UH, THE PROPERTY IS LOCATED AT 14 8 5 4 MONTFORT DRIVE. UM, JUST, UH, APPROXIMATELY, UH, 1200 FEET SOUTH OF BELTLINE ROAD. UM, TH THE BUILDING ITSELF AS PART OF A LARGER DEVELOPMENT, PART OF THE PRESTON WOOD PAWNED OFFICE, UH, TO THE EAST AND BLUE MESA RESTAURANT IN THE NORTH ON YOUR SCREEN IS THAT AREA IN THE, IN THE YELLOW DOTS SIGNIFIES WHERE THIS BUILDING IS. SO THE REQUEST BEFORE YOU TODAY IS TO CONSIDER A SPECIAL USE PERMIT FOR A RESTAURANT USE, UM, WITH THE SALE OF ALCOHOLIC BEVERAGES FOR ON-PREMISE CONSUMPTION. UH, THIS SITE, UM, WAS INITIALLY REZONED IN 1984 FROM, UH, LOCAL RETAIL TO THE CURRENT PLAN DEVELOPMENT DISTRICT. AND AT THAT SAME TIME CHOOSE SPECIAL USE PERMITS WERE APPROVED FOR RESTAURANT USE, WHICH IS FOR THE SUBJECT BUILDING AND ALSO THE, UH, EXISTING BLUE MESA BUILDING TO THE NORTH OF THE SITE. UM, AND THOSE WERE APPROVED A CONTIGUOUS VERB AT THE SAME TIME THAT THE ZONING WAS APPROVED, UH, BETWEEN THE CONSTRUCTION IN 1984 TO 2014. THIS BUILDING HAS BEEN OCCUPIED BY SEVERAL RESTAURANTS. UM, THE MOST KNOWN WAS MI POC, UH, RESTAURANT, UM, WHICH VACATED, UM, AND IN LATE, UH, 2013, I BELIEVE IT WAS WHEN THEY VACATED THE BUILDING. UM, IN 2015, THE BUILDING WENT UNDERWENT SIGNIFICANT RENOVATION, UH, WITH THE APPROVAL OF AN SEP FOR PUBLIC SCHOOL, 1972, WHICH IS WHAT WE SEE TODAY WITH A SIGNIFICANT IMPROVEMENTS TO THE EXTERIOR AND THE LANDSCAPING IMPROVEMENTS, AND ALSO THE PATIO, UM, UM, THAT OVERLOOKS UPON ALL OF THAT WAS APPROVED IN 2015, WITH THE APPROVAL OF SUV I STARTED TODAY, UM, AS I MENTIONED, THE WORK SESSION PUBLIC SCHOOL, 9, 7, 2 HAS MADE IT IN THE BUILDING. UM, THEY LEFT IN OCTOBER, I BELIEVE IS WHEN THEY CLOSED THEIR DOORS. UH, TK PLAYS, UM, IS A NEW RESTAURANT CONCEPT THAT'S PROPOSING TO OCCUPY THE BUILDING, UH, KEEPING THE RESTAURANT, THE BUILDING IMPROVEMENTS AS IS, UM, THIS RESTAURANT CONCEPT IS UNIQUE AS THE OWNERS, UM, UH, HAVE TWO PASSIONS, ONE BEING HOSPITALITY AND RESTAURANT TOURS, AND ALSO, UH, BEING IN THE COMEDY BUSINESS. UM, KARA MADSEN, SHE HAS DONE STANDUP COMEDY AND AMERICA'S GOT TALENT AND ALSO COMEDY CENTRAL. SO THEY HAVE EXPERIENCE IN THAT INDUSTRY AND ARE NOW VENTURING INTO OPENING A RESTAURANT. SO COUPLING THOSE TWO PASSIONS, UM, TO OPEN TKS PLACE HERE IN HUDSON, UM, ON YOUR SCREEN IS THE PROPOSED FOUR PLAN. UM, AS I MENTIONED, NO SIGNIFICANT IMPROVEMENTS TO THE INTERIOR SPACE. UM, THERE WILL BE SOME DEMISING WALLS THAT WILL BE ADDED, UH, WITH, TO [00:05:01] BREAK UP THE SPACE, UM, DUE TO THE CONCEPT OF THE COMEDY THAT, THAT, THAT WILL BE INTEGRATED WITH THE RESTAURANT. UM, SO AS YOU CAN SEE, UM, THIS BUILDING IS A SPLIT-LEVEL BUILDING AND HAS, UH, AN EXISTING PATIO, UM, ON THAT GROUND FLOOR. THE FIRST FLOOR IS A LITTLE OVER 7,500 SQUARE FEET IN SIZE AND AN OUTDOOR PATIO OVER 800 SQUARE FEET. AND IT WILL BE USED PRIMARILY FOR DINING FOR APPROXIMATELY 125 PATRONS. UM, THE BASEMENT LEVEL IS ABOUT 70 A 2,700 SQUARE FEET IN