UH, IF YOU REMEMBER, UH, BACK DURING THE SUMMER, WHEN WE WERE TALKING ABOUT OUR, UH, PROPOSED 2021, UH, BOND PROGRAM, WE HAD, UH, SOME, SOME REFUNDING OPPORTUNITIES AND ALSO SOME, SOME, UH, NEW BONDS THAT WERE BEING ISSUED. UH, BUT WE DISCUSSED, UH, BRIEFLY, UH, THE OPPORTUNITY THAT WE WOULD HAVE HERE AT THE END OF 2021 IN EARLY 2020 TO, UH, TO REFUND SOME 2012, A CERTIFICATE OF OBLIGATION ON A TAX EXEMPT BASIS, SO THAT WE HAD HILLTOP SECURITIES, OUR FINANCIAL ADVISOR REVIEW THIS ONCE AGAIN TO MAKE SURE THAT THAT STILL MADE SENSE. UM, AND THEN BASED ON THAT ANALYSIS, THEY DID DETERMINE THAT IT DOES STILL MAKE SENSE TO, UH, PURSUE A TAX EXEMPT REFUNDING, UH, FOR THESE 2020 OR 2012, UH, CERTIFICATE OF OBLIGATION BONDS. UM, AND THE REASON THAT WE'RE DOING IT AT THIS TIME IS BECAUSE, UM, BEGINNING, UH, FEBRUARY 15TH, 2022, UH, THESE BONDS CAN BE CALLED, WHICH MEANS THAT THEY CAN BE REFINANCED ON A TAX EXEMPT BASIS. UH, IF YOU RECALL, OVER THE LAST FEW YEARS, WE'VE DONE, UM, UH, TAXABLE REFUNDS OR REFINANCINGS, UM, AND THAT'S BECAUSE OF THOSE BONDS THAT WE REFINANCE, WE'RE NOT ABLE TO BE CALLED. SO WITH THIS ISSUE ONCE, UH, BECAUSE THESE ARE ABLE TO BE CALLED, WHICH MEANS BASICALLY THAT THE, THE LAST 10 YEARS OR 15 YEARS OF AN ISSUANCE, UH, THAT THOSE CAN BE REFINANCED, UH, AT THAT TIME. SO BY DOING THIS AT THIS POINT, THAT ALLOWS US TO DO THAT ON THAT TAX EXEMPT BASIS. SO, UH, THE REASON, UM, THAT THERE'S A DIFFERENCE BETWEEN TAXABLE AND TAX EXEMPT ON SOME OF THESE TRANSACTIONS NOW IS BACK IN 2017 WITH THE TAC TAX CUTS AND JOBS, JOBS ACT. UM, UH, THESE BONDS HAVE TO BE CALLABLE DONE, SO A REFUND ON THE TAX EXEMPT BASIS. SO, SO THAT TIMING HELPS US OUT THE, THIS TRANSACTION, UH, THAT WE CAN DO ON THAT BASIS AND SAVE SOME ADDITIONAL SAVING. SO A QUICK ANALYSIS OF WHAT THIS 2022 REFUNDING LOOKED LIKE, UH, ON THE LEFT, YOU CAN SEE THE DATE, UH, WHICH THESE ARE, UH, FOR THE NEXT 15 YEARS OF DEBT SERVICE. OUR CURRENT DEBT SERVICE IS LISTED THERE AS PRIOR DEBT SERVICE. AND YOU CAN SEE WHAT WE ANTICIPATE [00:05:01] IF WE REFUND OR REFINANCE, UH, THIS, UH, 2012, UH, CERTIFICATE OF OBLIGATION. AND THEN TO THE RIGHT, YOU CAN SEE THE ANNUAL SAVINGS, UH, WHICH RANGE FROM ABOUT 62,000 TO $68,000 PER YEAR. WE'RE IN TOTAL, APPROXIMATELY $971,500. AND THEN CONTINUED ON THAT ANALYSIS. IF WE LOOKED AT WHAT DOES THIS EQUATE TO, AS FAR AS THE TAX RATE GOES, IF WE LOOK AT WHAT OUR VALUES ARE FOR THE CURRENT FISCAL YEAR, THIS WOULD EQUATE TO ABOUT ONE, TWO OF ONE PENNY ON THE TAX RATE, UH, BEGINNING WITH, UH, THE NEXT FISCAL YEAR, UH, THIS, UH, PROPOSAL PROPOSED ISSUANCE, UH, ANTICIPATES IN ALL IN TRUE INTEREST COSTS OF ABOUT 1.8, 9% NET PRESENT VALUE SAVINGS OF ABOUT 8.8, 3%. AS I MENTIONED ON THE PREVIOUS SLIDE, THE SAVINGS ARE $970,500. AND THEN ON NET PRESENT VALUE BASIS, UH, THOSE SAVINGS ARE ABOUT 836,000. SO THE TIMELINE FOR THIS ISSUANCE, WE'RE HERE THIS EVENING ON NOVEMBER 9TH, THAT PRESENTED WITH PLANNING COUNCIL, UH, WE WOULD, UH, BEGAN PREPARING OUR PRELIMINARY OFFICIAL STATEMENT AND THOSE DOCUMENTS, UH, AND THEN ON THE WEEK OF DECEMBER 13TH, UH, HAVE RATING CALLS WITH RATING AGENCIES, UH, DECEMBER 28TH, WE WOULD ANTICIPATE RECEIVING THOSE RATINGS FROM THE RATING AGENCIES. UH, THE FIRST MEETING IN JANUARY TUESDAY, JANUARY 11TH, WE WOULD HOLD A