND IMPROVE THE, UH, EXTERIOR BUILDING FACADES AND, AND MAKE IMPROVEMENTS TO THE PEDESTRIAN CONNECTIVITY WITHIN THE PROPERTY AND ADDING LANDSCAPING, UM, THAT WE SEE TODAY, UH, AND NOW THE, UH, TENANT LAW KIND CAFE IS REQUESTING, UH, TO OPERATE WITHIN THE, UH, WITHIN A BUILDING D WHICH IS, UM, WHICH ALSO, UH, CONTAINS MENDOCINO FARMS AND CUT UP WHOLE HEALTH, UH, WITHIN THAT BUILDING.

SO THEY ARE REQUESTING A SPECIAL USE PERMIT IN ORDER TO, UH, FULLY, UH, OPERATE, UM, AS A RESTAURANT WITHIN THAT SPACE.

UM, AS I MENTIONED, THEY ARE CURRENTLY OPERATING UNDER A TEMPORARY CERTIFICATE OF OCCUPANCY, UH, DUE TO COMMUNICATIONS, UH, WITH THE APPLICANTS.

IT WAS STAFF'S INITIAL UNDERSTANDING THAT THERE WOULD BE NO SEATING WITHIN THE SPACE OR THE

OUTDOOR SEATING AREA THAT WOULD BE SPECIFIC TO THE CAFE, UH, DURING THE CERTIFICATE OF OCCUPANCY INSPECTION.

THAT IS WHEN STAFF, UM, FIRST LEARNED OF THE SEATING WITHIN THE CAFE AND DUE TO THE DEFINITION OF RESTAURANT, THAT IS WHAT TRIGGERED THE SPECIAL USE PERMIT, UH, THEREFORE, UM, STAFF IN ORDER TO, TO ALLOW THEM TO OPEN AND OPERATE.

WE, UM, DID ISSUE A TEMPORARY CERTIFICATE OF OCCUPANCY WITH A CONDITION THEY ESPECIALLY USE PERMIT BE ISSUED, UH, FOR, AT THAT BUSINESS.

UM, ON YOUR SCREEN, IS THESE A FLOOR PLAN FOR THE USE? UM, THE INTERIOR SPACE IS, UH, 1,295 SQUARE FEET OF INTERIOR SPACE, PRIMARILY, UM, THEIR SERVICE AREA, THEIR SERVICE COUNTER, WHERE THEY, UM, MAKE THE COFFEES AND THE BACK OF HOUSE AREA IS WHERE, UM, THE PRODUCTS ARE STORED WITHIN THE STOREFRONT, WHICH IS, UH, NORTH OF THIS PLAN.

UM, THIS TENANT ALSO HAS SOME OUTDOOR SEATING FOR EIGHT, UH, PATRONS, JUST OUTSIDE THAT STOREFRONT AREA THAT'S DESIGNATED FOR THEIR SUITE.

UM, I DO WANT TO NOTE THAT THERE IS A COMMON AREA JUST OUTSIDE OF THEIR SPACE THAT'S, UH, THAT SERVES THE LARGER SHOPPING CENTER.

SO THAT IS A COMMON AREA THAT HAS SEATING, UH, FOR, UM, FOR FOLKS THAT, UH, VISIT THE PRECEDENT WOULD SHOPPING CENTER.

UM, THE APPLICANT DID NOT, UM, I'M SORRY, ON YOUR SCREEN IS THE, UH, BUILDING ELEVATIONS FOR THE SPACE? UM, IT IS JUST A SMALL FREE-STANDING, UH, PORTION OF BUILDING D.

UM, IT IS TO THE EAST OF THE LARGER TWO STORY BUILDING.

AS YOU CAN SEE, THERE ARE NOT MAKE, DID NOT MAKE ANY MODIFICATIONS TO THE EXTERIOR OF THE BUILDING WITH THE EXCEPTION OF, OF SIGNAGE ON THE STORE, ABOVE THE STOREFRONT.