SIZE. THE PREVIOUS TENANT USED THIS AREA PRIMARILY FOR STORAGE, UH, TEEKAY'S PLACE, UH, IS PROPOSING TO USE THIS MORE AS ADDITIONAL DINING AREA FOR PRIVATE EVENTS AND ALSO SOME STORAGE. THERE'LL BE OTHER PROPOSING TO ADD A SMALLER BAR AREA IN THE BASEMENT LEVEL THAT WILL SUPPORT THOSE PRIVATE, UM, WHAT, UH, THAT WE'LL BOOK THOSE SPACES, UM, IN THE BASEMENT LEVEL. UM, YOU'LL ALSO NOTE THAT THE FLOOR PLAN STATES LOOSE SINGING ON THE FIRST FLOOR. UH, THE PURPOSE OF THAT STATEMENT IS, UH, TO REFLECT THE FLEXIBILITY OF THE SEATING ARRANGEMENT WITHIN THE SPACE. UM, AS I MENTIONED, UH, THE OWNERS WILL BE, UH, FUSING IF YOU WILL RESTAURANT WITH A COMEDY ASPECT. UM, AND SO THIS LOOSENING WILL ALLOW THEM TO REARRANGE THE SEATING IN ORDER TO FACILITATE, UH, COMEDY EVENTS. THAT WILL BE A PART OF THE DINING EXPERIENCE WITHIN TEEKAY'S PLACE. UH, THE PARKING FOR THIS SITE, UM, TKS IS REQUIRED TO PROVIDE 126 PARKING SPACES BASED ON THE, UH, FOUR AREA OF THE BUILDING. THE SITE CURRENTLY, UH, SHARE HAS 460 PARKING SPACES ON SURFACE AND ALSO UNDERGROUND THAT ARE PART OF UNDERGROUND THE OFFICE UNDER THE OFFICE BUILDING. AND ALSO, UM, UNDER THE SURFACE PARKING, THERE'S A, UM, UH, A PARKING GARAGE, IF YOU WILL. ALL OF THAT EXISTING PARKING IS SHARED AMONGST THE TWO RESTAURANTS ON THE SITE AND THE OFFICE COMPLEX. UM, I NOTED IN THE STAFF REPORT THAT BASED ON THE SQUARE FOOTAGES AND TENANT MIX WITHIN THIS BUILDING, THE SITE IS ONE PARKING SPACE SHORT. UM, THERE ARE REQUIRED TO HAVE ONE IN 61 PARKING SPACES. UM, WHEN I WENT BACK TO LOOK AT WHAT WAS APPROVED FOR PUBLIC SCHOOL, 97, 2 STAFF MANGA OBSERVATION, THE SAME OBSERVATION THAT THERE WERE SPACE SHORT. AND, UM, UH, THE SUP WAS GRANTED WITH THAT EXCEPTION, UH, GIVEN THAT THE, THE OFFICE BUILDING ISN'T COMPLETELY OCCUPIED AND, UM, THE, UH, THE FLEXIBILITY OF PARKING WHEN THE PEAK TIMES FLUCTUATE BASED ON THE OFFICE, UH, DEMANDS AND THE RESTAURANT DEMANDS. SO, SO STAFF IS RECOMMENDING THAT THAT, UH, SAME, UM, UH, SAME REDUCTION BE GRANTED TO, TO THIS NEW RESTAURANT, AS FAR AS THE, UH, LANDSCAPING WITHIN THE SITE, THE APPLICANT IS PROPOSING TO MAINTAIN THE EXISTING LANDSCAPING AS IT EXISTS. THE PROPERTY OWNER HAS, UH, COMMITTED TO REPLACING ANY DAMAGE OR, UH, DAD LANDSCAPING THAT'S WITHIN THE SITE. THEY'RE ALSO, UH, RECEDING THE ALONG MONTFORT DRIVE. THERE'S A, UM, SOME GRASS AREA THERE THAT HAS, UH, BEEN DISTURBED DUE TO UTILITY WORK WITHIN THE AREA. SO THEY WILL BE, UH, RECEDING THAT AREA TO ESTABLISH, UM, UH, GRASS OR GROUND COVER ALONG LONG FOR DRIVE. UM, THE, WHEN WE'RE LOOKING AT, UH, JUST THE VICINITY OF THIS PARTICULAR BUILDING, THE LANDSCAPING IS IN GENERAL COMPLIANCE WITH THE LANDSCAPE BORDERLANDS, AS WE DISCUSSED IN THE WORK SESSION, UH, STAFF IS RECOMMENDING THAT THIS APPLICANT UNDER REQUIRED TO BRING THE WHOLE SITE INTO COMPLIANCE AS IT RELATES TO LANDSCAPING, IS THERE ONLY A PORTION OF THE ENTIRE SITE, BUT WHEN WE'RE LOOKING AT JUST THE