SO WE DID HAVE THREE CASES THAT WERE ACTIVE ALONE BY A COMMISSION AT YOUR NOVEMBER MEETING.
AND THEN ALSO WE HAD TO, UM, RE HERE A CASE ON DECEMBER 7TH DUE TO SOME PROCEDURAL ISSUES.
UH, THOSE CASES ALL MOVE FORWARD, UH, TO CITY COUNCIL AT THE DECEMBER 14TH, LESLIE JOHNSON MEETING, UH, ALL THREE CASES WERE APPROVED.
UH, ONE CASE HAD A CONDITION, UH, APPLIED TO IT.
UH, THAT WAS THE TIERRA IN COMPATA, UM, UH, UH, DAYCARE, UH, THAT WE HEARD, UH, LOCATED OFF OF, UH, MARSHALL LANE NORTH OF SPRING VALLEY.
UM, A CONDITION WAS REQUESTED ADDRESSING, UM, THAT PRIOR TO SIO, UH, THEY PROVIDE A, UM, UH, TRAFFIC OPERATIONS PLAN, UH, FOR THE PROJECT AND SHARED THAT THERE IS NO ISSUES WITH CIRCULATION ONSITE AND OFFSITE.
UH, THE APPLICANT AT THAT TIME DID CONFIRM THAT THEIR BUSINESS MODEL WAS FOR, UM, UH, PARENTS TO ALWAYS PARK, UM, IN ORDER TO FACILITATE DROP OFF.
SO THERE WILL NOT BE ANY, UH, DROP OFF LINE, UH, WITHIN THE SITE.

SO THIS IS, UH, ONE OF THE THINGS THAT YOU MAY RECALL FROM OUR DISCUSSION PLANNING, ZONING COMMISSION, UH, PROCEDURES IS THAT THE COMMISSION, UH, EVERY YEAR IN JANUARY, NOT ONLY HAS OUR REGULAR MEETING, WHERE WE CARRY OUT THE REGULAR BUSINESS BEFORE THE COMMISSION, BUT WE ALSO HAVE WHAT WE CALL AN ORGANIZATIONAL MEETING.
UM, SO THAT, UM, IT IS AN OPPORTUNITY FOR US TO ADDRESS SEVERAL THINGS THAT RELATE TO THE BUSINESS AND THE COMMISSION.
UM, MOST PROMINENTLY THAT'S APPOINTMENT OF THE CHAIR OR DISCUSSION OF APPOINTMENT OF THE CHAIR AND VICE CHAIR, UH, FORMAL ACTION WILL NEED TO OCCUR, UH, AT THE JANUARY MEETING.
UM, SO, UM, WITH THAT AS WELL, UH, OUR CHAIR MS. RESNICK, UH, WILL HAVE SOME NEWS FOR US THAT SHE'LL BE LEAVING THE COMMISSION AFTER THIS MEETING.
SO WE DO ALSO HAVE A NEW MEMBER THAT WILL BE ONBOARDING, UM, BEGINNING WITH THAT MEETING AS WELL.
I WE'LL DO SOME STUFF WITH STAFF WITH THAT NEW MEMBER.
UM, BUT ALSO THAT WILL BE, UH, YOUR FIRST OPPORTUNITY TO BEGIN WORKING WITH THAT PERSON.
UH, SHE HAS, UH, VOLUNTEERED ON, UH, SEVERAL COMMITTEES, UM, UH, INFORMAL AND FORMAL, UM, AT THE TOWN.
AND SHE'S TALKED TO HER TODAY AND SHE'S EXCITED TO JOIN THE GROUP AND, UH, LEND HER SKILLSETS TO THE WORK OF THE COMMISSION.

AND BASED ON HOW OUR ZONING ORDINANCES DEFINED RESTAURANT, IT DID NOT TRIGGER THIS SPECIAL USE PERMIT.
UM, WITH THE BUILDING PERMIT REVIEW, WE DIDN'T SEE ANY SEATING PROPOSED WITHIN THE TENANT SPACE, WHICH IS ALSO ANOTHER, UM, UH, KEY THAT WE LOOK AT WHENEVER WE'RE LOOKING AT NEW RESTAURANTS, OCCUPYING SPACES AND IN THE TOWN OF MADISON, UM, WE LATER FOUND DURING THE, UH, CERTIFICATE OF OCCUPANCY INSPECTIONS THAT THEY DID IN FACT INCLUDE SEATING WITHIN THE ESTABLISHMENT AND ALSO, UM, OUTDOOR SEATING WITHIN THEIR PATIO AREA.
UM, HENCE WHY WE'RE HEARING THIS CASE TODAY, UH, FOR THE SPECIALTIES PER REQUEST, UM, IN AN EFFORT TO ALLOW THEM TO OPERATE AND NOT REQUIRE THEM TO REMOVE THE SEATING.
UM, WE DID ISSUE THE TEMPORARY CERTIFICATE OF OCCUPANCY FOR THEM TO OPEN AND OPERATE, UM, WITH THE CONDITION THAT THE SPECIAL PERMIT BE APPROVED.
UM, AND IN CONSIDERED TODAY, THE ONLY COMMENT THAT I HAVE IS THAT I WENT BY THERE SATURDAY, AND THEN I WENT BY THERE AGAIN TODAY.
THERE'S A LOT OF PEOPLE, THERE'S A LOT OF KIDS THERE AND THERE'S A LOT OF TRAFFIC THAT'S IN THAT PARKING LOT.
SO, UM, I UNDERSTAND SCHOOL'S OUT.

UM, THEREFORE THEY ARE BRINGING FORWARD A REQUEST TO AMEND THE PLAN DEVELOPMENT DISTRICT IN ORDER TO ALLOW MEDICAL OFFICE AS A PERMITTED USE WITHIN THAT PLAN DEVELOPMENT DISTRICT.
UH, THE ASSOCIATED PLANS THAT WERE APPROVED BACK IN 2019 WILL NOT BE MODIFIED.
