Case 1841-SUP/14854 Montfort Drive (TK's Place). ]

A VERY SHORT THAT DID THE TODAY IS TO HOLD A PUBLIC HEARING, PRESENT DISCUSSING CONSIDER ACTION ON A RECOMMENDATION REGARDING AN ORDINANCE FOR PROPERTY LOCATED AT 1 4 8 5 4 MONFORT DRIVE.

CURRENTLY ZONED COLLEGE DEVELOPMENT, TB, YOUR ORDINANCE NUMBER OH 8 4 0 7 6 FOR A SPECIAL USE PERMIT.

AS SHE GAVE TO ALLOW A RESTAURANT WITH THE SMELL OF ALCOHOLIC BEVERAGES FOR ON PREMISES CONSUMPTION.

MAYBE PLEASE HAVE THE STAFF REPORT TO THANK YOU.

UM, COULD YOU MEAN COMMISSIONED, UM, THANK YOU AGAIN FOR BEING HERE.

UH, SO WE DID HEAR THIS ITEM AT OUR LAST MEETING ON NOVEMBER 16TH AND, UM, WE'RE SHOWING WE DID FAIL TO NOTIFY THE COMMISSION OF A PUBLIC HEARING THAT NEEDED TO BE HELD, UM, BEFORE ACTION TO BE TAKEN.

SO, UH, WE WILL BE RECONSIDERING THIS ITEM.

UM, I'LL GO THROUGH THE INFORMATION ONCE MORE, UM, AND, UH, ALLOW FOR DISCUSSION AND HOLD THAT PUBLIC HEARING BEFORE WE CONSIDER, UM, ACTION.

SO THIS SPECIAL USE OR A SPECIAL USE PERMIT REQUEST IS FOR THE PROPERTY LEVEL 1, 4 8 5, 4 A MONTH FOR A DRIVE.

UM, THE REQUEST IS FOR A SPECIAL USE PERMIT FOR A RESTAURANT WITH THE SALE OF ALCOHOLIC BEVERAGES FOR ON-SITE ON-PREMISE CONSUMPTION, UM, THE PROPERTY HERE.

UM, SOME OF YOU MAY KNOW THAT IT WAS OCCUPIED PREVIOUSLY BY PUBLIC SCHOOL, 9 7 2.

UM, IT, IT, ISN'T A PLANNED DEVELOPMENT DISTRICT, UM, AND DOES HAVE CURRENTLY TO A SPECIAL USE PERMIT ORDINANCES THAT ARE SUBJECT TO THE PROPERTY.

UM, IN 2015 WHERE THE, WHEN THE BUILDING WAS OCCUPIED BY A PUBLIC SCHOOL, TWO AND FOUR, AND DID UNDERGO EXTENSIVE RENOVATION, WHICH IS WHAT WE SEE TODAY.

UM, AND NOW TKS PLACE IS PROPOSING TO OCCUPY THE BUILDING, MAKING MINOR IMPROVEMENTS TO THE INTERIOR OF THE SPACE AND MAINTAINING, UM, THE EXTERIOR IMPROVEMENTS.

UH, THIS RESTAURANT CONCEPT IS UNIQUE AND THAT, AND THAT IT DOES PROVIDE YOUR TYPICAL, UM, UH, RESTAURANT, UH, CONCEPT.

HOWEVER, THEY ARE INTEGRATING A COMEDY ASPECT OF IT, WHERE THEY WILL HOLD, UH, COMEDY EVENTS AS PART OF THEIR DINING EXPERIENCE.

UM, THIS BUILDING IS A SPLIT-LEVEL BUILDING.

THE FIRST FLOOR IS PROPOSED TO BE THE PRIMARY DINING AREA FROM EVEN 25 PATRONS.

UH, THE BASEMENT LEVEL IS, UM, PROPOSED TO BE USED FOR PRIVATE EVENTS, UH, FOR, UM, COMPANY EVENTS OR THAT SORT OF DINING EXPERIENCE.

UM, AND THAT WILL BE 4 73 PATRONS THAT BASING ON LEVEL WILL, UM, INCLUDE THE ADDITION OF ANY BAR AREA.

AND, UM, WE'LL BE PRIMARILY USED FOR, AS I MENTIONED, THE PRIVATE DINING AND FOR STORAGE FOR THE RESTAURANT.

UM, THERE IS ALSO AN OUTDOOR PATIO.