VICINITY, THIS, THIS PROPERTY IS IN GENERAL COMPLIANCE WITH THE LANDSCAPE ORDINANCE, WITH THE, UM, LANDSCAPE OR FOR ALONG THE STREET EDGE. AND THEN, UM, THE PARKING ISLANDS AND SHADE TREES WITHIN THE VICINITY OF THE PARKING SPACES, UH, AS IT RELATES TO THE EXTERIOR OF THE BUILDING, THE APPLICANT IS NOT PROPOSING TO MAKE ANY MODIFICATIONS TO THE EXTERIOR. AS I MENTIONED, UM, WITH PUBLIC SCHOOL 9, 7 2, THERE WERE SIGNIFICANT UPDATES TO THE EXTERIOR. AND SO THOSE WILL BE MAINTAINED. THE QUIZZES REQUEST, UM, AS REQUIRED BY TOWN AND STATE LAW, UH, STAFF DID SEND OUT, UH, PUBLIC NOTICES TO THE PROPERTY OWNERS WITHIN 200 FEET WITHIN THE TOWN OF MADISON CITY LIMITS. UH, THERE WERE 13, UM, PROPERTY OWNERS WITHIN [00:10:01] THAT TEACHING YOUR FEET. WE DID NOT RECEIVE ANY LETTERS IN SUPPORT OR OPPOSITION TO THIS REQUEST, UH, WITH THAT STAFF DOES RECOMMEND APPROVAL OF THIS REQUEST, UH, WITH THE FOLLOWING CONDITIONS. UH, ONE, THE APPLICANT SHALL NOT HAVE ANY TERMS OR GRAPHIC DEPICTIONS THAT RELATE TO ALCOHOLIC BEVERAGES IN ANY EXTERIOR SIGNAGE. UM, THE FREQUENCY OF OCCURRENCE OF NO MORE THAN THREE DAYS PER WEEK OF RELATED TO COMEDY EVENTS, UM, WITHIN THE PROPERTY. AND THEY SHALL REMAIN IN NORTH WITH AN INDOOR AREAS. AND THEN LASTLY, THE SUP ORDINANCE, UH, OH, 15 DASH 0 1 4. I RELATED TO A PUBLIX WHEN 9 7, 2 BEING REPEALED WITH THE ISSUANCE OF THE CERTIFICATE OF OCCUPANCY FOR TVS PLACE. THEY WILL HAVE A FULL MENU. UM, THEY DO NOT INTEND TO HAVE, UH, UH, AND THIS WILL ADDRESS YOUR QUESTION OF THE THREE DAYS WHERE THEY DO NOT INTEND TO HAVE COMEDY EVENTS THROUGHOUT THE WEEK, UM, OR DAILY AND THROUGHOUT BUSINESS HOURS. UH, THE OPERATING HOURS WILL BE, UM, MONDAY THROUGH SUNDAY, UH, FROM APPROXIMATELY 10:00 AM TO 12 MIDNIGHT. UM, AND, UM, THE APPLE, THE OWNERS HAVE, UM, SUGGESTED THAT THEY DO ONLY INTEND TO HAVE THESE COMEDY EVENTS, UH, DURING THE WEEKEND. SO FRIDAY, SATURDAY, OKAY. IN CANADA COMEDY CLUB, THAT'S ON BELTLINE. OH, I'M SORRY. I APOLOGIZE. BUT THEY DO SERVE FOOD ON PREMISE. UM, NOW AS FAR AS IT BEING PART OF THEIR PRIMARY OPERATIONS, I DON'T KNOW EXACTLY WHAT DO THEY HAVE A SIMILAR IT'S DIFFERENT. THEY HAVE DAILY EVENTS TO MY, TO MY UNDERSTANDING, UM, UH, JUST COMEDY. THEY DO SERVE FOOD THERE AND ALCOHOLIC BEVERAGES. YES. I GUESS WHAT I'M GETTING TO IS IF THIS BUSINESS MODEL TAKES OFF AND OBVIOUSLY THE COMEDY CLUB HAS NO BUSINESS, THEY'VE GOT LUNCHES AND DINNER ALMOST EVERY DAY, AND THEY WANT TO GO TO FOUR OR FIVE DAYS. WE HAVE PUT A CONSTRAINT ON THEM. IT SEEMS TO ME THAT HURT SOME WHEN I DID SEEM TO ALSO GRANT THEM. SO I'M TRYING TO, TO COME UP WITH THREE DAYS, IF, I MEAN, I UNDERSTAND THAT THEY MAY WANT TO START OFF WITH JUST WEEKENDS AFTER A DAY, BUT ALL OF A SUDDEN THEY WISH THEY HAD ASKED FOR FIVE. AND I'M JUST WONDERING HOW, WHAT SORT OF PRECEDENT WE'RE SETTING FOR OTHER SIMILAR SITUATIONS HERE? I THINK IT'S INCONSISTENT WHAT WE'RE DOING WITH COMEDY. SO IN GENERAL, THE