COMPETITIVE SELL FOR THE BONDS, UH, IN THE MORNING. AND THEN THAT EVENING WE WOULD PRESENT THE ORDINANCE AUTHORIZING THE SALE OF THOSE BONDS TO THE CITY COUNCIL FOR APPROVAL. AND THEN IF APPROVED, UH, THE CLOSING DATE WOULD BE FEBRUARY 15TH, AND THEN WE WOULD CLOSE ON THE TRANSACTION AT THAT TIME AND TAKE DELIVERY OF THE FUNDS, UH, WHICH WOULD, UH, PAY OFF THE OLD BONDS. AND THEN WE WOULD HAVE NEW BONDS AT A LOWER INTEREST RATE AND LET'S SAY, IN THE PAYMENT. SO, AND WITH THAT, WE'LL BE HAPPY TO ANSWER ANY QUESTION THAT YOU HAVE. SO I JUST HAVE ONE COMMENT. Present and Discuss Proposed Updates to the Code of Ordinances, Chapter 58, Parks and Recreation.] I HAVE NUMBER TWO, PRESENTED DISCUSS PROPOSAL UPDATES TO THE CODE OF ORDINANCES, CHAPTER 58, LOSS RECREATION MAYOR COUNCIL TENANTS AS WELL, DIRECTOR OF PARKS AND RECREATION, WHATEVER YOU NEED BEFORE YOU TONIGHT IS A FOLLOWUP TO A CONVERSATION THAT WE HAD IN JUNE OF 2021, WHERE STAFF RECOMMENDED CHANGES TO THE PARK ORDINANCE TO CREATE A PARK USE PERMIT. UM, THIS WAS RECOMMENDED TO HELP MANAGE AND DEFINE CRITERIA FOR GROUP GATHERINGS THAT WERE OCCURRING IN THE PARKS. AND IN SOME INSTANCES WAS CAUSING SOME NUISANCES FOR PARTS [00:10:01] OR MAINTENANCE OF THE PARKS. AND THEN FOR SOME OF THE RESIDENTS THAT LIVE AROUND THE PARKS, UM, SINCE THAT TIME STAFF IS COORDINATED WITH SPECIAL EVENTS, FOLLOWING THAT DISCUSSION, UM, AS A RESULT OF THAT DISCUSSION STAFF IS PROPOSING THAT MODIFICATIONS TO THE PROPOSED PARK USE PERMIT THAT WE DISCUSSED LAST TIME, BE MADE. WE'LL GO THROUGH THAT THIS EVENING, UM, AND WHAT WE'RE PROPOSING THESE UPDATES. WE WANTED TO TAKE THE OPPORTUNITY OF THIS TIME TO JUST CLEAN UP THE ORDINANCE AND TO PROVIDE SOME CLARITY IN A FEW PLACES. SO WE'LL GO THROUGH THAT THIS EVENING. ALSO, THE CHART THAT YOU SEE HERE IS WHAT WAS PRESENTED TO COUNCIL LAST TIME. I BELIEVE EVERYBODY RECEIVED THAT VERY FAVORABLY. WHAT YOU SEE IN RED WOULD BE WHAT WE ARE PROPOSING THAT WE ADD TO THE PROPOSED PARK USE ORDINANCE. UM, YOU'LL SEE WHERE THEIR CHANGES WERE MADE IS WHO CAN APPLY FOR A COMPO. I NEED TO MAKE ONE EDIT WHO CAN APPLY FOR A PERMIT OUT OF SOME RESIDENTS AND BUSINESSES. WE'D LIKE TO MAKE ONE EXCEPTION TO THAT AT OUR DESTINATION PARKS OUT OF SOME CIRCLE PARK IN VITRUVIAN PARK, WE DO HAVE NON ADDISON RESIDENTS IN BUSINESSES THAT RENT THOSE FACILITIES FROM SPECIAL EVENTS FROM TIME TO TIME. SOMETIMES THEIR GROUP GATHERINGS ARE LESS THAN A HUNDRED PEOPLE, SO IT WOULD FALL UNDER A PARKING ORDINANCE. SO WE LIKE TO MAKE THAT ONE CLARIFICATION THAT THOSE TWO PARKS, NON ADDISON RESIDENTS IN BUSINESSES COULD APPLY FOR A PARK USE PERMIT. WHAT IS THE COST OF A PERMIT? WE MADE A COUPLE OF CHANGES TO THAT RELATED TO THE NON OBVIOUSLY RESIDENT IN BUSINESSES, UM, THAT WE WOULD CHARGE THE RATE, WHAT SPECIAL EVENTS CHARGES. FOR EXAMPLE, IF THEY RENT A SECTION OF THE PARK OUT, THEY'VE WRITTEN BY HALF A DAY AND DAYS WHERE WE WOULD, UM, ISSUE A PERMIT, WE WOULD ISSUE IT WHERE NO MORE THAN 30 DAYS IN ADVANCE TO ALLOW SPECIAL EVENTS, TIME TO BOOK THE PARK FOR A LARGER EVENT. IF THEY DIDN'T BOOK THE PARK FOR A LARGER EVENT WITHIN THAT 30 DAYS TIME, WE COULD MAKE IT AVAILABLE TO ADDISON BUSINESS RESIDENTS NON-RESIDENTS AND NON ADDISON BUSINESSES, AND THEY WOULD BE CHARGED THE HOURLY RATE. SO IF THEY WERE ONLY