UM, THAT'S EXISTING AND THAT'S, UH, A LITTLE OVER 1800 SQUARE FEET AND IT'S PROPOSED TO BE USED FOR THE PRIMARY DINING AREA AS WELL.

UM, AS FOR PARKING AT TEACAKES PLACES REQUIRED TO PROVIDE 126 PARKING SPACES BASED ON THE PARKING REQUIREMENT, UM, IN THE ZONING ORDINANCE FOR RESTAURANT.

UH, AND THEN THE SITE, HOWEVER, UM, IS THIS, THIS RESTAURANT SITE IS PART OF A LARGER, UH, LOT, WHICH INCLUDES THE PERSON WHO WOULD OFFICE AND THE BLUE MESA THAT'S TO THE NORTH OF THIS BUILDING.

THEREFORE, THE SITE IN ITSELF HAS REQUIRED A TOTAL OF 461 PARKING SPACES, AND THERE ARE ONLY 460 PARKING SPACES, UM, THERE, SO THERE'S A ONE SPACE DEFICIENCY.

IT WAS A PUBLIC SCHOOL, 2 1 4, THE COMMISSION

DID GRANT A SPECIAL USE PERMIT, UM, WITH THAT ONE PARKING SPACE DEFICIENCY DUE TO THE TENANT MIX, UH, WITHIN THE SITE AND THE VACANCY THAT, UH, THE OFFICE BUILDING DOES CURRENTLY HAVE.

SO, UM, I WILL POINT THAT OUT AND, AND AS MENTIONED, THE STAFF REPORT, UH, STAFF IS RECOMMENDING THAT THAT SAME, UM, VERSION BE GRANTED TO THE NEW, UH, RESTAURANT USE, UM, AS FOR LANDSCAPING AT THE PROPERTY, UH, DOES THE, THE APPLICANT IS PROPOSING TO MAINTAIN THE EXISTING LANDSCAPING, SEPARATE REVIEWED, UM, A LANDSCAPE PLAN AS SHOWN ON YOUR SCREEN.

AND IT'S GENERALLY IN COMPLIANCE WITH THE LANDSCAPE ORDINANCE.

UH, THE PROPERTY OWNER HAS COMMITTED TO REPLACING ANY DEAD OR DAMAGED LANDSCAPING ON THE SITE AND ALSO, UH, REESTABLISHING GROUND COVER ALONG THE MUNFORD, UM, ARE THE TOWN'S TRANSPORTATION MASTER PLAN, UH, RECOMMEND OR, UH, A SIDEWALK ALONG LONG FOR A DRIVE THAT SIDEWALK WILL BE INSTALLED AT THE TIME THAT THIS SITE IS REDEVELOPED OR WHEN THE CITY DOES A CAPITAL PROJECT ALONG MUMFORD DRIVE FOR THAT SIDEWALK.

UM, AND AS MENTIONED PREVIOUSLY, THE APPLICANT DOES NOT INTEND TO MAKE ANY MODIFICATIONS TO THE EXTERIOR OF THE BUILDING.

WITH THE EXCEPTION OF BUILDING SIGNAGE, UH, STAFF DID SEND OUT MEDIA NOTIFICATIONS FOR THIS MEETING.

UH, WE SENT OUT 13 LETTERS TO THE SURROUNDING PROPERTY OWNERS WITHIN 200 FEET, UH, TO DATE.

I HAVE NOT RECEIVED ANY LETTERS OR RESPONSES IN SUPPORT OR OPPOSITION TO THIS REQUEST.

UM, THE RECOMMENDATION IS A BIT DIFFERENT THAN, UH, PREVIOUSLY PRESENTED, UM, BASED ON THE DISCUSSION THAT WE HAD ON NOVEMBER 16, UH, STAFF DID MAKE THAT MODIFICATION.

SO THE REQUEST IS NOW, UH, APPROVAL OF THE SPECIAL USE PERMIT, UH, WITH A CONDITION THAT NO TERMS ARE GRABBING THE PICTURES RELATED TO, UH, ALCOHOLIC BEVERAGES USED FOR EXTERIOR SIGNAGE AND THAT THE EXISTING SEP 15 DASH 0 1 4, UH, BE REPEALED UPON ISSUANCE OF THEIR CERTIFICATE OF OCCUPANCY FOR THIS, UH, NEW RESTAURANT.

UM, WITH THAT, I'LL OPEN IT UP FOR QUESTIONS AND THE APPLICANT IS HERE AS WELL.