TOWN DOESN'T ALLOW CLUBS IN THE SENSE THAT IT'S JUST OPERATING AS A ENTERTAINMENT FACILITY, UM, WITH ALCOHOL, WITH THE SERVING OF ALCOHOLIC BEVERAGES. AND THAT'S WHERE THIS CONDITION COMES INTO PLACE TO ENSURE THAT THE OPERATIONS OF THIS USE IS TRULY A RESTAURANT. AND THE COMEDY ASPECT IS JUST SUPPLEMENTARY. AND TO DO THAT COMEDY CLUB IS IF YOU UP THERE, IT DOESN'T STRIKE ME AS I'M IN A RESTAURANT. AND IF THEY CAN GET BY WITH MORE THAN THREE DAYS A WEEK, I'M TRYING UNDERSTAND WHY WE'RE STILL STICKING HIM IN THREE. SO I THINK WE'VE HAD SOME CHALLENGES WITH THE COMEDY CLUB, UH, RELATED TO THE USE OF THAT PROPERTY AT TIMES. UM, THOSE CHALLENGES AREN'T AS IMPACTFUL IN THAT THEY DON'T HAVE RESIDENTIAL ADJACENCY. UM, ONE OF THE THINGS THAT WE WANTED TO CONSIDER WITH THIS USE IS THAT IT IS ADJACENT TO A SINGLE FAMILY NEIGHBORHOOD. UH, WHAT THEY'RE PROPOSING IS A RESTAURANT. UM, WE'RE VERY MUCH OPEN FROM A STAFF PERSPECTIVE, IF IT'S THE COMMISSION'S PREROGATIVE TO SUGGEST THAT WE DON'T NEED TO PUT RESTRICTIONS ON THEIR ACTIVITIES RELATED TO COMEDY SHOWS, UH, WE DON'T FIND ANYTHING INAPPROPRIATE WITH THAT, BUT, UH, WE DID WANT TO ACKNOWLEDGE THE RESIDENTIAL ADJACENCY HERE AND ENSURE THAT, UH, REALLY THE, THE LEADING USE FOR THIS PROPERTY IS RESTAURANT, UH, AND, AND COMEDY IS, IS ACCESSORY TO THAT. THEY WANT TO START HAVING A THURSDAY NIGHT, DO THEY HAVE TO COME BACK THROUGH THIS? IF THEY WERE TO, I MEAN, IF YOU HAD A CONDITION LIKE THIS AND YOU, THEY WANTED TO DO COMEDY FOUR NIGHTS A WEEK, THEN THAT WOULD NOT COMPLY WITH THAT CONDITION. SO THAT'S A CONCERN. WE SHOULD NOT PUT A CONDITION LIGHTS THAT ENDED AS PROPOSED APPRECIATE WHAT YOU'RE TRYING TO DO HERE. AND SO I JUST, I MEAN THAT I ABOUT SEISMIC, I DON'T WANT TO HAVE LARGE PARTIES ON THE PATIO AND A LOT OF SOUND COMING FROM THAT, BUT IT SEEMS TO ME WE'RE BEING A LITTLE, A LITTLE, I JUST DON'T WANT TO PUT THEM IN THREE DAYS ON A BUSINESS, IF YOU DO NEED THEIR BUSINESS TAKES OFF. AND THEY WERE STAYING AFTER FIVE OR SIX AND HAVING TO COME BACK AND GET THAT, IT SEEMED LIKE A WASTE OF RESOURCES. SO I'M JUST, I'M JUST KIND OF CURIOUS HOW COOL WE CAN DO HERE. AND THE, AND THE, AND THE, UM, BUSINESS OWNERS ARE HERE TEACHING HERE, KARA MATTSON. SO ARE THERE ANY, AND THAT, I THINK THAT QUESTION WE CAN, I MEAN, AS FAR AS THE CONDITION ITSELF, THE COMMISSION CAN RECOMMEND AN ALTERNATIVE AS FAR AS FOR MOVING THAT CONDITION OR EVEN ALTERING IT TO WHERE IT'S, YOU KNOW, JUST THE INDOOR PORTION ASPECT OF IT. I THINK WE CAN GET THERE AS WE TALK LATER ON THE OTHER THING, I'M 126 PARKING PLACES. WHAT IS IT TO LOCK CONCEIVE AND FIRE CODE FOR THIS RESTAURANT? I DON'T HAVE THE ANSWER TO THAT QUESTION. SO AVERAGING TWO PEOPLE PER CAR IN THAT REGARD, THIS RESTAURANT IS GOING TO HANDLE PUT DOWN MORE THAN 108 AS FAR AS OCCUPANCY. SO, UH, THIS REQUEST IS TO AMEND THE CONCEPT PLAN AND TO ACT ON A PROPOSED DEVELOPMENT PLAN FOR A PORTION OF THE VITRUVIAN