GOING TO USE THE PARK FOR TWO HOURS, WE WOULD, AND WE WOULD TRANSCRIBE WHAT SPECIAL EVENTS, CHARGES, AND ONLY CHARGE ON THE TWO HOUR RATE. UM, WE WOULD STILL REQUIRE A DEPOSIT. THE REASON THAT WE'RE PROPOSING THAT WE DO THIS IS, UM, THERE IS A GAP AT OUR DESTINATION PARKS. WE DO HAVE PEOPLE THAT ARE IN GROUPS SMALLER THAN A HUNDRED THAT ARE COMING AND USING THEM. AND WE WANT TO BE ABLE TO GIVE THEM THE RULES, JUST LIKE WE TALKED ABOUT IN THE OTHER PARKS AND HAVE THEM AGREE TO WHAT THE TERMS ARE FOR THE USE OF THE FACILITY IN ORDER TO CONTROL SOME OF THE ISSUES THAT WE'VE BEEN HAVING. SO THAT'S ONE CHANGE THAT WE WOULD RECOMMEND. IN ADDITION TO THAT, WE WOULD MAKE UPDATES TO THE ORDINANCE THAT WOULD HELP, UM, HELP US FACILITATE THE PARK, USE PERMITS IN THE ORDINANCE. WE HAVE ADDED SOME DEFINITIONS TO HELP ADD CLARITY TO, UM, HOW WE WOULD ISSUE THOSE PARK USE PERMITS. WE HAVE CREATED A DEFINITION FOR THE ADOPTED PLAN, WHICH REFERS TO THE PARK RECREATION AND OPEN SPACE PLAN, WHICH WAS ADOPTED IN APRIL OF 2019. AND THERE WOULD BE A COPY ON FILE WITH THE OFFICE OF THE CITY SECRETARY. THE REASON WE WANT TO INCLUDE THAT IS BECAUSE THE PARKS RECREATION AND OPEN SPACE PLAN CATEGORIZES ALL THE PARKS. THAT'S THE PLACE THAT SAYS WHAT'S A DESTINATION PARK, URBAN PARK. UM, AND, AND IT WOULD DEFINE THAT. SO WE WANT TO REFER PEOPLE TO THAT PLAN. WE PROVIDED A DEFINITION FOR NEIGHBORHOOD GATHERING AS AN EVENT PRODUCED BY A COMMUNITY-BASED HOMEOWNER'S ASSOCIATION OR NEIGHBORHOOD GROUP FOR THE BENEFIT OF THEIR MEMBERS. IT DOES NOT REQUIRE USE OF PARKING. WE HAVE ADDED A DEFINITION FOR WHAT THE PARK USE PERMIT IS. HE HAS A PERMANENT THAT IS ISSUED BY THE DEPARTMENT OF PARKS AND RECREATION AND UPON APPLICATION AND APPROVAL FOR GROUP GATHERINGS OR NEIGHBORHOOD GRID GATHERINGS OF MORE THAN 20 PEOPLE, BUT LESS THAN A HUNDRED. AND THEN WE PROVIDED A DEFINITION FOR PARK PROPERTY, WHICH MEANS ANY PARK ATHLETIC FACILITY, RESERVATION, PLAYGROUND, RECREATION CENTER, OR ANY AREA, OTHER AREAS IN TOWN OWNED OR USED OUT OF TOWN AND DEVOTED TO ACTIVE OR PASSIVE RECREATION, BUT IS NOT ACQUIRED OR DESIGNATED BY THE TOWN FOR USE AS PUBLIC PARK PARK PROPERTIES ARE IDENTIFIED THE PARKS RECREATION AND OPEN SPACE PLAN. THE PLAN ALSO CLASSIFIES PARKS IN THE FOLLOWING CATEGORIES, DESTINATION, COMMUNITY, URBAN NEIGHBORHOOD, AND GREENBELT TRAIL. IN ADDITION THAT WE'VE ADDED A SECTION IN THE PARKS ORDINANCE, SECTION 58 43, UM, THAT WOULD BE THE TOOL THAT WE USE TO IMPLEMENT THE PARK [00:15:01] USE PERMIT. IT WOULD IDENTIFY GROUP GATHERINGS. IT WOULD ESTABLISH WHAT THE REQUIREMENTS ARE FOR ESTABLISH OR RE APPLYING FOR A PERMIT. IT WOULD DEFINE WHAT THE FEES ARE. UM, IT WOULD DEFINE THE RULE, IT DEFINES THE RULES AND IT DEFINES ENFORCEMENT. AND IF OFFENSES ARE COMMITTED AND WHAT THE PENALTY WOULD BE, WE ALSO ADDED SOME ADDITIONAL ORDINANCE CLARIFICATIONS. UM, WHILE WE WERE LOOKING AT UPDATING THE ORDINANCE, UM, TO HELP US GO ABOUT FACILITATE THE JOB THAT WE DO ON A DAY-TO-DAY BASIS. ONE OF THOSE IS TO DEFINE WHAT INDEPENDENT IS. UM, WE'VE ACTUALLY HAD THIS ISSUE COME UP SEVERAL TIMES AS FAR AS REGISTERING CHILDREN FOR OUR CAMPS AT THE ATHLETIC CLUB. UM, WE DO NOT HAVE A CLEAR DEFINITION OF WHAT INDEPENDENT IS OF SOMEBODY. AND SO THIS DEFINITION WOULD HELP US, UM, BE ABLE TO