UM, AS IT RELATES TO PARKING, UH, THIS PD REQUIRES, UH, ADOPTED, UH, PARKING REQUIREMENT OF ONE SPACE FOR EVERY 200 SQUARE FEET.

AND THAT'S FOR ALL USES WITHIN THAT SHOPPING CENTER.

UH, THIS SPECIFIC USE, UM, OBVIOUSLY WAS ACCOUNTED FOR WHEN THAT PLAN DEVELOPMENT DISTRICT WAS ADOPTED.

UH, TH THE SHOPPING CENTER DOES HAVE AN EXCESS OF PARKING THAT'S COMPLYING WITH THE PLAN DEVELOPMENT DISTRICT, UH, ORDINANCE, AS IT RELATES TO LANDSCAPING AND OPEN SPACE.

AS I MENTIONED WITH THE 2019, UH, REZONING, THE APPLICANT DID MAKE EXTENSIVE MODIFICATIONS TO THE LANDSCAPING ON THE SITE, UM, AND IS IN COMPLIANCE WITH THE ZONING ORDINANCE.

AND THIS, THIS TENANT WILL NOT BE MAKING ANY ADDITIONAL IMPROVEMENTS TO, UH, LANDSCAPING OR OPEN SPACE, UH, WITH THAT, UM, GIVEN THAT THIS IS A PUBLIC HEARING, STAFF DID SEND OUT THE PROPERTY OWNER NOTIFICATIONS TO THE SURROUNDING PROPERTY OWNERS.

UH, THERE WERE 18, UH, RECIPIENTS OF THOSE LETTERS.

UH, TODAY WE HAVE NOT RECEIVED ANY RESPONSE, UM, OR THIS REQUEST STAFF IS RECOMMENDING APPROVAL FOR THE SPECIAL USE PERMIT, GIVEN THAT THIS, UH, BUSINESS IS, UH, COMPATIBLE WITH THE EXISTING, UH, BUSINESSES THAT ARE WITHIN THE PRESTON WOOD PLACE SHOPPING CENTER, AND IS, IS A GOOD ADDITION TO, UH, THE TOWN OF ADDISON.

UM, GIVEN THAT THIS PLANNED DEVELOPMENT DISTRICT HAS A, IS BASED ON THE LOCAL RETAIL, UH, ZONING DISTRICT AND AMENDMENT IS NECESSARY IN ORDER TO, FOR MEDICAL CLINIC.

SO WHAT MEDICAL, AS I MENTIONED IS A MEMBERSHIP-BASED PRIMARY CARE PRACTICE.

UM, THEY TEND TO LOCATE IN

VERY, UH, VIBRANT AND URBAN TYPE, UH, LOCATIONS IN LARGE METROPOLITAN REGIONS THROUGHOUT THE COUNTRY.

UM, I KNOW THAT THEY DO HAVE PLANS TO OPEN SEVERAL IN THE DALLAS AREA WITH ADDISON BEING ONE OF THOSE.

UM, AS I MENTIONED, BECAUSE OF THE WAY OUR ZONING ORDINANCE DEFINES MEDICAL OFFICE, UH, WHICH IS AN OFFICE FOR THE EXAMINATION AND TREATMENT ABOUT PATIENTS, INCLUDING DENTAL EXAMINATION AND TREATMENTS, UH, THIS USE IS NOT PERMITTED UNDER THE CURRENT, UH, ORDINANCE GIVEN THE LOCAL RETAIL BASED ZONING.

UM, SO AGAIN, UM, THE CURRENT ORDINANCE BASED ON LOCAL RETAIL ZONING DISTRICT, THE ONLY MODIFICATION THAT IS, THAT WAS ADOPTED AS PART OF THAT ORDINANCE WAS THE MIXED USE PARKING RATIO OF ONE TO 200.

UM, THE PROPOSED AMENDMENT WOULD BE TO MODIFY OR ADD AN ADDITIONAL, UH, STANDARD, WHICH IS TO ALLOW FOR MEDICAL OFFICE AS A PERMITTED USE THE ADOPTED, UH, PLANS THAT WERE, THAT WERE ADOPTED AS PART OF THE ORIGINAL ORDINANCE.