PARK NEIGHBORHOOD. THIS NEIGHBORHOOD WAS FIRST ESTABLISHED IN ADDISON, UH, THROUGH A REZONING REQUEST IN 2007. UH, THE REZONED AT THAT TIME, A 99 ACRE PORSCHE THAN THE TOWN, UH, GENERALLY, UH, THE SOUTHEAST QUADRANT OF SPRING VALLEY ROAD AND MARSHALL LANE WITH THE EXCEPTION OF A FEW PROPERTIES IN 2013, UH, THE PD WAS EXPANDED. SO YOU TAKE IN THE BROOKHAVEN VILLAGE, UH, SHOPPING CENTER, WHICH IS AT THE SOUTHEAST QUADRANT OF MARCH, IT'S FROM VALLEY. AND THEN IT ALSO TOOK IN, UH, THE SUBJECT PROPERTY THAT IS UNDER CONSIDERATION BY THE COMMISSION TONIGHT, UH, 5.11 ACRE TRACT AT THE SOUTHEAST CORNER OF SPRING VALLEY AND VITRUVIAN WAY, AND THEN BOUNDED AT THE SOUTH BY BELLA LANE. UH, THIS, UH, BLOCK IS KNOWN AS BLOCK TWO 17 IN THE VITRUVIAN PARK MASTER PLAN AND PD ZONING. UH, SO WITH THIS REQUEST TONIGHT, UH, THE APPLICANT A UDR IS REQUESTING TO AMEND THAT CONCEPT PLAN TO ACCOMMODATE A DIFFERENT DEVELOPMENT FORM, AND THEN ALSO TO, UM, UH, RECEIVE CONSIDERATION FOR APPROVAL FOR A PROPOSED DEVELOPMENT PLAN FOR 85 TOWNHOME MULTIFAMILY UNITS. SO, UH, THAT DEVELOPMENT [01:00:01] FORM, UM, BECAUSE IT IS HOUSING UNITS THAT ARE, UM, TOWNHOME AND CHARACTER, BUT THEY'RE ALL ON ONE LOT AND THEY'RE ALL RENTAL TOWNHOMES. UH, THEY WOULD BE CATEGORIZED FROM A LANDIS' PERSPECTIVE, UM, VIA THE, THE VITRUVIAN PARK PD AS MULTIFAMILY. UM, THE PREVIOUS CONCEPT PLAN HAD THIS BLOCK DESIGNATED FOR URBAN MULTI-FAMILY DEVELOPMENT, UH, JUST UNDER 370 MULTIFAMILY UNITS WERE ENVISIONED, UH, AT THAT, UH, WITH THAT PREVIOUS CONCEPT PLAN. SO THE PROPOSED CONCEPT PLAN WOULD, UH, REDUCE THE DENSITY, UH, CHANGE THE HOUSING FORM AND CHARACTER, UH, FOR THIS TO ACCOMMODATE 85 UNITS AT THIS SITE. UM, SO WITH THAT, UH, THE PROPOSED HOUSING TYPES ARE THREE STORY, UH, UNITS. UH, THEY ARE, UH, ATTACHED TOWNHOME UNITS, UH, SHARING A COMMON WALL, UH, EACH UNIT THAT EITHER FRONTS ON A PUBLIC STREET OR FRONTS ON PRIVATE OPEN SPACE, UH, WHERE IT CAN'T, UH, FRONT ON A PUBLIC STREET. SO, UH, THOSE UNITS FORM AN URBAN STREETSCAPE ALONG BELLA LANE, THE TRUE GATEWAY AND SPRING VALLEY. AND THEN THEY ALSO ENGAGE THE STREETS STREETSCAPE BY ACCOMMODATING, UH, STOOPS AND PATIO FEATURES AT THE GROUND FLOOR, CREATING THAT, UH, PEDESTRIAN ORIENTED, URBAN STREETSCAPE THAT IS, UH, REALLY, UH, A KEY CHARACTERISTIC OF THE VITRUVIAN PARK NEIGHBORHOOD. ANOTHER KEY ELEMENT OF THIS PROPOSAL, THERE IS AN EIGHT FOOT TRAIL PROPOSED ALONG THE EASTERN EDGE, UH, LINKING SPRING VALLEY, UH, TO BELLA LANE, UH, THAT IS IMPLEMENTING THE TOWNS, UH, TRAIL MASTER PLAN. ALSO, THERE ARE STREETSCAPE IMPROVEMENTS, PROPOSED DEVELOP LANE, ADDING THE SIDEWALK AND CREATING THAT URBAN EDGE THAT THOMAS ON THE FRONT DOWN AND THEN ACCESS FOR THIS SITE IS TAKEN FROM MULTIPLE LOCATIONS, PRIMARY ACCESS FROM CONTRIBUTING WAY WHERE THERE'S A LEFT TURN INTO THE SITE. AND THEN, UH, BELLA LANE, UH, HAS ACCESS AS WELL. UH, AND THEN THERE IS EMERGENCY ACCESS ONLY TAKING