EXPLAIN THAT TO OUR MEMBERS WHO WANT TO ENROLL THEIR CHILDREN IN CAMP. A DEPENDENT IS AN INDIVIDUAL LINK TO A PRIMARY MEMBERSHIP COUNT AT THE AND THE ATHLETIC CLUB. AND THE PRIMARY MEMBER IS THE LEGAL GUARDIAN OF THE DEPENDENT. WE HAVE ALSO ADDED A DEFINITION FOR LEAK PLATE. UM, WE'VE HAD SOME INSTANCES OF LEAGUE PLAY, UM, AT SOME OF OUR PARKS WHERE A LOT OF EQUIPMENT'S BEEN BROUGHT IN WHITE SANCTIONS HAVE BEEN BROUGHT IN. UM, AND SO WE WANT TO HAVE A DEFINITION THAT DEFINES WHAT LEAGUE PLAY IS AND WHAT WE'VE COME UP WITH IS IT NEEDS AN ORGANIZED GROUP OF PEOPLE THAT REGULARLY PRACTICE AND REPLAYED AN ORGANIZED SPORT. AND THEN WE'VE DEFINED ORGANIZED SPORT AS ANY GAMES, COMPETITION, OR PRACTICE, WHICH IS PLAYED BY THREE OR MORE PERSONS IN IS CARRIED OUT UNDER AGREED SET OF RULES. AND THEN WE'VE ADDED SOME CLARIFICATION TO SECTION 58, 3 VENDING AND PEDDLING, UM, THAT NO FITNESS INSTRUCTOR OR FITNESS TRAINING IS ALLOWED ON PARK PROPERTIES UNLESS THE FITNESS INSTRUCTOR OR FITNESS GROUP HAS APPLIED FOR AND BEEN APPROVED BY THE DEPARTMENT OF PARKS AND RECREATION AS AN OUT-GROUP VENDOR. UM, ONE OF THE THINGS THAT WE NOTICED WHEN THE PANDEMIC KIT AND A LOT OF INDOOR FACILITIES WERE CLOSED, WE HAD, UM, A LOT OF FITNESS INSTRUCTORS THAT WERE SHOWING UP IN OUR PARKS AND THEY WERE CONDUCTING BUSINESS IN OUR PARKS, AND WE'VE ADDED THIS LANGUAGE. UM, WE DO ALLOW FITNESS INSTRUCTORS, LIKE WE HAVE CAMP GLADIATOR AND OUT OF SOME POP-UP YOGA, UM, OR OUT OF SOME CIRCLE, YOGA THAT FACILITATE CLASSES, BUT THEY HAVE AN AGREEMENT WITH US. UM, WE MAKE SURE THAT THEIR INSURANCE REQUIREMENTS ARE MET AND THAT ANY CERTIFICATIONS THAT THEY HAVE ARE MET, AND THEN THEY ALSO PAY A SMALL PORTION OF THE MONEY THAT THEY RECOUPED THROUGH TEACHING THEIR CLASSES TO US, WHICH HELPS US PUT THAT INTO THE MAINTENANCE OF THE PARKS. AND SO WE WANT TO MAKE SURE THAT ANYBODY WHO'S CONDUCTING BUSINESS IN THE PARKS IS APPROVED, HAS A PERMIT TO DO SO. UM, WITHOUT ALL OPEN THE FLOOR FOR ANY DISCUSSIONS, SINCE WE MADE SOME CHANGES, WE JUST BROUGHT THIS BACK TO YOU FOR DISCUSSION. UM, BASED ON WHAT WE HEAR THIS EVENING, OUR PLAN IS TO COME BACK TO YOU, UM, VERY QUICKLY WITH A PROPOSED ORDINANCE UPTAKE THAT REFLECTS WHAT WE HEARD THIS EVENING. JANE, I LOVE THE CHANGES. UM, WE, WE CAN'T JUST LOOK AT THIS INDIVIDUAL BUILDING SITE, BUT IT'S IMPORTANT THAT WE ENSURE THAT THE ENTIRE CAMPUS, UH, REMAINS COMPLIANT WITH THE TOWN'S PARKING REQUIREMENTS. AND THAT IS INDEED THE CASE HERE, UH, BASED ON THE PARKING REQUIREMENTS FOR THIS SITE, UH, 744 SPACES ARE REQUIRED, AND THEY ARE EXCEEDING THAT MINIMUM REQUIREMENT. UM, BUT JUST UNDER 20 SPACES, UH, THE EXTERIOR APPEARANCE OF THE, UH, NEW BUILDING THAT IT HAS A VERY UNIQUE AND ATTRACTIVE DESIGN. UM, MUCH OF IT IS COMPRISED OF, UH, TAN COLORED BRICK, MASONRY, UH, LIKE MANY, UH, INSTITUTIONAL BUILDINGS. IT'S IMPORTANT TO HAVE, UH, LOTS OF GLAZING AND LIGHT AND, UH, GREENHILL, UH, CERTAINLY DID THAT, UH, WITH THIS PROPOSAL ON THE SOUTH AND EAST SIDE OF THE BUILDING, THEY REALLY DID A NICE JOB OF PROVIDING SIGNIFICANT GLAZING AND CURTAIN WALL TO PROVIDE VIEWS OF THE APPLAUSE OF AN OPEN SPACE AREAS THAT SURROUND THE BUILDING. SO REALLY PROBABLY THE MOST CHALLENGING ASPECT OF THE DEVELOPMENT REVIEW PROCESS RELATED TO TREE PRESERVATION AND THE INTEGRATION