SO THE REQUESTS YOU HAVE BEFORE YOU TONIGHT IS FOR A SPECIAL USE PERMIT FOR A NEW RESTAURANT IN AN EXISTING RESTAURANT TENANT SPACE.
AND THEN ALSO, UH, FOR THE SALE OF ALCOHOLIC BEVERAGES, UH, FOR ON PREMISES CONSUMPTION ONLY, UH, THE LOCATION OF THE REQUEST IS IN THE VILLAGE ON THE PARKWAY DEVELOPMENT IN THE SOUTHERN QUADRANT OF THE SITE, ADJACENT TO THE LAZY DOG RESTAURANTS, AS WELL AS STAIRS.
IT IS IN THE FORMER MERCY, UH, RESTAURANT TENANT SPACE.
SO THIS REQUEST IS REQUIRED, UH, DESPITE THERE BEING, UH, SEVERAL EXISTING, UH, SPECIALTIES PERMITS FOR, UH, BOTH THE SALE OF ALCOHOL BEVERAGES FOR ON PREMISE CONSUMPTION, AS WELL AS, UH, THE SALE OF BEER AND WINE FOR OFF PREMISES CONSUMPTION BECAUSE THE PROPOSED, UM, APPLICANT DISTRICT, UH, IS GOING TO BE DOING SOME INTERIOR REMODELING AND THAT WILL RESULT IN SOME MODIFICATIONS TO THE BAR AREA, UH, AS IT'S TYPICAL, UH, IN THE TOWN, UH, WHEN THAT DOES OCCUR, UH, IN EXISTING RESTAURANT TENANT SPACES, A NEW S P IS WARRANTED.
UM, SO WITH THE VILLAGE ON THE PARKWAY, UH, DEVELOPMENT, UH, AS YOU'RE AWARE, UM, THE INITIAL ZONING, UH, FOR, UH, THE CURRENT ITERATION OF THE CENTER WAS ESTABLISHED IN 2012, YOUR PD, AND THEN ALSO THE COMMISSION RECENTLY ADOPTED IN 2020 SOME MODIFICATIONS TO THAT PD TO ACCOUNT FOR AN ADDITIONAL NON-RESIDENTIAL SPACE AND THE NORTHERN QUADRANT OF THE CENTER.
AND THEN ALSO, UH, SOME PARKING, UH, MOBILITY AND INFRASTRUCTURE IMPROVEMENTS, UH, IN THE, UM, CENTER AS WELL TO INCLUDE LANDSCAPING IMPROVEMENTS.
UH, WITH THIS REQUEST, A DISTRICT IS ONCE AGAIN, PROPOSING TO OCCUPY AN EXISTING 10TH SPACE AND HAVE ALCOHOL SALES FOR ON-PREMISE CONSUMPTION.
SO PROPOSED RESTAURANT USE, UH, THE INTERIOR FLOOR AREA WOULD BE JUST OVER 3000 SQUARE FEET.
AND AS, UH, CURRENTLY EXISTS, THERE IS A PATIO, UH, IN THE, UH, EXISTING TENANT SPACE.
IT HAS 716 SQUARE FEET OF FLOOR AREA.
UM, THERE IS CURRENTLY A PATIO COVER, UH, THAT EXISTS AT THAT SPACE AND THEY ADVOCATE DOES PROPOSE TO, UH, REMOVE THAT, UH, WITH THIS, UH, REMODEL, UH, ALSO, UH, SEATING FOR THIS PROJECT AND ACCOMMODATES 94, UH, UH, SPACES FOR 94 SEATS INDOORS, AND THEN ALSO 40 ON THE PATIO.
UM, AS YOU CAN SEE FROM THE FLOOR PLAN, UH, IT'S QUITE OPEN, UH, YOU DO HAVE A BAR, UH, UH, CENTRALIZED IN THE, UH, INTERIOR SPACE, AND THEN YOU HAVE DINING, UH, UH, SPACE THAT LINES, THE PERIMETER OF THAT BAR.