FROM, UH, SPRING VALLEY ROAD. UH, SO THERE ARE MULTIPLE UNIT TYPES PROPOSED. UM, 78% OF THE PROPOSED TYPES ARE EITHER TWO OR THREE BEDROOM UNITS. SO THAT IS A, UM, A PRETTY SIGNIFICANT DEVIATION FROM TYPICAL MULTI-FAMILY PRODUCT THAT WE SEE NOW IN TOWN. AND THEN THERE IS ALSO A ONE BEDROOM FLOOR PLAN AS WELL. A SMALLEST PROPOSED UNIT IS 1500 SQUARE FEET IN SIZE WITH THE LARGEST, UH, BEING JUST OVER 2200 SQUARE FEET IN SIZE. AND THE AVERAGE UNIT SIZE IS JUST OVER 1900 SQUARE FEET. UH, EACH OF THESE UNITS WILL ACCOMMODATE, UH, PARKING, UH, HAD THE GROUND FLOOR WITHIN THE BUILDING THROUGH A TWO CAR GARAGE. ADDITIONAL PARKING IS PROVIDED FOR VISITORS, BOTH AT THE PUBLIC STREETSCAPES. UM, THE TRUE ME IN, IN BELL LANE, BUT ALSO INTERNAL TO THE SITE AS WELL. UM, WHILE WE'RE ON THE TOPIC OF PARKING, UH, THIS, UH, BASED ON THE 85 DWELLING UNITS THAT ARE PROPOSED AND THE NUMBER OF NUMBER OF BEDROOMS THAT COMPOSE, UH, COMPRISE THOSE 85 DWELLING UNITS, 151 PARKING SPACES ARE REQUIRED. THIS PROPOSAL SIGNIFICANTLY SEEDS THAT WITH 215 PARKING SPACES PROVIDED, UM, THE, UH, PROJECT BEING IN THE VITRUVIAN PARK NEIGHBORHOOD. AS WE KNOW, UM, OF THE FRONT END OF THAT DEVELOPMENT, UH, A CENTRALIZED, EXPANSIVE, UH, OPEN SPACE WAS PROVIDED, UH, THAT ACHIEVED THE PARKLAND DEDICATION NEEDS, UH, FOR THE VITRUVIAN PARK NEIGHBORHOOD. SO ALL ADDITIONAL OPEN SPACE IS REALLY PRIMARILY PRIVATE AMENITY AREA. AND THEN ALSO PRIVATE LANDSCAPES. YOU SEE THAT, UH, IN THE FORM OF THE, UH, UH, COMMUNITY AMENITY SPACE, THE POOL, AND THEN THE LANDSCAPE YARDS, UH, AT THE, UH, PUBLIC STREET FRONT, BUT ALSO INTERIOR TO THE SITE AS WELL. ONE OF THE UNIQUE FEATURES OF THIS PROPOSAL IS, UM, UH, IN THE PATIO AREAS, THE APPLICANT IS PROPOSING TO HAVE A PORTION OF, UH, COMPRISING, UH, ARTIFICIAL TURF. UM, AND ALSO THERE'S A SMALL DOG RUN, UH, WITHIN THE SITE THAT IS, UH, PROPOSED, UH, TO HAVE ARTIFICIAL TURF, UM, THIS AT THIS LEVEL, UM, IT, THAT IS APPROPRIATE, BUT AS WE GET INTO ADDITIONAL CIVIL DESIGNER, YOU WOULD TAKE INTO CONSIDERATION SUCH AS DRAINAGE AND, AND THE IMPACTS OF SAY PET USAGE OF THOSE FEATURES. THAT'S SOMETHING THAT THE APPLICANT WILL NEED TO PROVIDE SOME ADDITIONAL ANALYSIS ON THAT TO ENSURE THAT THOSE ARE APPROPRIATE DESIGN TREATMENTS. UM, WHENEVER WE TALK ABOUT PROJECTS, WE TALK ABOUT REQUIRED LANDSCAPE AREA. TYPICALLY 20% IS REQUIRED WITH THIS PROPOSAL. THE APPLICANT IS EXCEEDING [01:05:01] THAT WITH 27% LANDSCAPE. UM, SO, UH, WITH THIS PROPOSAL, UM, THE APPLICANT IS, UH, PROPOSING, UH, BUILDING DESIGNS, UH, COMPRISED OF, UH, MULTIPLE FACADE MATERIALS WITH THE VITRUVIAN PARK PD. UH, IT REQUIRES MASONRY CONSTRUCTION ON 80% OF THE STREET FACING AND PUBLIC SPACE FACING FACADES. AND IT ALSO LIMITS FACADE MATERIALS TO, UH, NO MORE THAN THREE. UM, WE'LL GET INTO THAT ISSUE A BIT MORE. BUT ONE THING I WOULD HIGHLIGHT IS THAT, UH, WITH THE APPLICANTS, UH, UH, UH, PROPOSED FACADES, THEY ARE, UM, UH, COMPRISED OF A