OF NEW LANDSCAPE, AS WELL AS THE MITIGATION OF TREE CANOPY THAT WAS LOST AS A RESULT OF THIS PROJECT. SO, UH, JUST TO CLARIFY, UH, THE TOWN'S TREE MITIGATION REQUIREMENTS DO APPLY TO THIS SITE. AND ALSO BECAUSE THIS PROJECT IS, UH, UH, REQUIRES A SPECIAL USE PERMIT, ALL THE TOWNS LANDSCAPE REQUIREMENTS APPLY AS WELL. UM, SO WITH THAT, UH, GREENVILLE DID PROVIDE A, UH, LANDSCAPE PLAN, UH, WITH THE SUBMITTAL, UH, PROPOSED PLANTINGS, UM, UH, ARE REALLY INTENDED TO REPLACE WHAT WAS LOST AND ALSO TO FILL IN ANY GAPS, UM, THAT WEREN'T ALREADY ADDRESSED BY THE EXTENSIVE LANDSCAPE ON THE CAMPUS. SO WITH THAT PROPOSED LANDSCAPE PLAN, THEY ARE ADDING 284 CALIBER INCHES OF NEW TREES, ALL QUALITY TREES APPROVED, UH, AND, UH, ALLOWED BY THE TOWN'S LANDSCAPE ORDINANCE. AND MOST OF THOSE TREES ARE AT LEAST EIGHT INCHES IN DIAMETER AT PLANTING, UH, WITH THIS SITE. UM, THEY WERE REALLY, UH, VERY, UH, UH, SIGNIFICANT CHALLENGES AS IT RELATES TO TREAT PRESERVATION, UM, MUCH LIKE YOU RECENTLY SAW WITH TRINITY CHRISTIAN ACADEMY. UH, THE BOTH OF THESE INSTITUTIONS HAVE DONE A WONDERFUL JOB OVER THE YEARS OF PLANTING TREES ON THEIR CAMPUSES AND THOSE TREES THAT HAVE GROWN AND MATURED AND, AND REALLY PROVIDED AN OUTSTANDING CANOPY. HOWEVER, THEY BOTH MASSIVE PLANTS THEY'RE CONTINUING TO GROW AND EVOLVE. AND SO WHEN YOU HAVE, UH, THAT GROWTH AND EVOLUTION, UH, FREQUENTLY TREES GET IMPACTED. SO, UM, WITH THIS, UH, THERE IS SOME PRESERVATION THAT WAS DONE, UH, LARGELY BETWEEN IN THE DESIGN OF THE BUILDING. SO THERE WERE ACTIONS DONE TO, TO ACHIEVE SOME PRESERVATION, BUT EVEN WITH THAT, UH, JUST UNDER 365 INCHES OF MATURE TREES, UH, ARE REQUIRED TO BE REMOVED, UH, WITH THIS PROJECT. UM, ALSO, UH, THE, UH, GREENHILL IS PROPOSING TO RELOCATE ONE MATURE, UH, 26 INCH, UH, PECAN TREE. SO THE GAP BETWEEN WHAT IS PROPOSED WITH THEIR LANDSCAPE PLAN AND WHAT IS BEING REMOVED AS A RESULT OF THIS PROJECT, UH, IS, UH, JUST UNDER 81 INCHES OF TREE PLANTINGS. SO WHEN WE DID VISIT WITH THE PLANNING ZONING COMMISSION, THAT WAS A POINT OF DISCUSSION. AND ONE OF THE DRIVERS OF THAT DISCUSSION WAS, UM, IF THOSE TREES WERE GOING TO BE PLANTED, UM, THE CHALLENGE WITH THEIR SITE IS THEY CAN ONLY PLANT SO MANY TREES AROUND THE SCIENCE BUILDING. IF YOU TRY TO GET THOSE 80 EXTRA INCHES IN THE IMMEDIATE VICINITY OF THE SCIENCE BUILDING, YOU REALLY WOULDN'T HAVE A CONDITION WHERE THE TREES WOULD NOT GROW PROPERLY BECAUSE THEY'RE TOO CLOSE TOGETHER. SO THE, THE QUESTION OR THE PLANNING ZONING COMMISSION WAS, HOW DO YOU ADDRESS THOSE REMAINING 80 INCHES? ONE [00:55:01] OF THE THINGS WE CONSIDERED, UH, THERE'S A PARKING LOT TO THE NORTHWEST OF THE NEWLY PROPOSED BUILDING. UH, AND, UM, IT LACKS LANDSCAPE. IT'S NOT PART OF THE SCOPE OF THIS PROJECT, BUT IT IS NOT A PARKING LOT THAT I WOULD SAY IS HEAVILY COVERED WITH TREES. THERE IS SOME TREE COVER, BUT IT'S ALSO A VERY BUSY PARKING LOT. SO ONE OF THE THINGS WE CONSIDERED IS HOW THAT PARKING LOT EVOLVED OVER TIME. YOU CAN SEE IN THIS AERIAL IMAGERY, IT WAS ONCE LANDSCAPE. SO OBVIOUSLY THERE WAS A NEED AS THE CAMPUS GREW. UH, AND YOU SEE THAT, UM, BETWEEN 95 AND 2001 THAT PARKING LOT, UH, WAS CREATED. AND IT REALLY WAS THE RESULT OF THE NEW BUILDINGS THAT WERE PROPOSING THE SEVENTIES. YOU CAN SEE THAT THIS IS BASICALLY FULLY ENCOMPASSING