1922 WOULD BE CARRIED OVER WITH THIS AMENDMENT IF IT WERE TO BE APPROVED.

SO I DIDN'T WANT TO MAKE THAT, UH, NO, UH, WHEN STAFF WAS LOOKING AT, UH, OR CONSIDERING THIS AMENDMENT TO SOMETHING THAT WE OBVIOUSLY WANT TO CONSIDER IS WHAT THE INTENTION OF LOCAL RETAIL IS.

AND SO LOCAL RETAIL IS INTENDED TO BE A MIX OF, UH, RETAIL OFFICE TYPE FACILITIES OR BUSINESSES THAT SERVE, UH, THE RESIDENTS IN THE COMMUNITY AND ALSO THE LARGER REGIONS SURROUNDING IT THERE TOO.

THE ZONING DISTRICT IS TYPICALLY FOUND ALONG YOUR MAJOR MATERIALS FOR EASE OF ACCESS, UM, AND ARE ADJACENT TO, UM, OR OTHER COMMERCIAL TYPE FACILITIES OR TYPE ZONING DISTRICTS.

UM, THE, UM, LOCAL RETAIL DISTRICT, UM, DOES ALLOW FOR A RANGE OF USES.

I I'VE PROVIDED A FEW ON YOUR SCREEN THAT CAN INCLUDE YOUR, YOUR, YOUR STANDARD RETAIL SALES, UM, OFFICES, PERSONAL SERVICE SHOPS, SUCH AS A BARBERSHOP OR A BEAUTY SALON.

UH, WELL, UM, ALSO WHEN WE WERE EVALUATING THIS AMENDMENT, WE WANTED TO LOOK AT OUR LONG RANGE POLICIES.

UM, AND ONE OF THOSE IS OUR, UH, COMPREHENSIVE PLAN, UH, THAT THE TOWN'S COMPREHENSIVE PLAN DOES MAKE NO OF, UM, EVALUATING OUR, UH, RETAIL FACILITIES.

AND IN ORDER TO REINVEST INTO THOSE, UH, SHOPPING CENTERS AND THOSE RETAIL LOCATIONS WITH, THROUGHOUT THE TOWN, UM, WE DO HAVE TO MAINTAIN IT A HEALTHY MIX OF TENANTS WITHIN THOSE, UM, WITHIN, WITHIN THOSE SHOPPING CENTERS OR WITHIN THOSE RETAIL REGIONS.

AND THAT EASEMENT IS PARTIALLY LOCATED IN A TOWN PLAN'S TOWN RIGHT AWAY, THAT WOULD BE ESTABLISHED BY THIS PLANT.

SO, UH, THE APPLICANT HAS ADDITIONAL WORK, UM, WITH STAFF THAT NEEDS TO OCCUR IN ORDER TO DE-CONFLICT ANY ISSUES WITH THAT ACTION, UH, IN ORDER FOR THE TOWN, UH, TO RECOMMEND APPROVAL OF THIS PLAN.

UM, SO WITH THAT STATE LAW DOES ALLOW THE APPLICANT IN LIEU OF HAVING THEIR PLAT, THE DENIED.

THEY HAVE A ONE-TIME OPTION TO REQUEST A 30 DAY EXTENSION TO THE REVIEW OF THEIR PLAT APPLICATION.

SO THE APPLICANT HAS MADE THAT REQUEST TO THE COMMISSION AND IF APPROVED, UH, THEY HAVE, AND WOULD USE THAT TIME TO, UH, WORK WITH STAFF, TO RESOLVE ISSUES RELATED TO THE EASEMENT AND THE RIGHT OF WAY.

SO STAFF DOES RECOMMEND APPROVAL OF THE REQUEST TO EXTEND THE PLAT REVIEW PROCESS BY 30 DAYS, UH, PLACING THIS PLAT ON YOUR JANUARY PLANNINGS ON THE COMMISSION AGENDA.