SIGNIFICANT AMOUNT OF STUCCO, UM, THAT, UH, IS NOT A SPECIFICALLY CALLED OUT MASONRY CONSTRUCTION MATERIAL IN THE VITRUVIAN PD. THEN ALSO WITH THESE FACADES, YOU'LL SEE THAT, UH, ONE OF THE DOMINANT COLORS IS WHITE. UM, THERE IS, UM, UH, MATERIAL COLOR RESTRICTIONS IN THE VITRUVIAN PD SPECIFICALLY RELATED TO, UH, WHITE, UH, NEEDING TO BE MORE OF AN ACCENT MATERIAL INSTEAD OF A PRIMARY MATERIAL LIKE IT'S BEING UTILIZED HERE. UM, ALSO, UM, ONE ADDITIONAL, UM, UH, KIND OF DEVIATION FROM THE PD ORDINANCE IS THAT, UH, WHEN YOU HAVE PATIO AREAS OR BALCONY AREAS, THE ENCLOSURE, UH, THAT, UH, UH, CORDONS THOSE AREAS OFF, UH, TYPICALLY NEEDS TO BE TRANSPARENT. SO METAL FENCING OR BROAD IRENE IS THE TYPICAL DESIGN TREATMENT. THEY ARE PROPOSING THAT THE GROUND FLOORS TO HAVE SOME MASONRY MATERIAL, UM, THAT FENCE CAN'T GET TALLER THAN 36 INCHES, BUT, UM, WHAT THEY PROPOSE WOULD BE LESS TRANSPARENT THAN WHAT THE PD ALLOWS. SO, UM, ONE OF THE UNIQUE THINGS ABOUT THE, THE TRIVIAN PARK PD, UH, SIMILAR TO ADDISON CIRCLE AND ACKNOWLEDGES THAT WHEN YOU'RE IMPLEMENTING, UH, MASTER PLANNING PROJECTS AND YOU ESTABLISH DESIGN STANDARDS ON THE FRONT END OF THOSE PROJECTS, UH, WHEN YOU GET INTO SPECIFIC SITES, SOMETIMES THEY WILL NEED TO BE CONSIDERATIONS RELATED TO, UH, UH, DESIGN FLEXIBILITY. UM, SO THERE IS A SECTION IN THAT PD CALLED FLEXIBLE STANDARDS, UH, THAT ALLOWS APPLICANTS TO REQUEST WAIVERS OR DEVIATIONS FROM THOSE DESIGN STANDARDS TO ACCOMMODATE, UH, ALTERNATIVE TREATMENTS. SO, UH, THERE ARE A SERIES OF, UH, DESIGN DEVIATIONS BEING REQUESTED BY THIS APPLICANTS. MOST OF THEM RELATE TO BUILDING DESIGN, BUT THERE IS ONE THAT RELATES TO SITE DESIGN AND THAT'S, UH, RELATED TO THE BUILD TO STREET BUILD TO LINE REQUIREMENTS. SO THE TOWN HAS ESTABLISHED STANDARDS THAT REQUIRE IN THIS AREA BECAUSE IT'S MORE URBAN THAN FORM TO HAVE THE BUILDINGS PUSHED UP TO THE STREET. SO THAT MEANS THAT THEY HAVE TO BE BUILT A SPECIFIC DISTANCE FROM THE STREET EDGE. SO IN THIS CASE, ON THE TRUE BEING WAY, UH, THE BUILDINGS HAVE TO BE BUILT, UH, NO MORE THAN NINE FEET, UH, FROM THE PROPERTY BOUNDARY AND REALLY SPECIFICALLY NINE FEET FROM THE PROPERTY BOUNDARY, UM, DUE TO THE, OF VITRUVIAN WAY, UH, THAT IS VERY CHALLENGING TO ACHIEVE. SO THE APPLICANT HAS REQUESTED A WAIVER FROM THAT STANDARD, AND YOU CAN KIND OF SEE IT IN THE MID-BLOCK AREA WHERE THE BUILDINGS ARE SET BACK A BIT MORE, UH, THAT DOES PROVIDE FOR ADDITIONAL LANDSCAPE AREA, WHICH I THINK IS, UH, A UNIQUE AND APPROPRIATE TREATMENT AND PROVIDES VISUAL INTEREST OF THE STREETSCAPES AND STAFF DOES SUPPORT THAT REQUEST. UH, THE REMAINING, UH, WAIVER REQUESTS, UH, RELATE TO BUILDING FACADE DESIGN. UM, WE HIGHLIGHTED, STUCK OUT AS BEING A POTENTIAL ISSUE. SO THE PD SPECIFICALLY DEFINES BASIN CONSTRUCTION, AND IT USES TERMS SUCH AS BREAKS DOWN, UH, CAST ON THE TYPICAL TERMS THAT YOU ASSOCIATED WITH MASONRY STUCCO IS NOT ONE OF THOSE TERMS. UM, HISTORICALLY, UH, THE