THE COVID-19 PANDEMIC. SO YOU CAN SEE THAT THIS IS, UH, BASICALLY BEEN COMING DOWN, UH, FOR THE ENTIRE SPECTRUM THAT SHOWN HERE. UM, I THINK THE LAST NUMBER THAT CAME OUT, WHICH WOULD EXPAND BEYOND THIS WAS A 4.6%, THE NATIONAL AVERAGE, SO TRENDING IN THE RIGHT DIRECTION. AND WE HAVE OUR HOTEL, UH, REVENUE PER AVAILABLE ROOM TO THE RIGHT OF THAT. AND YOU CAN SEE THAT, UH, DURING THE SPRING, WE, WE RAMPED UP A LITTLE BIT, HAD A LITTLE BIT OF A DIP THERE, UH, IN JULY AND AUGUST THERE THAT CAN, UH, BE ATTRIBUTED A LITTLE BIT TO THE DELTA AREA THAT CAME THROUGH. AND WE SEE THAT PICKING BACK UP, UH, WITH WHAT WE'VE SEEN THAT IN SEPTEMBER AND OCTOBER, UH, WE HAVE OUR ADDISON HOTEL STATISTICS TO THE RIGHT OF THAT, AND WE HAVE THE GREEN BAR, WHICH IS OUR ROOM RATE. AND YOU CAN SEE ROOM RATES HAVE RISEN, UH, OVER THE PAST YEAR AND WE HAVE OUR REVENUE PER AVAILABLE ROOM, WHICH YOU CAN ALSO SEE AS RESIDENT. AND THEN WE HAVE OUR HOTEL OCCUPANCY, WHICH HAS RISEN AS WELL, AGAIN, A SLIGHT DIP THERE, AND THEN JULY AND AUGUST, AND WE APPEAR TO BE REBOUNDING TO WHERE WERE IN THE SPRING SUMMER. AND THEN WE HAVE OUR OCCUPANCY INDICATORS. UH, THESE ARE COMPARING, UH, FOURTH QUARTER OF 20, 20 TO FOURTH QUARTER OF 2021 OFFICE OCCUPANCY, A SLIGHT DECREASE IN 1.1% THAT WE HAVE OUR RETAIL OCCUPANCY, A SLIGHT DECREASE IN THE ONE AND A HALF [01:35:01] PERCENT. AND THEN TO THE RIGHT OF THAT, WE HAVE OUR HOTEL INDICATORS A PRETTY, PRETTY LARGE INCREASE YEAR OVER YEAR. SO A HOTEL OCCUPANCY AT 51.8%, THAT'S A 18.6% JOB, UH, REVENUE PER AVAILABLE ROOM, UH, $47 AND 24 CENTS AT 93.4% JOB. SO WE'RE GETTING BACK TO, UH, SOME OF THE HISTORICAL LEVELS, UH, THAT, THAT WE NEED TO BE AT. UM, WHAT WE HISTORICALLY HAD BEEN AT WITH A HOTEL OCCUPANCY, UH, SOMEWHERE BETWEEN 60, 65, 70%, SOMEWHERE IN THAT RANGE, UH, REVENUE PER AVAILABLE ROOM, SOMEWHERE IN THE $65 RANGE. AND THAT'LL GET US TO, UH, REVENUE THAT WE WERE ACCUSTOMED TO PRIOR TO A LOW THEIR TOTAL PERMITS ISSUED AND VALUATION. UH, SO PERMITS, UH, NUMBER OF PERMITS, UH, ACTUALLY, UH, SLIGHTLY MORE THAN THE PREVIOUS YEAR, HOWEVER, DOLLAR VALUE OF THOSE PERMITS THAT DOWN SLIGHTLY, UH, QUARTERLY PERMIT ACTIVITY YEAR OVER YEAR TO THE RIGHT, UH, PERMIT ACTIVITY IS BASICALLY TRAINING IN LINE WITH, UH, THE LAST, UH, THREE PRIOR FISCAL YEARS. SO NOT ANY SIGNIFICANT VARIANCE THERE. THEN THE ECONOMIC DEVELOPMENT INCENTIVES, THERE ARE FIVE EXECUTED AGREEMENTS IN FISCAL YEAR, 2021. THERE WERE $33,333 PAID, AND THEN, UH, COMMITTED INCENTIVES, UH, 300, $5,333 TO THE RIGHT A FOUR QUARTER SALES TAX COMPARISON THAT YOU CAN SEE THAT ALL OF OUR COMPARISON CITIES, CARROLLTON, FARMERS, BRANCH RICHARDSON, ALL OF THEM, INCLUDING US, UH, TOWN OF ADDISON HAD A PRETTY SIGNIFICANT INCREASE, UH, FROM, UH, FISCAL YEAR 24TH, QUARTER OF FISCAL YEAR 2021 FOURTH QUARTER. AND IT'S NOT JUST THIS AREA, BUT STATEWIDE THERE'S BEEN SIGNIFICANT INCREASES IN SALES TAX. UH, FROM LAST YEAR TO THIS YEAR, THEN A FREER LOOK MONTH BY MONTH OF OUR SALES TAX COLLECTIONS. AGAIN, UH, THE BLUE BAR IS 29, 20 19. GREEN BARS ARE AT 2020 AND THE PURPLE BARS ARE 2021. SO YOU CAN SEE IN THE LAST FEW MONTHS OF 2021 VERY STRONG WITH REGARDS TO SALES TAX COMPARED TO LAST YEAR, AND THEN EVEN PRE COVID, UH, 2019 LEVELS, UH, THERE'S SOME PRETTY STRONG IMPROVEMENT THERE. UH, SO