SO WITH THE EXISTING CONDITION AND THE VILLAGE ON THE PARKWAY DEVELOPMENTS, UH, THE CURRENT PARKING SUPPLY, UH, EXCEEDS THE, UH, PARKING REQUIRED BY THE PLAN DEVELOPMENT DISTRICT, UH, GIVEN THAT THIS USE IS PROPOSED IN AN EXISTING SPACE AND DOES NOT REQUIRE ADDITIONAL FLOOR AREA, UH, NO ADDITIONAL PARKING WILL BE REQUIRED, UM, FOR OPEN SPACE

AND LANDSCAPE.UH, ONCE AGAIN, THIS IS AN EXISTING SPACE, IT DOES HAVE THREE MATURED STRAIGHT TREES ALONG ITS FRONT-STAGE, AND IT DOES ALSO HAVE A, AN ESTABLISHED LANDSCAPE AREA, UM, BETWEEN THIS SPACE AND THE LAZY DOG SPACE, AND NO ADDITIONAL LANDSCAPE IS REQUIRED TO COMPLY WITH THE PD OR AS PART OF THIS SEP REQUEST.
THE, UM, FACADE MODIFICATIONS THAT ARE PROPOSED ARE VERY LIMITED.
UM, MOST IMPACTFUL IS THE REMOVAL OF THE PATIO COVER.
AND BEYOND THAT, THEY'RE PRIMARILY PROPOSING A MINOR PAINTING, AS WELL AS THE ADDITION OF SOME, UH, NEW PATIO FRICTIONS.
ACCORDING IT'S WITH COMMON STATE REQUIREMENTS OF DID PROVIDE PUBLIC NOTICE TO ADJACENT PROPERTY OWNERS WITHIN 200 FEET OF THE SUBJECT PROPERTY THAT INCLUDED FIVE OR SIX SEDANS.
WE HAVE NOT RECEIVED ANY FEEDBACK ON THIS REQUEST AT THIS TIME WITH THIS STAFF DOES RECOMMEND APPROVAL OF THEIR REQUESTS, UH, WITH THE TYPICAL CONDITION, UH, FOR, UM, UH, UH, RESTAURANTS THAT ARE PROPOSING ALCOHOL SALES, THAT APPLICANT SHALL NOT USE ANY TERMS OR GRAPHIC, THE PATIENTS THAT RELATE TO ALCOHOLIC BEVERAGES AND ANY EXTERIOR SIGNAGE.

SO WE WOULD LOOK AT THAT AS PART OF THE OVERALL SITE PLAN, AND TYPICALLY WE WOULD HAVE THE, UH, THE APPLICANT, UH, THEY'RE TYPICALLY REQUIRED TO EMPLOYED AN ADA CONSULTANT TO DO THAT REVIEW.
THAT IS TYPICALLY BEYOND THE SCOPE OF THE REVIEW FOR STAFF, SO THAT ADA CONSULTANT ESSENTIALLY SERVES AS A, UM, PROFESSIONAL, UH, DESIGN, UH, EXPERT WITH REGARDS TO ADA DESIGN.
AND THEY WOULD ESSENTIALLY HAVE TO, UH, INSPECT AND ENSURE AND PROVIDE COMMUNICATIONS THAT WHAT IS PROVIDED COMPLIANCE AND ADA REQUIREMENTS.
THE REASON I ASKED HIM NOW SPECIFICALLY TO THIS THERE'S AN ADA SPACES ON THE NORTH OR EAST AND WEST SIDES, BUT I CAN'T SEE NECESSARILY HOW SOMEONE PARTICULARLY SOMEONE HAS BEEN FINDING THE WHEELCHAIR TO BE ABLE TO GET IN TO THE RESTAURANT OR, UM, OTHER THAN GOING THROUGH THE PARKING LOT, UM, BECAUSE OF THE EXISTING PATIO, THAT'S THERE PRETTY WELL COVERS UP THE SIDEWALK THROUGH FAIR.
YOU'VE GOT TO KIND OF GO AROUND THAT AND PROBABLY NOT A PROBLEM FOR MOST EVERYBODY EXCEPT SOMEONE IN WHEELCHAIR.
SO I DIDN'T KNOW IF YOU GUYS REVIEW THAT OR, OR WHAT WAS THE SITUATION.
SO WE WOULD TYPICALLY REQUIRE SOMEONE TO DEMONSTRATE THAT THE IMPROVEMENTS COMPLY WITH ADA.