TOWN HAS, UH, PERMITTED STUCCO AS A MATERIAL. UH, AND IN THOSE CASES IT HASN'T BEEN LIKE AS AN ACCENT MATERIAL WHERE IT'S ONLY ACCOMMODATING 20% OF THE BUILDING FACADE, UH, AS AN EXAMPLE, UM, THE MOST RECENT PROJECTS, UH, VITRUVIAN WEST, IT DID ACCOMMODATE MORE STONE THAN STUCCO, BUT IT WAS NOT SUBSTANTIALLY MORE. THIS ONE'S PROBABLY A LITTLE DIFFERENT IN THAT STUCK IS PROBABLY A MORE DOMINANT MATERIAL, BUT THE USE OF STUCCO, ISN'T AN INAPPROPRIATE MATERIAL FOR THIS TYPE OF BUILDING. AND BASED ON HOW TOWNS REGULATE THE USE OF STUCCO WOULD NOT BE APPROPRIATE INAPPROPRIATE IN THIS CASE. UH, I WOULD ALSO SHARE THAT YOU DO SEE THE USE OF STUCCO AND OF THEIR BUILDINGS IN VITRUVIAN AND, AND IT'S, IT'S, UM, UH, LARGELY CONSISTENT WITH THAT AND THE DESIGN [01:10:01] AND THE USE OF THE STUCCO IN THIS PARTICULAR DESIGN IS NOT DONE IN A WAY WHERE YOU HAVE, UH, LARGE AREAS OF BLANK WALL. IT'S A, IT'S A WELL-DESIGNED BUILDING, BUT WE CAN LET THE APPLICANT TALK ABOUT THAT MORE AS WELL. ALSO, THE MATERIAL ISSUE THEY ACCOMMODATE FOR FACADE MATERIALS, UH, THREE IS, UH, UH, THE REQUIREMENT, UM, NOT AN EXCESSIVE, UM, UH, INCREASE OVER WHAT IS REQUIRED. AND, UH, IT DOES ADD A LITTLE BIT OF DIVERSITY TO THE FACADE AND THEN, UM, THE ISSUE OF COLORING, UM, YOU CAN SEE WITH FIORE AND YOU'VE PROBABLY SEEN IN THE PAST WITH, UH, THE EUROPEAN WEST BUILDING LIGHTER COLORS, UM, ARE, ARE NOT UNCOMMON IN VITRUVIAN. IT'S KIND OF CONSISTENT WITH THAT AESTHETIC. AND, UM, LOOKING AT THE PALETTE, THAT'S PROPOSED A MIX OF GRADES BROWNS AND WHITE IS A PRIMARY MATERIAL. UH, STAFF FEELS THAT THAT IS CONSISTENT AND COMPATIBLE WITH THE SURROUNDING AREA. SO STAFF IS COMFORTABLE WITH THOSE, UH, WAIVER REQUIREMENTS AND ALSO WITH THE, UH, PROPOSED WAIVER TO ALLOW FOR THE MASONRY HABEO ENCLOSURES, GIVEN HOW SHORT THOSE ENCLOSURES ARE, UH, IT'S, IT'S AN APPROPRIATE TREATMENT AND DOES PROVIDE SOME ARCHITECTURAL INTEREST AT THE GROUND FLOOR. UH, STAFF DID NOTIFY ADJACENT PROPERTY OWNERS, AS WELL AS THE ISD IN ACCORDANCE WITH STATE LAW, SIX RECEIVED NOTICES. WE'VE NOT RECEIVED FEEDBACK TO THIS POINT. STAFF DOES FEEL THAT THIS PROJECT IS ADDING A UNIQUE HOUSING TYPE AND A UNIQUE LIVING, UH, OPTION IN THE VITRUVIAN PARK NEIGHBORHOOD. IT'S CONSISTENT WITH THE CHARACTER AND THE QUALITY OF DESIGN THAT YOU'VE SEEN IN THE PAST. AND IT'S A, UH, A NICE GATEWAY, UH, UH, PROJECT THAT CAN BE, UH, SERVE AS A GATEWAY, UH, TO THIS NEIGHBORHOOD. UH, STAFF DOES RECOMMEND APPROVAL OF THE REQUEST. SO THE CONSTRUCTION DURATION IS A LOT SHORTER. UM, ONE THING THAT WE REALLY ARE EXCITED ABOUT THIS COMMUNITY IS THAT IT'S REALLY DIFFERENT, UM, AND A GREAT WAY. AND ONE THING THAT KIND OF POINTED OUT EARLIER IS THE AVERAGE HOME VALUE CLOSER TO 1900 SQUARE FEET. WE NEED TO MAKE DECISIONS MUCH SOONER RATHER THAN LATER, AS IT RELATES TO THIS DESIGN AND FINISHES OF THE INTERIOR OF THE UNITS, AS WELL AS, UH, OTHER FEATURES AROUND THE SITE.