AND, UH, MADAM CHAIR, BEFORE WE GET INTO THE PUBLIC HEARING, IF I COULD MAKE A COUPLE BRIEF COMMENTS AT THE LAST MEETING, WE DO RECALL, UH, WE HAD A DISCUSSION, UH, WITH REGARDS TO LANDSCAPE COMPLIANCE, AND THERE WAS SOME CONCERN WITH REGARDS TO HOUSE STAFF APPLY THE LANDSCAPE CODE TO THIS PARTICULAR PROJECT.

JENNIFER, IF YOU COULD PULL UP THE AERIAL IMAGERY.

SO IF YOU GO TO THIS SITE AND YOU'VE PROBABLY SEEN THIS AS WELL, WHEN YOU DRIVE BY AT THE FRONTAGE, SO ADJACENT TO THIS BUILDING, AS WELL AS BLUE MESA, VERY GOOD LANDSCAPE COVERAGE, THERE'S MATURE TREES, LANDSCAPING, PARKING LOTS, THERE'S IOWANS.

IT DEFINITELY MEETS THE INTENT.

UM, KEEP IN MIND WITH THIS SITE.

IT WAS A ZONE PD IN 1984.

UH, THAT WAS TWO YEARS AFTER I WAS BORN.

SO, UH, THERE'S, UH, UH, THERE'S SOME HISTORY HERE, UM, WHERE THERE SOME MINOR ISSUE AT THE FRONT EDGE IS REALLY THE WIDTH OF THE PARKWAY.

UH, THE TALENT'S CODE REQUIRES 20 FEET.

UH, IT'S ABOUT 18 FEET LOOKING AT IT OFF OF GOOGLE.

UH, IF YOU WERE TO CHANGE THAT YOU'D BE IMPACTING THE FRONT PARKING.

SO THAT'S A GOOD EXISTING CONDITION THAT I THINK MEETS THE INTENT OF THE LANDSCAPE CODE, WHERE THE OVERALL SITE KIND OF GETS AWAY FROM THE LANDSCAPE CODE IS REALLY, UM, AT THE SURFACE PARKING LOT, UM, UH, TO THE NORTHEAST OF BLUE MESA, UH, THAT PARKING LOT.

YOU'LL SEE THAT IT IS REALLY DOES NOT HAVE A LANDSCAPE PLANTINGS.

IT DOESN'T HAVE TREES.

THAT'S A CONDITION THAT'S BEEN THERE FOR THE LONG TERM.

UH, AERIAL IMAGERY THAT I'VE LOOKED AT, UM, 20 YEARS AGO IS THE LAST CLEAR IMAGE I CAN FIND.

UH, THERE WERE NO TREATS THERE.

SO IT'S VERY LIKELY THAT WHEN THIS WAS INITIALLY ZONED, UM, THAT CONDITION WAS APPROVED.

DOES THAT MEAN WE KEEP THAT CONDITION MOVING FORWARD? NOT NECESSARILY, BUT I THINK PROBABLY A BETTER NEXUS MAY BE PERHAPS WHEN THE BLUE MESA PROPERTY, IF THERE IS CHANGE THAT OCCURS THERE, OR PROBABLY MORE LIKELY THE OFFICE PROPERTY, IT'S REALLY IN FRONT OF THAT, UM, WHERE THAT PARKING AREA IS AND WHERE WE WOULD NEED TO PLANT TREES OR THE REALLY THE, THE PROPERTY OWNER WOULD NEED TO PLANT TREES TO BRING THAT UP TO CODE IS ANYWHERE FROM TWO TO 300 FEET FROM THIS BUILDING.

SO, UM, GIVEN THAT YOU'D ALSO HAVE TO INSTALL IRRIGATION, CAUSE IT'S, IT'S FULLY PAID OVER.

UM, THIS PROPERTY MAY NOT BE THE BEST OPPORTUNITY, BUT IT'S DEFINITELY SOMETHING THAT WE NEED TO LOOK AT IN THE FUTURE.

UH, CAUSE I DO AGREE THAT IT'S IMPORTANT THAT, UH,

WE MEET THE INTENT OF OUR CODES AS BEST POSSIBLE, BUT KEEPING IN MIND THAT IT HAS A STRONG NEXUS TO THE PROPERTY AND THE AREA OF THE PROPERTY THAT'S MOST IMPACTED ANY ADDITIONAL QUESTIONS ON THAT.