THINGS ARE TRENDING IN THE RIGHT DIRECTION AND THEN DETAIL OR SALES TAX COLLECTIONS, UH, IN TOTAL, UH, 14, UH, JUST UNDER $14.9 MILLION WAS WHAT WAS COLLECTED. IF YOU RECALL, OUR ORIGINAL BUDGET WAS ABOUT $12.3 MILLION. THERE WERE TWO BUDGET LIMITS DURING THE YEAR, UH, WHICH, UH, BUMPED THAT UP TO ABOUT 13.5 MILLION, UH, AND STILL EVEN WITH THOSE TWO BUDGET AMENDMENTS, THE TOTAL SALES TAX COMES IN AT 110% OF THAT ADJUSTED BUDGET. UH, ABOUT $1.3 MILLION BEYOND, UH, THE, UH, AMENDED BUDGET, UH, BREAKDOWN OF SALES TAX BY CATEGORY TO THE RIGHT. UH, NUMBER ONE CATEGORY IS RETAIL. NUMBER TWO, UH, ACCOMMODATIONS AND FOOD SERVICE HAS COME BACK VERY STRONG. UH, WE HAVE WHOLESALE TRADE, UH, NUMBER THREE AT 12%. AND THEN WE HAD INFORMATION AT 9% AND AT 7% CONSTRUCTION AND ALSO, UH, PROFESSIONAL AND, UH, TECHNICAL SERVICES. AND THEN WE HAVE A 5% MANUFACTURING AND THEN OTHER, UH, AT 23%, EACH OF THOSE, UH, INDIVIDUAL CATEGORIES AND OTHER, NONE OF THOSE, UH, EXCEED 4% THERE. SO VERY DIVERSE TAX SPACE, UH, WITH REGARDS TO SALES TAX, UM, ACCOMMODATIONS AND FOOD SERVICES IS TRENDING, UH, SIGNIFICANTLY, UH, GENERAL FUND REVENUE. OVERALL GENERAL FUND REVENUE, UH, IS ABOUT 103.3% OF WHAT WAS BUDGETED. A COUPLE OF ITEMS THAT, UH, WERE, WERE THE LOW BUDGET. AS I MENTIONED, THE NUMBER OF PERMITS ISSUED IN 2021. UM, WE'RE, WE'RE IN LINE WITH THE SCHOOL COLLABORATIVES, BUT THE DOLLAR VALUE OF THOSE PERMITS WAS SLIGHTLY BELOW. SO THAT'S WHY THAT REVENUE NUMBER THERE IS A LITTLE BIT LOWER THAN WHAT WAS BUDGETED AT 70%. WE HAVE A RECREATION, WHICH IS A SMALLER BUDGET BUDGET ITEM THERE ABOUT 52%, AND THEN OUR INTEREST EARNINGS, WHICH ARE HAD GONE DOWN SLIGHTLY THEY'RE AT 52%, BUT IN TOTAL, A GENERAL FUND REVENUE AT 103.3% OF THE AMENDED BUDGET, UH, GENERAL FUND EXPENDITURES, EVERYTHING IS TRENDING. UH, WELL, AS FAR AS THE EXPENDITURES GO, UH, IN TOTAL 95.9%, UH, OF THE BUDGET WAS EXTENDED THROUGH SEPTEMBER. THEN THE HOTEL FUND, UH, AS MENTIONED THE HOTEL TAXES BELOW BUDGET. UH, AS I MENTIONED, THOUGH, WE DO HAVE AN ADDITIONAL MONTH, WHICH WILL BE, UH, SLIGHTLY OVER $300,000, WHICH WILL BE INCLUDED IN THE AUDIT AND FINANCIAL [01:40:01] STATEMENTS, UH, THAT WILL BE INCREASED TO REVENUE FOR HOTEL TAXES AND ALL OF THE OTHER REVENUES AND EXPENDITURES THERE, UM, ARE WITHIN TOTAL BUDGET. UH, THE TOTAL EXPENDITURES THEY'RE AT 85.7%, UM, ALONE, UH, TOTAL BUDGET, FAIRLY SIGNIFICANTLY, UH, WHEN WE GET THAT ADDITIONAL REVENUE, UH, INTO, UM, UH, OUR AUDITED FINANCIAL STATEMENTS, UH, WE BELIEVE THAT THE ENDING FUND BALANCE SCHOOL WILL EXCEED WHAT WOULD BE ANTICIPATED WITH THE BUDGET. SO FOR THE BUDGET WE HAD ABOUT $2.7 MILLION. UH, WHEN WE GET THAT ADDITIONAL REVENUE IN THERE WOULD BE SLIGHTLY ABOVE THAT ECONOMIC DEVELOPMENT FUND REVENUES AT 97.8%, BUT JUST UNDER, UH, WHAT WAS BUDGETED, HOWEVER, THE EXPENDITURES THAT ONLY 75% SIGNIFICANTLY BELOW IT WAS BUDGETED, UH, GENERATES A SLIGHT INCREASE IN, UH, ANTICIPATED ENDING FUND BALANCE. AND AT THE END OF THE YEAR, WE HAVE OUR AIRPORT FUND, UH, OPERATING REVENUE, 107.8% OF TOTAL BUDGET. UM, SO SLIGHTLY OVERWHELMED AS BUDGET OPERATING EXPENSES AT 85.9% OF THE BUDGET PRETTY SIGNIFICANTLY BELOW. UH, SO WE DO HAVE A ANTICIPATED INCREASE THERE THAT IN ENDING WORKING CAPITAL, THE AIRPORT FUND, AND THEN OUR UTILITY FUND, UH, REVENUES AT 96%, UH, AND, UH, OPERATING EXPENSES AT 90 10.3%, UH, THERE WERE, UH, SOME CAPITAL EXPENSES THERE ABOUT 33.4% OF THOSE WERE, WERE SPENDING IN THAT FISCAL YEAR. SO TOTAL EXPENSES AND 91.9%. SO WITH THE BUDGET, UH, WE ANTICIPATED A, A, UH, UH, UH, A DEDUCTION OR A REDUCTION IN WORKING CAPITAL ABOUT 430,000, UH, WITH THIS, UH, WE'RE LOOKING LIKE WE'RE GOING TO HAVE ABOUT A $200,000, UH, POSITIVE AREAS. SO, UH, OVERALL THAT AFFECTS THE WORKING CAPITAL, UH, LOOKS LIKE POSITIVELY BY ALMOST $600,000. SO IT'S A GOOD NEWS FOR THE UTILITY FARM THERE. AND THEN WE HAVE OUR STORMWATER UTILITY FUND. UH, REVENUE BASICALLY COMES IN RIGHT AT BUDGET AT 99.9% OPERATING EXPENSES AT 96.2%. UH, AND THEN, UM, THERE WAS, UM, UH, CAPITAL PROJECTS THAT WERE BUDGETED. THEY WERE ACTUALLY GOING TO BE COMPLETED IN FISCAL YEAR 2022, WHICH WERE REBUDGETED FISCAL YEAR 2022. AND SO THAT'S WHY THOSE PROJECTS WERE DONE IN 21. UH, BUT SO WITH THAT, UH, THERE WAS AN ANTICIPATED, UH, REDUCTION IN WORKING CAPITAL, WHICH ENDS UP BEING, UM, IN ADDITION TO WORKING CAPITAL. SO ANY WORKING CAPITAL ANTICIPATED TO BE JUST UNDER $9 MILLION WITH STORM WATER UTILITY FUND, AND HERE YOU CAN SEE HOTEL OCCUPANCY TAX COLLECTIONS, UH, BY A QUARTER. AND YOU CAN SEE, UH, YOU KNOW, THIS GOES BACK TO SEPTEMBER OF 2019. YOU CAN SEE, UH, PRE COVID AND THEN KIND OF THE, THE FALL OFF AIR WITH COVID. AS I MENTIONED, THERE'S ONE MONTH OF HOTEL TAX COLLECTIONS THAT WERE NOT INCLUDED AT, WHICH WOULD BE INCLUDED, UM, WHICH WERE, WOULD BE INCLUDED FOR SEPTEMBER, UH, BUT WERE NOT RECEIVED, UM, UH, IN TIME WE PRODUCED THIS REPORT. SO, UM, WITH THAT SAID, UH, IT'S LOOKING POSITIVE. IT'S JUST NOT BACK TO THE LEVELS THAT WE WERE PRE COVID, SO WE'RE GETTING CLOSER. AND THEN OUR INVESTMENT REPORT SUMMARY, UH, SO THIS COMPARES, UH, THE, UH, VALUES OF OUR INVESTMENTS AND EARNINGS ARE IN BED OF OUR INVESTMENTS, UH, FOR THE LAST TWO QUARTERS. SO WE HAD AN INCREASE IN BOOK VALUE AND MARKET VALUE. SO WE SOLD BONDS IN THAT FOURTH QUARTER. UH, SO THAT'S WHY THERE'S A SIGNIFICANT INCREASE IN THE AMOUNT OF OUR BOOK VALUE INVESTMENTS AND OUR MARKET VALUE OF INVESTMENTS. UH, FOR THAT FOURTH QUARTER, UH, OUR INTEREST REVENUE WENT UP ABOUT 15% IN THE FOURTH QUARTER, AND THEN OUR WEIGHTED AVERAGE YIELD TO MATURITY WENT UP ABOUT 4%. SO ALL POSITIVE SIGNS ON THE INVESTMENT FRONT, UH, ALL OF THE INVESTMENTS WERE MADE IN ACCORDANCE WITH, UH, THE PUBLIC FUNDS INVESTMENT ACT AND OUR POLICY. SO WITH THAT, I'LL BE HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE ABOUT THE FOURTH QUARTER REPORT. IT LOOKED TO ME, THE ONE WOULD CONCERN MOST IS HOTEL PHONE, BUT IT'S COMING BACK QUICKLY. SO INSTEAD OF A 13% COVID-19 HIT RIGHT NOW, IT WENT UP TO ALMOST 52%. WE'VE BEEN, WE'VE BEEN OVER 50% PRETTY CONSISTENTLY WITH THE, WITH THE OCCUPANCY. UM, I THINK THERE WAS, THERE [01:45:01] WAS MAYBE ONE OR TWO WEEKS OVER THE LAST FOUR OR FIVE MONTHS THAT IT'S BEEN LOWER THAN 50%. SO, SO WE'RE SEEING SOME POSITIVE SIGNS, UM, BUT WE WANT TO GET TO THAT 60 TO 70% LEVEL. AND, UM, THAT'LL GET US BACK TO MAYOR PARK, THE, UH, OR THE INCREASES ALSO DUE TO THE MARKETING. THAT'S BEEN POSITIVE MARKETING, OUR STAFF PUT FORWARD. YEAH, MARRIED, BUT I THINK THE NEXT MEETING YOU'LL GIVE HER, YOU'RE GOING TO GIVE US AN UPDATE. I BOUGHT THE RESTAURANT MONTH.
